Responses to questions received. Survival Gear/Kits – Solicitation H92240-22-R-0004.
Q1. Each of the price sheets has cells which are blacked out, but also have a Preferred Manufacturer listed. Please confirm that the following manufacturers are preferred for these lines:

C008 – Sure-Fire C009 – Mares Diving C010 – Omega Pacific C011 – Omega Pacific C012 – Black Diamond Equipment C013 – Cascade Designs C014 – Suunto USA C016 – XCEL International, Inc.

R1. The cells for these ELINs were originally shaded out and are not subject to the required manufacturer. The pricing sheets have been reposted and underlying text removed in these cells for these ELINs as of 22 February 2022.
Q2: Due to the unpredictability and volatility of the current market and supply chain, five-year pricing is not available from many suppliers. Would the Government consider removing the five-year pricing, and instead include FAR Part 16.203 to allow for economic price adjustments?
FAR Part 16.203-3 states “that it is necessary either to protect the contractor and the Government against significant fluctuations in labor or material costs or to provide for contract price adjustment in the event of changes in the contractor’s established prices.” As such, including contract clauses 52.216-2 or 52.216-3 to allow for economic price adjustments that will most likely work in the Government’s favor as prices will likely decrease as the market regulates.
R2: Economic price adjustment language will not be included under this action. All items listed under this procurement action are commercially available items and the Government will require these items over the long term. A reduction in the period of performance of this contract under five years will not be undertaken.
Q3: For items A002, this was included on the sole source document as a name brand due to Code B - "Only item satisfying unique NSW mission requirements and no alternate product is able to satisfy these requirements." If we have a product which does meet the requirements (NSF 231 certified) and also eliminates the need for item A003, is the vendor permitted to submit?
R3: For items on pricing sheet where a manufacturer is listed in the Preferred Manufacturer column, only the named manufacture, product/part number is permitted. No substitutions are permitted.
Q4: For ELIN C007, please confirm the desired boot color
R4: The desired boot color is tan. Pricing sheets will be updated prior to issuance of any award to incorporate boot color.
Q5: Is the Government able to provide insight on the expected annual kit quantities per location?
R5: A vast majority of historical purchases of Survival Gear Kits has occurred in the San Diego, CA location ($5M over four years). However, the Government anticipates meaningful increases of Kit purchases for Kodiak. The Government anticipates that other location purchases will primarily involve procurement of individual items not Kits. NOTE: Stennis, Mississippi location is removed from the solicitation.
Q6: For ELIN C019, the item description provided is for a non-Berry compliant tent (Hilleberg Tent). Please confirm if we can submit non-Berry items that are readily+ available COTS.
R6: Items that are required shall comply with both the Buy American and Berry Amendment source restrictions. If a US domestic source is not available, the Government may choose to pursue a waiver of these source restrictions. Compliant products are preferred. If an offeror believes no compliant source exists, offeror shall submit with their quote support information relating to findings in the marketplace of non-availability of Buy American or Berry Amendment products.
Q7: Are any alternatives allowed to be submitted for items listed in the Brand Name Justifications, particularly if the sole source OEM will not provide pricing for their products?
R7: For products supported by a brand name justification, where a manufacturer is listed, no alternate product proposal is permitted.
Q8: The language in the Pricing spreadsheet(s) states, “…Provide product description to include manufacturer name and description of product (if shaded in, only the listed product and part number is permitted)”; however, the only shading on the sheet(s) are blacked out boxes - which do not have part numbers. Can the USG provide the OEM & P/Ns requested in the spreadsheets and/or Clarify the language in the price spreadsheets?
R8: All interested parties are highly encouraged to read solicitation terms and conditions in their entirety. For item descriptions whether the Preferred Manufacturer and Part Number columns are shaded, requires the offeror to submit a product that satisfies the Item Description and identify the relevant information requested under the light blue shaded Product Proposed and Part Number areas.
Unique Identification Clauses: Via Amendment 01, the Government has added Unique Identification Clauses. These DFARS clauses shall apply to any items with a unit acquisition cost at $5,000 or above. If a kit is valued at this level, these clauses shall apply.
