52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The Government is utilizing simplified acquisition procedures defined under FAR Subpart 13 as authorized by
FAR Subpart 13.5.
Quoter Acceptability
We will evaluate the acceptability of quotes and quoters on a pass or fail basis. We will consider a quote to be acceptable if (1) it is received from an eligible 8(a) small business, (2) is prepared in compliance with the instructions in this RFQ and unconditionally assents to all terms of the RFQ, including all listed attachments, (3) is received from a quoter who holds an active Secret Facility Clearance, and (4) the proposed Key Personnel meets the minimum requirements and the quoter has a signed letter(s) of intent for this/these position(s).
Failure to meet any of the acceptability requirements will make your quote unacceptable and may make you ineligible for contract award.
Quoter Capability
We will evaluate the extent to which the quoter’s oral presentation and responses to our questions show that your firm
(1) understands the contract requirements and (2) persuades us that your firm has the capability and experience to perform this contract. We will consider the extent to which your firm has provided services similar to the services contemplated by this solicitation and the degree your firm has had the opportunity to face and learn how to overcome managerial and task performance challenges similar to those you may confront under this effort.
Price
We will evaluate your pricing submission for completeness and use appropriate procedures prescribed by FAR
13.106-3 to evaluate the fairness and reasonableness of your price. We will not evaluate price realism. Pricing for both the Basic Pricing Sheet and Task Order Pricing Sheet shall be evaluated. The Government may request additional price information. If proposed pricing cannot be determined fair and reasonable in accordance with
FAR 13.106-3 the Government may no longer consider your submission for award.
Contract Award
The Government will award to the firm whose quote is acceptable and represents the best value to the Government based upon evaluation of Capability and Price. Capability is more important than Price. As the difference in Capability becomes less distinguished between quoters, Price becomes a more discriminating factor.
(b) Options. The Government will evaluate offers for award purposes by adding the total price submitted pricing for all option periods to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the
Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
