SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
L.1.
L.1. PROPOSAL INSTRUCTIONS (MAY 2021)
PART A: GENERAL INSTRUCTIONS
1. GENERAL
1.1. Section L contains instructions on how to prepare and submit proposals in response to this solicitation.
Nonconformance with these instructions may result in an unfavorable proposal evaluation and elimination from consideration.
1.2. The Government will base its evaluation on the information presented in the offeror's proposal. The offeror has the burden to submit a proposal that convincingly demonstrates that the offeror has an accurate understanding of the requirements and the associated risks; that the offeror has viable solutions for the requirements and potential risk areas; and that the offeror is able, willing, and competent to devote the resources necessary to meet the requirements.
1.3. It is the offeror’s responsibility to submit a proposal that enables Government evaluators to effectively evaluate and substantiate the validity of any assertions set forth in the offeror’s proposal. Assume the Government has no prior knowledge of an offeror’s facilities and experience. Accordingly, do not simply rephrase or restate the Government's requirements. Statements that the offeror will provide a particular feature or objective without explaining how the offeror proposes to meet that feature or objective are generally inadequate and may adversely impact the Government’s evaluation assessment of the offeror. Also inadequate are the following types of statements:
a) Unsupported statements that the offeror allegedly understands the requirements and risks.
b) Unsupported statements that the offeror allegedly can or will comply with requirements.
c) Unsupported statements that merely paraphrase the requirements.
d) Undefined or explained statements, such as “best commercial practices will be used.”
e) Undefined or explained statements, such as “standard procedures will be used.”
f) Undefined or explained statements, such as “well-known techniques will be employed.”
1.4. Alternate proposals are not acceptable. In addition, taking exception or deviating from any term or condition of the RFP may make an offer unacceptable, and the proposal unawardable, unless the RFP expressly authorizes such an exception or deviation with regard to that specific term or condition.
1.5. There is no need to repeat information in the same volume or in more than one volume. If an overlap exists, the detailed information should be included in the most logical place and summarized and referenced in other areas. With the exception of the Price Volume, no cost or pricing information should appear in any volume.
2. PROPOSAL FORMAT
2.1 ELECTRONIC SUBMISSION OF PROPOSAL
This section provides information to the offeror on the electronic format and application software used for submitting proposals. The offeror shall format proposals using a Times New Roman, 12-point normal font (no reduction permitted). A 10-point font is acceptable for Tables and Graphics. Use of the software and procedures described in this section will ensure that the proposals received are suitable for reading electronically.
2.2 ELECTRONIC PROPOSAL MEDIA
The offeror shall submit all volumes of its proposal electronically on the Procurement Integrated Enterprise Environment (PIEE) suite. See paragraph 4.1 below. All proposal information shall be marked with “Source Selection Information – See FAR 2.101 and 3.104.”
2.3 OPERATING SYSTEM AND APPLICATIONS
The Government uses the Microsoft Windows 10 Operating System to access proposals. Submit proposal information such that is compatible with the following applications: Microsoft Word 2016, Microsoft Excel 2016, Microsoft PowerPoint 2016, and Microsoft Project 2016. However, letters and other signed documentation may be provided in fully searchable Portable Document Format (.pdf) files. Use of other application software for the submission of proposals is unacceptable.
2.4 HYPERLINKS
The offeror shall not use hyperlinks in proposal volumes.
2.5 VIRUS FREE ELECTRONIC SUBMISSION
The offeror is responsible for ensuring that its electronic proposal is virus free. The offeror shall certify, in its proposal cover letter, that all electronic proposal information delivered throughout the evaluation (e.g., original proposal submission, responses to evaluation notices, Final Proposal Revisions) are virus free. The offeror shall specify the anti-virus software, version, and virus definition used to check the data.
2.6 MULTIMEDIA
In order to reduce file sizes, the offeror shall not embed sound or video (e.g., MPEG) files within the proposal submission.
2.7 GRAPHICS
Large files require greater computer system resources and are discouraged. The offeror is encouraged to—
a) Simplify the color palette used in creating figures and minimize the use of color print or graphics to the maximum extent possible;
b) Minimize size of graphics files; and
c) Avoid scanned image.
3. PROPOSAL VOLUMES
The offeror must present its proposal information in a manner that facilitates a one-for-one comparison between the information presented and Section L’s Proposal Instructions. Offerors shall structure proposal information such that its paragraph numbers/letters correspond to the proposal instructions paragraph numbers/letters, though the offeror may add lower tier sub paragraphs.
The proposal shall include a completed and signed Standard Form 33; acknowledgement of all solicitation amendments, if applicable; representations, certifications, and other statements of the offeror (Section K of this solicitation); and other applicable fill-ins.
Offerors shall submit each Volume of the proposal as one electronic copy. The offeror shall submit all electronic copies of the proposal to the address provided in paragraph 4.1.
Price information shall not be included in any volume other than Volume 2 Price.
Page limitations for each volume are specified in the table below. Proposal pages beyond the specified limit will not be evaluated. The Volume/Factor cover sheet, if used, any included table of contents pages, if used, any acronym list, if used, and any revision pages, if used, will not be considered as part of the Page Limit and will not be evaluated.
Volume No. Volume Title Page Limit
1 TECHNICAL 30 pages
2 PRICE As needed
4. PROPOSAL SUBMISSION
All Proposals shall be UNCLASSIFIED. The submission date for all Volumes of the proposal shall be no later than the date and time specified in Block 9 of Standard Form 33 (Solicitation, Offer and Award) of the solicitation.
Offerors are hereby notified that the Government will not reimburse for any costs incurred for solicitation preparation.
4.1 SUBMISSION INSTRUCTIONS
Electronic copies of each volume shall be submitted through the Solicitation Module of the Procurement Integrated Enterprise Environment (PIEE) suite at https://piee.eb.mil/piee-landing/. Proposals submitted by mail or hand-carried will not be evaluated. Proposals sent through proprietary or third party File Transfer Protocol (FTP) sites or DoD SAFE will not be retrieved. It is the responsibility of the Offeror to confirm receipt of proposals. All proposals received after the exact time specified for receipt shall be treated as late submissions and will not be considered except under facts and circumstances allowed by the Federal Acquisition Regulation (FAR). For instructions on how to post an offer, please refer to the Posting Offer demo: https://wawftraining.eb.mil/wbt/sol/Posting_Offer.pdf.
It is the Offeror’s responsibility to obtain written confirmation of receipt of all electronic files of the full proposal by the Contracting office. In the event that the Solicitation Module is down, the alternate method for proposal submission is via email to: richard.h.steinfeld.civ@us.navy.mil AND erin.b.young.civ@us.navy.mil ONLY. The Offeror must obtain prior approval from the Contracting Officer to use the alternate submission method.
Offerors are responsible for ensuring electronic copies are virus-free and shall run an anti-virus scan before submission.
Electronic copies of each volume shall be compatible with the following software products: Adobe Acrobat Reader 11 and Microsoft Office Suite 2016. Narrative portions of the proposal shall be in Adobe Acrobat portable document file (pdf) searchable text format. The Offeror shall not embed sound or video (e.g., MPEG) files into the proposal files. Electronic files shall be clearly identified for each volume, section, and item.
4.2 VALIDITY PERIOD
Proposals shall be effective for at least 180 days after the proposal due date as reflected in Block 9.
4.3 LATE PROPOSALS
Offerors are advised that the time identified on Block 9 of the Standard Form (SF) 33 applies. Delivery is defined as having occurred based on the PIEE email notification time stamp to the contract specialist. If multiple dropoffs occur, any drop off after the time identified on Block 9 of the SF 33 would render the entire proposal as late.
Partial proposal submittals are not acceptable. See FAR provision 52.215-1(c) (3) for additional guidance on timely submittal. Offerors are strongly encouraged to deliver as early as possible to avoid any risk of late submission.
a) Definitions. As used in this provision—
“Proposal Modification” means a change made to a proposal before the solicitation’s closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.
“Proposal Revision” means a change to a proposal made after the solicitation closing date at the request of or as allowed by a Contracting Officer.
“Time,” if stated as a number of days, means calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and federal holidays. However, if the last day falls on a Saturday, Sunday, or federal holiday, then the period shall include the next working day.
b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).
c) Submission, modification, revision, and withdrawal of proposals. Offerors are responsible for submitting proposals, and any Proposal Modifications or Proposal Revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.
(1) Any proposal, Proposal Modification, or Proposal Revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition, and—
(i) if it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals or
(ii) it is the only proposal received.
(2) However, a late Proposal Modification of an otherwise successful proposal that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(4) Offerors may submit Proposal Modifications (1) at any time before the solicitation closing date and time, (2) in response to an amendment, or (3) to correct a mistake at any time before award.
(5) Offerors may submit Proposal Revisions only if requested or allowed by the Contracting Officer.
(6) An offeror may withdraw its proposal by written notice at any time before award.
Withdrawals are effective upon receipt of notice by the Contracting Officer.
(7) A written award or proposal acceptance mailed, or otherwise furnished, to the successful offeror within the time specified in the proposal shall result in a binding task or delivery order without further action by either party.
4.4 RESTRICTION ON DISCLOSURE AND USE OF DATA
Offerors that include in their proposals data that they do not want disclosed to the public for any purpose or used by the Government except for evaluation purposes shall perform the following steps:
a) Mark the title page with the following legend:
This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed—in whole or in part—for any purpose other than to evaluate this proposal. If, however, a task or delivery order is awarded to this offeror as a result of — or in connection with — the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting task or delivery order. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]
b) Mark each sheet of data it wishes to restrict with the following legend:
Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.
5. SOLICITATION QUESTIONS
Questions regarding this solicitation shall be submitted in writing with the use of Section J, Attachment L-1.
Each question or comment should reference the applicable document, page number, and paragraph number. Do not include any proprietary information in your question, because the Government will provide the question and answer to all potential offerors on sam.gov. All questions about this solicitation must be submitted no later than 5:00 pm Eastern Time on 10 August 2022 to Richard Steinfeld, Contract Specialist, at richard.h.steinfeld.civ@us.navy.mil. PART B: SPECIFIC INSTRUCTIONS
1. VOLUME 1: TECHNICAL FACTOR
1.1. ASSUMPTIONS, CONDITIONS, EXCEPTIONS, DEVIATIONS OR WAIVERS
Assumptions, conditions, exceptions, deviations, and requests for waivers may cause proposals to be considered deficient and, thus, not awardable. If there are no assumptions, conditions, exceptions, deviations or waivers, the offeror shall provide a statement stating that the proposal contains no assumptions, conditions, exceptions, deviations or waivers. If the offeror proposes an assumption, condition, exception, deviation, or waiver to a term or condition of the solicitation, the offeror shall provide a detailed description for each assumption, condition, exception, deviation, or request for waiver, as applicable. The offeror shall identify the portion of the solicitation and the offeror’s proposal that are affected. This volume shall not contain any reference to cost or price aspects of the offer.
1.2. DEVICES 2F227-1 AND 2F196B-3 APPROACH AND METHODOLOGY, AND PROPOSED
SCHEDULE
The offeror shall provide information to address the following:
The offeror shall discuss their approach and the methodology they will utilize to satisfy the requirements of the prospective contract to the extent in which their approach minimizes fleet impact resulting from the loss of trainer availability for the 2F227-1 and 2F196B-3 (CLINs 0400 and 0500) trainers during the contract performance period. It is not necessary to address any other device under this factor. The offeror’s approach and methodology shall identify all activities and events (examples: disassembly/assembly, installation, cold start, reviews, test & evaluation components, Deficiency Review Board, deficiency report (DR) correction and Government (DR) verification/closure) that will result in the loss of trainer availability during contract execution. The offeror shall include in their approach and methodology any specific measures they will take to minimize fleet impact such as: applicable assumptions, benefits, risks and suggested risk mitigation, courses of action, and possible trade-offs inherent to their approach.
The offeror shall provide a graphical, linear, time-phased depiction of their proposed schedule for both trainers addressed in their narrative approach and methodology. The offeror’s schedule shall clearly identify periods of time that the offeror requires trainer access at applicable training sites to perform their actions within the contract performance period. The offeror, consistent with their proposed approach, shall identify all periods of time where each trainer will not be available for training for each activity and events (examples:
disassembly/assembly, installation, cold start, reviews, test & evaluation components, Deficiency Review Board, deficiency report (DR) correction and Government (DR) verification/closure) . The offeror shall provide in a summary note for each training device: the total number of hours that each trainer will not be available for training as a result of the offeror’s planned activities to complete all contract requirements.
Government testing periods shall be based on 5 day work week (Monday through Friday), and not to exceed 10 hours per day, one shift per day. The 2F227-1 and 2F196B-3 training devices will be available for teardown and modification at contract award.
Trainer availability is when the training devices are available for fleet operator use/training.
Hours of operation for the 2F227-1 and 2F196B-3 Trainer locations:
*MCAS Yuma (receiving destination both trainers) 2F227-1 - Monday – Friday: 0800 – 1600 hrs 2F196B-3 - Monday – Friday: 0800 – 1600 hrs
1.3. TECHNICAL APPROACH WIND CHARACTERISTICS AND REDUCED VISIBILITY
LANDING
a) The offeror shall describe their approach, method, and duration for developing, providing, and validating the WC model and RVL solutions.
(1) For the WC and RVL solutions, the offeror’s description of the approach shall include functional block diagrams showing the functions involved in each solution and the hardware and software configuration items and components to which the functions are allocated. Include a description of the interfaces between those components and the data exchanged or transmitted through the interfaces. Include a brief description of the concept of operation of each solution, including data inputs, functions, processes, and outcomes.
(2) The offeror shall describe how the proposed approaches for modeling WC and RVL scales and configures each solution to meet all stated functional and performance requirements simultaneously with no degradation in performance.
(3) The offeror shall describe common functions, if any, shared by the WC and RVL solutions, and describe the allocations of these functions. For any shared functions allocated to a common configuration item, describe the design and scaling provisions made in the approach described in (b.) to meet requirements simultaneously even under the most stressing conditions.
b) The offeror shall discuss their approaches and methodology to deliver WC and RVL solutions.
(1) The offeror shall discuss the extent of Government resources needed, including pilot validation and testing, duration of test events, and coordination of schedule for testing and validating the WC and RVL solutions.
(2) The offeror shall describe the extent to which their proposed WC and RVL solutions rely on commercial and non-developmental (CaNDI) hardware (HW) and software (SW) configuration items and components by identifying which the items and components involved in the described approach requested in (b.) are COTS or commercial items, and which will require development. The offerors shall identify the percentage of hardware and software that is COTS, commercial items, and new development. The total percentage of HW and SW shall equal 100%.
(3) The offeror shall discuss all assumptions, un-mitigatable risks, and tradeoffs required to meet training missions and objectives related to WC and RVL.
2. VOLUME 2: PRICE FACTOR
The offeror shall include the following information in this volume:
2.1 Prices: Provide a copy of Section B of the solicitation populated with the CLIN unit prices and CLIN total prices using each CLIN’s quantity value. The offeror shall sum up the proposed Total Price by CLIN, provide a Total Price of the proposal using stated estimated quantities, and submit a complete Section B with prices displayed.
2.2 Unbalanced Pricing: The offeror shall explain any appearance of unbalanced pricing. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.
2.3 Administrative Completeness: The Price Volume shall also contain the following information:
a) Signed Standard Form 33 for basic solicitation and each amendment.
