Notice of Opportunity (NOO) Revision 3 for Energy Savings Performance Contract (ESPC) GSA/PBS Nationwide Deep Retrofit project covering approximately 20 States.
Dear Department of Energy ESCOs:
The General Services Administration (GSA), Public Buildings Service (PBS), invites current Department of Energy (DOE) ESPC Indefinite-Delivery Indefinite-Quantity (IDIQ) contract holders to submit a written response (Expression of Interest) to this notice for the opportunity to be considered for this potential project. The mission of GSA is to provide effective, sustainable workplace solutions for other federal agencies at the best value to the American taxpayer.
Invitation
The GSA under the auspices and with the support of the DOE, Federal Energy Management Program (FEMP), invites current ESPC IDIQ contract holders to submit a written Expression of Interest (EOI) to this NOO for consideration in this potential task order (TO) award under the ESPC program. The EOI response requirements are detailed below.
Project Objectives
1. Retrofit plans that move a building towards net zero energy consumption
2. No upfront buy down funds are envisioned for this project. The project must self finance within a financing term of 25 years or less.
3. GSA has no current funds for moving tenants out of space; therefore, respondents should expect the buildings will remain occupied during the performance period, to include construction, however, the Government reserves the right to allow movement of tenants if it is deemed to be in the best interests of the Government. Work that is not in public space and is not disturbing to building tenants may be performed during business hours. However, it is anticipated that the majority of the work will be performed after hours. GSA will not pay a premium for work performed outside of GSA’s normal business hours.
4. Assurance that improvements identified are tied to the useful life of the equipment and the facilities.

The physical locations and data for the anticipated buildings to be included in this project are shown in Attachment A, EOI Supplemental Data. Attachment A represents the potential projects. Energy usage estimates are provided for reference only. Actual and projected energy rates will need to be verified by the ESCO during the Preliminary Audit (PA). The agency reserves the right to consider all viable ECMs. The Government is encouraging ESCOs to propose any and all ECMs that may be economically viable and will contribute to the overall project goals and objectives. GSA reserves the right to add to or remove any federally controlled space or buildings to Attachment A, EOI Supplemental Data at any time prior to execution of the Investment Grade Audit (IGA). ESCOs will not be given access to facilities until the PA.
Selection Process
GSA/PBS, anticipates awarding TO(s) to one or more ESCOs in accordance with Section H.3.1.A of the subject contract, Selection Based on Qualifications Method. Response requirements for the NOO are detailed below. ESCOs will be selected from affirmative responses received to this NOO based on the ESCO Experience and ESCO Past Performance criteria outlined below. GSA will select one or more ESCOs deemed to be most qualified as a result of the ESCOs responses to this NOO. Multiple task orders are anticipated. Selected ESCOs will move forward to the Preliminary Audit (PA) for a Government selected set of buildings contained in Attachment A, EOI Supplemental Data. Selected ESCO(s) will be assigned a group of buildings, however, only one ESCO will be selected to move forward with the PA on a particular building. ESCOs are advised that GSA intends to make ESCO selection based solely on the ESCO’s responses to this NOO. In the event that GSA deems it necessary, a second down selection may be added.
Responses
ESCOs will be evaluated on their ability to perform and their ability to complete an IGA. Each Interested ESCOs is requested to submit on 1) Experience and 2) Past Performance. Both factors are of approximately equal weight.
1. ESCO Experience: (20 page maximum)
This section should include sufficient information to identify and describe the experience and qualifications of the ESCO as it relates to the property types and desired outcomes as described in this document. Project experience must be for projects completed within the past 5 years. Projects older than 5 years will not be considered.
a) The ESCO should provide a minimum of three (3) similar projects for evaluation. ESCO experience as both prime contractor and subcontractor will be considered. The experience summary for each project must outline each of the items below. Please provide each past project separately addressing each item for each project.
Similar Projects are defined as follows:
i) Building type ( i.e. Office buildings, Laboratory Space, Data Centers, Border Stations, and Courthouses) - Include a brief description of the facility including square footages, building type, occupancy, and approximate age of building.
ii) Buildings/Facilities Occupied Throughout Construction – Note if the building was or was not occupied during the construction phase of the project.
iii) Projects conducted in Multiple Locations/States or Campuses under one contract/task order. Provide the proximity of each location to the other locations under the task order. Describe how the ESCO effectively managed the projects in various locations.
iv) Projects specifically awarded for energy and/or water performance contracts.
v) Projects where the ESCO prepared an Investment Grade Audit (IGA) and performed subsequent construction phase services. Completion of a PA only is not considered similar project experience for the purposes of this evaluation factor.
vi) Describe how the project met or did not meet the following criteria:
(1) Project experience identifying, designing and managing energy and/or water conservation, especially using whole building design approaches which leverage the cumulative efficiencies of different systems.
(2) Project experience designing, operating and cost effectively dispatching cogeneration systems.
(3) Project experience designing, constructing and/or operating geothermal heating and cooling systems.
(4) Projects that resulted in significant reductions in energy and/or water consumption. Describe the level of energy and/or water reductions achieved.
(5) Experience designing, installing and operating onsite renewable technologies and connecting those renewable installations to the electric grid.
b) The summary for each project provided for this Experience criterion shall include the following information at a minimum:
i) Owner, Project Location, Contact Information, include the name and phone number of the person most familiar with the work.
ii) Date of task order award, Original contract completion date, and actual project completion date. If not completed on time explain.
iii) Original Anticipated Energy Savings and Installation Costs as proposed in the PA (total costs)
iv) Original Anticipated Energy Savings and Installation Costs as proposed in the IGA (total costs)
v) Final Contract Guaranteed Actual Energy Savings (Units of Energy and Dollars) and Installation costs.
vi) Annual energy rate escalation factor
vii) Financing Interest Rate and length of term.
viii) Measurement and verification methodology employed
ix) Small business subcontracting goals and actual subcontracting achieved
x) ESCO status as prime contractor and subcontractor Project responses will be evaluated for relevancy and recent performance. Relevancy is based on similarity to criteria identified above as related to this project. The more similar the project, a more favorable rating will be assessed. Projects completed more recently within the past five (5) years will receive more favorable ratings.
2) ESCO Past Performance
a) The ESCOs past performance will be evaluated for similar projects provided above as defined in the ESCO Experience criteria at a minimum.
b) The ESCO shall have the reference for each similar project provide a completed Attachment B, Past Performance Questionnaire for each reference. The Past Performance Questionnaire shall include the projects referenced in the ESCO Experience submission.
c) The following information shall be included on the form for each reference:
i) Name of Respondent
ii) Title/Company
iii) Role on Energy & Water Performance Contract
iv) Address
v) Phone
vi) Fax
vii) E-mail
d) The ESCO shall provide its Past Performance References in compliance with the requirements of this NOO. The reference shall complete the Attachment B Past Performance Questionnaire and send the Attachment B by e-mail directly to Ken Shutika, Contracting Officer, at ken.shutika@gsa.gov by the NOO response deadline of April 27, 2012 at 4:00 PM Eastern Time.
Completed Past Performance Questionnaires sent to the Contracting Officer directly from the ESCO will not be accepted for evaluation. Past Performance Questionnaires received late will not be evaluated. Owners may be contacted for assessment of ESCO experience.
For any contract that was terminated, or where there were severe performance problems, the ESCO bears the burden to provide all relevant information regarding the facts and circumstances surrounding the default termination or performance problems. Absent adequate explanations regarding such termination(s), the Government shall presume that the termination(s) resulted from the contractor’s failure to meet its contractual obligations. For performance issues, the ESCO shall provide information regarding the steps taken by the ESCO to correct the problem(s). This information should be listed as an attachment to the contract information sheet.
The Government reserves the right to request further information regarding these or any other contracts, if necessary to properly evaluate the offer.
The Government is not limited to reviewing only those references provided by the ESCO. The Government may also consider the ESCO’s performance on contracts not submitted by the ESCO that the Government is aware of or becomes aware of as a result of reference questionnaires or other means.
ESCOs are cautioned that any falsification, misrepresentation or willful omission of facts shall be sufficient cause for disqualification of the proposal upon discovery of such facts.
Additional information:
The Government assumes that ESCOs are interested in all buildings included in Attachment A. If an ESCO is not interested in a particular building(s), then it should indicate in its submission which buildings it is not interested in. ESCOs are hereby notified that deselecting a particular building(s) included in Attachment A, EOI Supplemental Data will not affect the ESCO’s evaluation. However, the ESCO will not receive a TO that includes any deselected building(s). ESCOs may identify their top choices of buildings from Attachment A and include an explanation on why awarding the ESCO the building(s) of choice would be beneficial to the Government. Final building determination or any grouping of buildings for each TO award will be determined by the Government.
No data or literature of any kind, other than those specified will be accepted, nor will discussions take place at this time. Expressions of interest shall be submitted via e-mail to ken.shutika@gsa.gov no later than 4:00pm Eastern time on April 27, 2012. An acknowledgement of receipt of this NOO is requested by all ESCOs. For those ESCOs not interested in this invitation, a negative response is hereby requested. Failure to provide a written EOI by the deadline referenced above will result in that ESCOs exclusion from this project.
Contractors may submit general questions or questions about the selection process in writing via e-mail to ken.shutika@gsa.gov prior to 4:00pm Eastern time on April 23, 2012. All questions posed by a contractor and the accompanying Government responses to those questions will be distributed to all contractors.
