To receive any points for this factor, a site visit must be attended at each of the three locations. Points for this factor will be awarded on an all-or-none basis.

M.3 PRICE EVALUATION

A. A total evaluated price will be computed for the Base Period as follows:

1. Prices quoted for CLIN 0001 multiplied by 7

2. Prices quoted for CLIN 0002 multiplied by 7

3. Prices quoted for CLIN 0003 multiplied by 7

4. Prices quoted for CLIN 0004 multiplied by 7

5. Prices quoted for CLIN 0005 multiplied by 7

6. Prices quoted for CLIN 0006 multiplied by 7

7. Prices quoted for all other CLINs (0007-0049) will be multiplied by 1

The total evaluated price for the Base Period is the sum of items A1 – A7.

B. Option Periods I, II, III, and IV will be evaluated in the same manner as the Base Period. The price for each respective option period CLIN will be multiplied by the quantities listed in A1 – A7 above.

C. The six-month option to extend services will be evaluated by multiplying CLINS 4001 – 4006 by six and multiplying CLINS 4007 – 4049 by one.

D. The total evaluated price for the Base Period, four (4) Option Periods, and six month extension period will be added together to determine the total evaluated price for each Offeror.

The Government reserves the right to accept or reject the line item prices when awarding the contract.

THE ABOVE FORMULA IS TO BE APPLIED BY THE GOVERNMENT, NOT THE

CONTRACTOR.

The Government may determine that an offer is unacceptable if the prices proposed are materially unbalanced between line items or subline items. An offer is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the offer will result in the lowest overall cost to the Government, even though it may be the low evaluated offer, or it is so unbalanced as to be tantamount to allowing an advance payment.

The Government may (1) reject any or all offers if such action is in the public interest, (2) accept other than the lowest offer, and (3) waive informalities and minor irregularities in offers received.

The Government intends to evaluate proposals and award a contract without discussions with Offerors

(except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the Offeror’s best terms from a cost or price and technical standpoint. However, the

Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

The Government may accept any item or group of items of an offer, unless the Offeror qualifies the offer by specific limitations. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the Offeror specifies otherwise in the offer.

M.4 FAR 52.217-5, EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

M.5 WRITTEN NOTICE OF AWARD

A written award or acceptance of offer mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer, as provided in paragraph above), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. Negotiations conducted after receipt of an offer do not constitute a rejection or counteroffer by the Government.

M.6 IN THE EVENT OF AN EMERGENCY

If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

M.7 SPECIAL STANDARD(S) OF RESPONSIBILITY

In accordance with FAR 9.104-2 the following special standards of responsibility must be met prior to contract award. Failure to meet these standards will result in an offeror being determined ineligible for award.

A Quality Control Plan (QCP) must be submitted with the initial offer and will be reviewed and accepted prior to award of a contract. The plan must conform to the minimum requirements specified in Section C.

Offerors must quote a price for all line items for base period and all additional option periods (See Section

B). Failure to quote a price for all line items will be cause for rejection of the bid/offer.

Any discounts offered will not be considered in the evaluation of bids/offers.

Do not include any allowance for any contingency to cover increased costs for which adjustment is provided for under the price adjustment clause FAR 52.222-43, Fair Labor Standards Act and Service

Contract Act – Price Adjustment.
