52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) Be advised that the Government is conducting this acquisition using simplified acquisition procedures in accordance with FAR Part 13. The Government will award one (1) IDIQ contract resulting from this solicitation to the responsible Offeror whose quote conforming to the solicitation is the Lowest Price Technically Acceptable (LPTA).
The factors listed in the 52.212-2 Addenda below shall be used to evaluate quotes.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options (FAR 52.217-8 Option to Extend Services period) to the total price for the basic requirement. See Factor 2 Price for additional details. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
52.212-2 ADDENDA – EVALUATION – COMMERCIAL ITEMS
This is a competitive LPTA solicitation. This section outlines the criteria the Government will use in evaluating the Offeror’s technical capability and quote for the mountain wilderness and extreme cold weather training.
All quotes received from eligible Offeror s will be initially evaluated for completeness and conformance with the RFQ instructions. Incomplete and nonconforming quotes will not be further evaluated.
All complete and conforming quotes will be considered in terms of price, lowest to highest, and then the apparent lowest-priced Offeror will be evaluated for acceptability under the Factor 1 - Technical Capability. If the lowest-price Offeror is determined technically unacceptable, the acceptability of the next lowest-price Offeror will be evaluated, continuing this process as necessary until the LPTA Offeror is identified. The Government reserves the right at its discretion (but is not required) to seek additional information from the lowest priced Offeror for evaluation and award purposes without seeking information from other Offerors or allowing other Offerors to submit revised quotes.
The following factors shall be used to evaluate quotes:
Factor 1 – Technical Capability Factor 2 – Price
A finding of Unacceptable in Factor 1 shall result in the entire quote being determined unacceptable and, therefore, ineligible for award. The Government shall evaluate the Technical Factor using the following adjectival ratings
Adjectival Rating Description
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Discussions. IAW FAR 52.212-1(g), the Government intends to evaluate quotes and award a contract without discussions. Therefore, the Offeror’s initial quote should contain the Offeror’s best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. Offerors may be asked to clarify certain aspects of their Technical and/or Price quote.
*Exchanges conducted with regard to resolving/clarifying minor or clerical errors in any of the quote volumes will not constitute discussions and the Contracting Officer (CO) reserves the right to award a contract without granting an opportunity to revise the original quote.
FACTOR 1 – TECHNICAL CAPABILITY: The Government will evaluate information submitted by the Offeror for this factor and will make an acceptable or unacceptable rating. Acceptable is defined as the Offeror’s technical capability and approach clearly demonstrating the ability to meet the requirements outlined in Attachment 1 – Performance Work Statement. Unacceptable is defined as the Offeror’s technical approach not meeting the requirements outlined in Attachment 1 – Performance Work Statement.
The Government will evaluate the Offeror’s description of HOW the training course requirements will be satisfied to include the following information: 1) information relative to the training locations and any associated permits that may be required at the specified locations and 2) the experience of the specific instructor personnel (key personnel) providing services same/similar to those required under PWS paragraph 4.3. Evaluation of the below documents/pictures will demonstrate the Offeror’s knowledge, skills, and abilities to provide safe, professional and successful training.
i) Identification of Certifications and Qualifications (by name) required under PWS para 4.3
ii) Copy of Commercial Use Authorizations Certificate (CUA) and/or a Concession Contract
iii) DRAFT of Course Schedule(s) (Reference PWS para 4.4.1)
iv) DRAFT of Training Plan(s) (Reference PWS para 4.4.1)
v) DRAFT Gear/Equipment List (Reference PWS para 4.6)
vi) DRAFT Group Meal Plan (Reference PWS para 4.6)
vii) Visual Representation (Comprehensive Pictures) demonstrating the Offerors Group Gear Inventory along with Inventory Summary (i.e. Items, Sizes, Amounts, etc…) (Reference PWS para 4.6)
viii) Description of Food Preparation Area and Example List of Meal Preparation Items that will be available for packing (examples: carbohydrate bars, energy gels, packaged dry meats, food storage bags, food scale, …. ) (Reference PWS para 4.7.5)
ix) Visual Representation (Comprehensive Pictures) of Facility and Camping Area (inclusive of Shower/Sink/Bathroom facilities). Include specifics about both the Facility and Camping Area. (Reference PWS para 4.7 and 4.11)
x) Safety and Emergency Management Plan to include Visual Representation of Operations Center and Name of Doctor(s) utilized. (Reference PWS para 8.3)
xi) COVID-19 Spread Mitigation Plan (Reference PWS para 15.3)
xii) Copy of Vendor(s) Liability Insurance (Reference PWS para 16)
The technical capability evaluation will be based upon the Offeror’s thorough and complete comprehension of the requirement.
In addition, The Government will evaluate the Offeror’s technical volume to confirm:
i) The Offeror made the affirmative statement that all COIs shall include, at a minimum, the topics identified in the PWS (2.2, 2.3, and 4.5).
ii) The Offeror made the affirmative statement that all COIs identified in the PWS will be instructed Live in-person (not virtual).
iii) The Offeror made the affirmative statement that it has the ability to provide all COI materials, equipment/gear, permits, personnel, management and facilities to meet the standards of training as identified in the PWS.
iv) The Offeror made the affirmative statement that all Instructors meet the experience and certification requirements as outlined in Section 4 of the PWS.
v) The Offeror made the affirmative statement that it has the ability to successfully and safely conduct the COI at each of the locations as indicated in the PWS.
vi) The Offeror made the affirmative statement that it maintains/has the ability to provide (quickly) supplies on hand to provide replacement items (for sale) as needed for safe training utilization.
vii) The Offeror made the affirmative statement that it shall maintain the appropriate Liability Insurance coverage throughout the duration of the contract period of performance.
FACTOR 2 – PRICE: All prices proposed in Attachment 2 – Exhibit Line Item Pricing Spreadsheet, including the option permitted under FAR 52.217-8, will be evaluated for price reasonableness in accordance with FAR 13.106-3.
Note that pricing for all items is required, otherwise the quote will be considered ineligible for award. The Government will evaluate quotes for award purposes by adding the total prices for all five years (utilizing the assumption that there will be 1 course of instruction per each number of students for both the spring/summer and winter courses during each ordering period), and the six-month extension via FAR 52.217-8. The evaluated price of the option under FAR 52.217-8 will be calculated by the Government at 50% of the total price for Year 5. The total evaluated price will be automatically formulated by the Microsoft Excel spreadsheet provided by the Government, by calculating the Offeror’s proposed pricing. The Offeror shall not alter formulas in the Microsoft Excel spreadsheet provided by the Government.
