Survival Gear Kits Naval Special Warfare Command
Survival Gear
1. BACKGROUND
1.1. Naval Special Warfare Command (NSWC) requires delivery of multiple, individual, commercial item components to support various training activities. In general, the gear required supports outdoor activities, to include camping and providing human needs including but not limited to shelter, warmth, and safety in a wide variety of climates.
For terms of this procurement we will refer to it as Survival Gear.
2. OBJECTIVE
2.1. NSWC requires various types of Survival Gear to be utilized in various training exercises in multiple types of climate. Multiple delivery location will be required and are listed under paragraph 4.1. To satisfy requirements for re-occurring survival gear requirements, establishment of a five-year, indefinite-delivery, indefinite quantity type contract is required. The Government intends to issue orders against this contract to satisfy reoccurring requirements
3. DESCRIPTION OF REQUIREMENT
3.1. Product Name: Survival Gear Kits
3.2. Description and Capabilities: List of products required are located under multiple excel spreadsheets. Each excel spreadsheet contains the same products required under listed Exhibit Line Item Numbers (ELINs) and each spreadsheet represents a specific location as labelled. A total of three tabs exist under each spreadsheet. The ‘ALL ELIN’ contains all components required and the remaining two involve creation of three Kits. Kits are comprised of items listed under the ALL ELIN tab of the excel spreadsheet.
3.3. Delivery timelines: Delivery timelines have been established by each individual product (ELIN) and are located under the ALL ELIN tab of each spreadsheet. If multiple items are being delivered, the delivery date shall be the product with the longest delivery timeline unless an alternate schedule is agreed upon by both the Contractor and the Government.
3.4. Packaging: All Kits shall be consolidated and shipped in a single, complete package, preferably a sealed plastic bag and include a packing slip of contents. Kits should be packaged on pallets in tri-walls. Single items or ones that are not part of the kits should be shipped in a tri-wall or as specified in the task order.
3.5. Buy American Act and Berry Amendment (BAA):
3.5.1. Procurement is subject to the Buy American Act and Berry Amendment (textiles and tools). Offerors are required to disclose the country of origin for all listed items. DoD has determined it inconsistent with public interest to apply restrictions of the Buy American statute or Balance of Payments Program to the acquisition of qualifying country end products. List of qualifying countries are located under Defense Federal Acquisition Regulation Supplemental (DFARS) 225.872-1. Any proposed product that is not domestically manufactured or from a qualified country as defined under DFARS 225.872-1 may be rejected. Any items subject to the Berry Amendment, textiles and tools, are required to be made in the United States unless an exemption applies.
3.6. Non-Availability of Product: Contractor shall be pro-active in determining upcoming non-availability of product by monitoring marketplace conditions for changes in availability or discontinuation of product. Contractor shall notify the Government in writing no later than sixty (60) days before a component is to become non-available and shall provide replacement product detail to include: new part name, new part number, name of manufacturer, and country of origin of product.
3.6.1. As requested, the Contractor shall assist the Government in obtaining a domestic non-availability determination (DNAD) where appropriate at the Government’s discretion by providing information relevant to Defense Federal Acquisition Regulation Supplement (DFARS) 225.7002-2, including but not limited to market research findings and supporting documentation, analysis of alternatives, potential impacts, and contractor’s corrective plan.
3.6.2. Refresh: In order to address any items listed under the spreadsheet becoming non-available, the Government intends to permit a quarterly refresh of ELINS. ELINs becoming non-available shall be disclosed and the information listed under paragraph 3.6 shall be submitted to the Government. The Government shall notify the contractor, no later than thirty days after receipt, whether the proposed substituted product is acceptable.
Acceptance of alternate product is at the sole discretion of the Government. If a suitable replacement component, compliant with the BAA cannot be found, the Government shall have the unilateral right to remove non-available items from the ELIN spreadsheets. Any new items proposed due to non-availability or other reason, will be added or substituted into the contract only after the Government has determined the proposed price of the added/substituted item has been determined fair and reasonable in accordance with FAR 13.106-3(a).
3.6.3. Pricing: Prior to executing changes to the ELIN Spreadsheets, the Government shall determine any unit pricing fair and reasonable in accordance with the procedures described under Federal Acquisition Regulation (FAR) 13.106-3(a).
3.6.4. Additional components: The Government may procure items not listed under original or revised ELIN spreadsheets at the order level. Items shall be incorporated into all ELIN sheets at least every three months and must be determined fair and reasonable prior to issuance of order in accordance with FAR 13.106-3(a).
4. DELIVERY INFORMATION
4.1. Deliveries shall be to the following locations as represented by the following SURVIVAL GEAR PRICE LISTS:
4.1.1. San Diego, California (Addenda 02A)
4.1.2. Virginia Beach, Virginia (Addenda 02B)
4.1.3. Stennis Space Center, Mississippi (Addenda 02C)
4.1.4. Kodiak, Alaska (Addenda 02D)
4.1.5. Pearl Harbor, Hawaii (Addenda 02E)
4.2. Delivery information to include point of contact to be provided at order level.
5. SECURITY: Not Applicable
6. QUALITY ASSURANCE
6.1. The Government reserves the right to perform inspections and surveillance to evaluate the Contractor’s compliance to the contract terms to include proper delivery of quantity and type of goods. The Government will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner.
