If, however, a contract is awarded to this offeror as a result of -- or in connection with --the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government’s right to use information contained in this data if it is obtained from another source without restriction. (End of provision)
52.212-2 Evaluation -- Commercial Items (JAN 1999):
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate quotes are in descending order of importance:
Technical Capability: The quote will be evaluated to identify how well the vendor is capable of providing the government’s base contract PWS requirements as outlined in Attachment (1). Additionally, the quote will be evaluated on the vendor’s ability to meet the delivery time line.
Experience: The quote must demonstrate the vendor’s ability to provide highly-skilled subject matter experts across the range of functions delineated by the PWS. Key personnel resumes will be evaluated to ensure the personnel proposed possess the relevant experience to perform the tasks detailed in the PWS. In order to receive credit for his/her experience, each key personnel resume shall clearly describe the work performed, the time frames of that performance, and a current Government point of contact (email address and telephone number) who can be contacted to verify the aforementioned.
Price: The evaluated price will be determined using the data supplied by the vendor when completing Attachment 2. Specifically, the Government will calculate a total evaluated price using the following methodology:
• An annual net total price for each year of the 5-year ordering period will be calculated by multiplying 3 X each of Exhibit Line Item Number (ELIN) prices submitted in response to this solicitation.
• In order to preserve the possibility of executing the 6-month option period discussed in FAR 52.217-8, an option net total will be calculated by multiplying 2 X each ELIN price of the 5th ordering year. Evaluation of the option price shall not obligate the Government to exercise the option.
• The six (6) net totals (five annual net totals + option net total) will be added together to calculate a single grand total.
• The Government will use the single grand total as the offeror's total evaluated price.
Technical Capability and Experience, when combined, are significantly more important than price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options, including the timeframe associated with 52.217-8, to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
