Question Answer

1 SUBMISSION

Sec. II - Proposals/page 5 of 15/Para II.A.

Does the Government want the "Technical Proposal" and "Other Documents as Required" content submitted in one binder/volume, or in two separate binders/volumes?

One binder clearly indicating the two requirements. The “other documents” should precede the technical proposal. Also, be sure to clearly separate each technical factor.

2 SF1442 Are Offerors required to submit a signed copy of the SF1442 form with the proposal? If required, please provide the SF1442 form.

It does not appear to be included in the solicitation documents.

You are not required to submit a SF1442.

Please see Section V.A. of the solicitation.

The form was deleted.

3 Reference page 8, paragraph II.D.(1)

Can you please clarify what constitutes “proof of CCR [now SAM] registration”? If a printout from the SAM system is required, what portion of the report do you require, and would it be exempt from the page limitations?

What constitutes “proof of CCR” registration is a copy of your CCR (now SAM) report. Please include the document in its entirety (minus the Reps & certs. If you plan to complete it using the form provided on the FBO announcement.)

Proof of CCR registration is under “Other Documents” and therefore it is not a part of the page limitation. Keep in mind that the page limitation only applies to the Technical proposal.

4 Reference page 8, paragraph II.E.(3)

This paragraph requires us to submit representations and certifications, financial information, and past performance information for each member firm of the joint venture.

· Reps and certs are required for each JV member;

however, no mention is made for including reps and certs for the JV itself. Should these also be included in the proposal submission?

· Are the reps and certs exempt from the page limits?

· What financial information is required?

· In providing past performance for both JV members, does this mean that each JV member is to replicate the requirements specified in Factor 1: Past Performance of Offeror? I.e., do you require each JV member submit 3 additional past performance projects (a total of 6 additional projects)? If not, what information is required as “past performance” from the JV member firms?

Yes, please include reps and certs for the JV.

Reps and certs are exempt from the page limits.

Only those invited to Phase 2 will be required to submit financial information.

Past performance - In cases where the Offerors member teams (designer and constructor) have not worked together on similar projects the Offeror may submit projects that demonstrate the work of either the designer or constructor or both.

5 General – CCR/SAM Will SAM verification suffice regarding DUNS Number and Federal TIN? Yes.

6 General – CCR/SAM In II.D. Other Requirements it states in part the following: “(1) Proof of CCR registration.” The System for Award Management (SAM) has migrated eight federal procurement systems including CCR Registrations into one system in July 2012. Does the Government intend for the Offeror to provide proof of SAM registration?

Yes.

7 General In I.E. Pre-Proposal Conference for Phase 1, it states in part as follows: “Date: December 10, 2012, Time: 10:00 am Eastern Standard Time.” Will the Government provide the list of attendees to Pre-Proposal Conference, both the one scheduled at 10: 00 AM and the subsequent one at 11:00 AM?

Yes

8 General - Claims On page 6 of 14, it states, “Provide a list of all claims submitted by the Offeror's member teams with the last five years. For each claim briefly describe the claim and the final resolution, if already resolved.” Can you please provide clarification on what types of claims you require information on?

Claims can be for costs or time extensions, the categories in construction are:

1. late payments

2. changes

3. constructive changes

4. project change condition

5. delay for interference

6. acceleration

7. errors or omissions in design

8. suspension of work

9. variations in bid item quantities

10. reject for equal substitution

9 General - Questionnaire Are the Performance Questionnaires to be sent to the POC for the projects listed in Factor 1 only

Yes, for Factor 1 only.

10 General – Questionnaire The provided Performance Questionnaire is not editable. Is there an editable form available? If not, may we provide our Customers with an editable version?

Please see editable document attached to the FBO announcement.

11 Paragraph I.C.(3) Paragraph I.C.(3) on page 3 of 14 references the SF 1442 on page 3 of 14. There was not a SF 1442 included in the solicitation.

See Section V.A. of the document. Article I.C.

List of Phase 1 Solicitation Documents Delete Item No. (3) Standard Form (SF) 1442 – Solicitation Offer and Award is not required.

12 Paragraph I.C.(4) There is a reference to “Draft of The Agreement”. Is this the See V.A. of the document. Article I.C. List of Phase 1 Solicitation Documents Delete Item

Security Document? No. (4) Draft of the Agreement.

13 General The SBU form indicated in "Other Documents" requires a copy of business license or other documentation granted by the state, or local jurisdiction to conduct business. Is it required that this business license be active upon submission of the proposal or by time of contract award?

The SBU form requires a “valid” businesss license or other document. If it must be active to be valid, theit is required to be active upon submission of the proposal when the document (SBU form) is completed.

14 General – Submission Reference solicitation, page 5 of 14, paragraph II.B: This paragraph requires us to use a font no smaller than 12 point.

May we use a smaller font on graphs, tables, and drawings, so long as the information is easily readable?

Yes.

15 Page Limit General - Page Count

Regarding page counts in general, do only the pages from paragraph II.C count toward the 15 double-sided page limit?

Yes, only the documentation for the “technical factors” is included in the 15 double-sided page limit.

16 Sec. II - Proposals/page 5 of 15/Para II.B.

Does the stated page limit of 15 double-sided pages include the documents required under Para II.D."Other Requirements"?

See answer to question 15.

17 Para II.B on page 5 of 14 This section limits the total submission to 30 pages (15 double-sided). This number is insufficient for the information required.

Can this total be increased? The Representations and Certifications and the Document Security represent 7 pages. Are these excluded in the 30 pages?

Yes. The Reps. And Certs are excluded.

18 Item II.D. Other Requirements

On Page 8 of the Solicitation, Item II.D. Other Requirements to be submitted – Would it be possible to not count these documents/pages count against the page count?

See answer to question 15.

19 Item II.D. Other Requirements

“The external cover of each proposal (hard copies and electronic copies) shall clearly identify the Offeror’s names” and “the total submission should not exceed 15 double sided 8-1/2”x 11” pages (not including Cover Letter, Table of Contents, or Section Separators).” Does the Government intend that the “external cover” be included in the page count?

No. The External cover shall not be in the page limit. Only the information regarding the technical factors shall be considered in the page limit.

20 General – Personnel Security

On page 3 of 14 at paragraph 1.A., it states that you “require contractor personnel with security clearances.” Is this a simple background check or an actual security clearance, e.g., Confidential, Secret, Top Secret, etc.? If the latter, will there be provisions to allow an otherwise successful bidder to obtain the proper clearance?

A NACI clearance is required and it is something that GSA will provide. However, the process will not begin until a successful Offeror is awarded. The GC needs to follow HSPD-12 guidelines.

21 General – Personnel Security

Paragraph I.A. on page 3 of 14 requires that contractor personnel have security clearances. Will GSA provide these clearances?

See answer to question 20.

22 General – Personnel Security

What personnel security requirements (badging/escorts) will be required?

All personnel on site will be required to comply with HSPD-12 guidelines. More guidelines will be provided to all Offerors that continue to Phase 2. Actual background check process and badges are funded by GSA.

23 JOINT VENTURE

Section II - Proposals/page 8 of 15/Para II.E.

Are Offerors required to submit a Letter of Commitment from the Design firm team member? The Joint Venture Agreement precludes the need for a letter of commitment.

24 Reference page 8, paragraph II.E.(1)

This paragraph requires all JV offerors to include a copy of the joint venture agreement. Is the JV Agreement exempt from the page limitations?

Yes.

25 Reference page 8, paragraph II.E.(2)

This paragraph requires each Joint Venture member to sign the submission. As there is no SF 1442 required, what documents must be signed? E.g., the Document Security form, a cover letter, etc.

A cover letter stating that this is the JV’s proposal with both parties signature is sufficient.

26 General We are an SBA-approved Joint Venture comprised of two firms.

On pages 5 and 6 of 14, it states that the “Offeror shall provide three (3) same or similar projects completed within the last five

(5) years of this RFQ issue date.” On page 6 of 14, it also states, “In cases where the Offerors member teams (designer and constructor) have not worked together on similar projects the Offeror may submit projects that demonstrate the work of either the designer or constructor or both.” As there are now four distinct firms involved (the JV itself, each JV member, and the A/E), how many past performance projects are permitted?

3 past performance evals are permitted. GSA counts either the JV or the JV members. We do not “double count” them because they are the same entities. I would need more information about how your JV is setup to give you a complete answer.

Technical Factors What is the definition of "similar projects"? “Similar” is defined as Design-Build or Bridging

Design-Build renovation projects of multi-story construction containing a minimum of 40,000 gross square feet. Examples of such “similar” building structures include courthouses, hospital facilities, Class A office space, research laboratories, and government facilities with a minimum construction cost of $5 million. The Government’s preference is that the renovations include historic structures, building additions, and the work was completed while the building was fully or partially occupied.

28 General – Technical Factors

May an IDIQ contract with multiple task orders be submitted as a single project for either Factor 1 or Factor 2?

You may submit a task order that meets what is defined as “similar” projects. Please see question 27 for the definition of similar projects.

29 For both Factors 1a and 2a – can we profile a task order project that is part of a larger IDIQ contract? Conversely, can we profile an overall IDIQ contract as a whole, highlighting multiple relevant tasks?

See answer to question 28.

30 General – Technical Factors

On Page 6, the last item under Factor 1, reads:

b. Provide a list of all claims submitted by the Offeror's member teams with the last five years.

For each claim briefly describe the claim and the final resolution, if already resolved.

Are we to provide a list of 1) claims made by our Team (contractor/AE) against Owners or 2) made against our Team?

See answer for Question 8.

You should provide a list of claims for both.

31 General – Technical Factors

For the Phase 2 evaluation of proposals, will technical factors be significantly more important than price, or will technical and price be approximately equal to each other in important?

GSA will select the proposal that represents the best value based on the evaluation of technical factors and price, with technical factors being more important than price.

32 Reference pages 7 & 8 of 14, paragraphs c.

(Resource Capacity) and

d. (Coordination):

It appears that the same information is requested in two locations as listed below:

From “c. Resource Capacity”: “Offeror shall provide its means, methods, and processes used to manage clients, trade subcontractors, consultants, and other entities during Design Phase Services and Construction Phase Work.”

and

From “d. Coordination”: “Offerors shall provide a written narrative that describes its means, methods, and processes used to manage clients, trade subcontractors, consultants, and other entities. Of particular importance will be the Offeror’s experience with managing and coordinating design services within a Design- Build contract.”

Factor 3c Resource Capacity revised as follows:

Offerors shall describe/verify the capacity of the project team members to be available on this project as proposed during the term of the contract related to its means, methods, and processes used to manage clients, trade subcontractors, consultants, and other entities during Design Phase Services and Construction Phase Work.

Factor 3d Coordination remains unchanged

Are these two sections asking for the same information? If so, can one area by eliminated in light of the page limits? If not, can you please clarify the difference?

33 Paragraph II.C Paragraph II.C on page 5 of 14 requires information on projects for the designer and constructor. Does this mean that the designer and constructor must have worked on the same projects or can separate projects be submitted for each?

It is a lot easier to see how the two will work together if you submit projects where you both have worked on however, you can submit separate projects.

34 General – Technical Factors

Regarding Factor 1a, the RFQ states: “In the cases where the Offerors member teams (designer and constructor) have not worked together on similar projects, the Offer may submit projects that demonstrate the work of either the designer or constructor or both.” Please clarify if we are limited to a maximum of three projects for the entire D/B Team, i.e., three projects total from the contractor and designer? Or may we submit three projects from the designer and three projects from the contractor, for a total of six projects? May we also include additional projects from other team members?

A total of 3 projects each for factor 1 and factor

2. Design Phase Services and Construction Phase Work can be represented by a single project and Offerors are encouraged to submit projects wherein both types of services were provided on the same project. In cases where the Offerors member teams (designer and constructor) have not worked together on similar projects the Offeror may submit projects that demonstrate the work of either the designer or constructor or both.

35 General – Technical Factors

Regarding Factor 2a, please clarify if we are limited to a maximum of three projects for the entire D/B Team, i.e., three projects total from the contractor and designer? Or may we submit three projects from the designer and three projects from the contractor, for a total of six projects? May we also include additional projects from other team member firms?

Please see answer to question 34.

36 Reference Page 7 of RFQ, Factor 3c Resource Capacity and Factor 3d Coordination have similar requirements and include the same (partial) sentence…

“3c…Offeror shall provide its means, methods, and processes used to manage clients, trade subcontractors, consultants, and other entities during Design Phase Services and construction Phase Services” 3d…Offeror shall provide a written narrative that describes its means, methods, and processes used to manage clients, trade subcontractors, consultants, and other entities”

Can GSA expand or elaborate on the difference

See answer to question 32.

between the two sections in terms of what information is sought here?

37 General – Technical Factors

What is the required ballistic rating of the CSO guard station? The SOW requires compliance with USMS Publication 64, which calls for ballistic-resistant material meeting UL Standard 752, Level III.

38 General – Technical Factors

Is there work anticipated for the exterior guard shack There is no work anticipated to the exterior guard shack at the rear of the building, except possibly some work to the surrounding curb, sidewalk, and bollards.

39 General – Submission During the scheduled Pre-Proposal Conference for Phase 1 on December 10, 2012 pursuant to RFQ I.E. Pre-Proposal Conference for Phase 1, the Government made reference to several design guides (GSA P-100, US Court and US Marshal).
