PART 1 GENERAL

1.1. SUMMARY

The work consists of furnishing plant, labor, materials, and equipment to perform dredging, placing beach quality sand on the beach, constructing the beach fill sections, and associated work as required by these specifications and drawings.

1.3. DEFINITIONS

1.3.1. Required Dredging Prism

The dredging prism shall be defined as the area down to the required depth and the associated side slopes as specified on the contract drawings. The dredging prism does not include the borrow limit and the associated side slopes. Under this contract, the required dredging prism is only applicable in the Folly River Channel (if awarded).

1.3.2. Borrow Limit

The borrow limit shall be defined as the depth, as shown on the contract drawing, above which material can be removed and placed on the beach as fill.

Any material removed below the borrow limit will be defined excessive dredging as outlined in Paragraph 1.3.4.

1.3.3. Side Slopes

Under this contract, side slopes are only applicable in the Folly River Channel (if awarded). Dredging of side slopes is not required. Material actually removed from outside the required section shown on the contract drawings as lying between the vertical cut and the maximum pay slope plane will be considered beach fill and paid for at the beach fill placement unit cost. Up to 100 percent of the material lying in this zone as calculated from the before dredging survey will be considered beach fill and paid for at the beach fill placement unit cost, if actually removed.

1.3.4. Excessive Dredging

Material taken from beyond the limit as extended in the provisions of paragraph “Borrow Limit” will be considered as excessive dredging.

1.3.5. Floating Pipeline

Floating pipeline is any pipeline which is not anchored on the channel bottom.

1.3.6. Submerged Pipeline

Submerged pipeline is any pipeline which shall be anchored on the channel bottom.

1.3.7. Perpetual Easement Line

A line seaward of the sand dunes or seawall that forms the landward extent of the new beach fill. Generally, the perpetual easement line follows the elevation contour of the top beach berm where it is formed against the existing beach, dune line, or seawall, except where the beach or dunes have been eroded to below the top elevation of the berm, in which case, the perpetual easement line shall be the landward toe of the berm.

1.4. MEASUREMENT AND PAYMENT

Beach fill satisfactorily placed to the prescribed berm grade will be measured in-place for payment by use of the average end area method. The Government reserves the right to verify in-place quantities. For the purposes of this contract, each 100’ survey station on beach will be deemed as an acceptance section. Measurement of quantity placed for pay purposes will be based on original and final cross sections made on the section or reach indicated on the drawings. Measurement of quantity will be within the limits of the beach fill design template between the landward tie-in and the assumed seaward slope tie-in with the pre-construction surveys. Quality Control Surveys shall be the responsibility of the Contractor.

Contractor shall perform pre- and post-construction topographic surveys at 100-foot stations with elevations taken at not more than 25-foot range intervals from a minimum distance of 100 feet landward of the perpetual easement line to a minimum distance of 1500 feet seaward of the coastline. In order to achieve final grade in the slough zone, the entire assumed seaward slope, the Contractor may stockpile beach fill up-slope of slough zone.

Contractor shall shape beach in accordance with Paragraph “Finished Beach Fill” and will be paid for in place material within the limits as described in Paragraph “Tolerances.” Once post-construction survey is performed, no measurements will be revised except on suspicion of obvious error.

Under this contract, if the option is awarded, Contractor will be required to clear the dredging prism in the Folly River Channel to the required depth as shown on the contract drawings, but not to exceed stated borrow limit.

However, the Contractor will be paid for placed beach fill material removed from the side slopes as described in Paragraph “Side Slopes”. Excessive dredging, as defined in Paragraph ”Excessive Dredging”, in the Folly River Borrow Area will be deducted from payable beach fill using an in situ dredge to fill ratio of 85%.

Payment items for the work under this contract will be made as listed in the Bidding Schedule and described below. All costs for items of work, which are not specifically mentioned or are incidental to completion of the work, are to be listed in a particular lump sum or unit price payment item that is most closely associated with the work involved. The lump sum price and payment

made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, testing and reports, and for performing all work required for which separate payment is not otherwise provided.

Progress payments shall be made monthly in accordance with the contract clause PAYMENTS UNDER FIXED-PRICE CONSTRUCTION CONTRACTS. Progress payments shall be based on a mutually agreeable percentage of completed work. Monthly progress payments will be based on approximate beach fill quantities estimated and agreed on with the construction representative using information taken from the surveys as described in Section 01 55 00 10 Beach Survey Requirements.

Final acceptance and compliance of the whole or a part of the work and deductions or corrections of deductions made thereon will not be reopened after having once been made, except on evidence of collusion, fraud or obvious error, and the acceptance of a completed section shall not change the time of payment of the retained percentages of the whole or any part of the work.

Placement of dredged material shall be in accordance with the contract drawings. Contractor shall monitor and adjust fill rates during construction as needed to ensure material will be placed uniformly on Folly Beach and, if the option is awarded, to meet dredging compliance requirements in Folly River Channel.

1.4.1. Continuity of Work

All tools, labor and materials required to complete any item of work within a given work area, shall be available at the site prior to commencement thereof. Once work has commenced on an item of work, said work shall be continuously and diligently performed to completion and acceptance.

1.4.2. Work Covered By Contract Price

ITEM 0001, MOBILIZATION AND DEMOBILIZATION - BEACH FILL OPERATIONS ON FOLLY

BEACH, shall include all costs connected with the mobilization and demobilization of all the Contractor's dredging plant and equipment for beach fill operations on Folly Beach.

ITEM 0002, PLACEMENT OF BEACH FILL FROM FOLLY RIVER BORROW AREA, shall include the cost of removal and placement of all material and the layout and accomplishment of all work, as specified herein or indicated on the contract drawings. The movement of plant within the Folly River Borrow Area shall be included in the unit price. Calculated volumes for cubic yardage of beach fill placement will be determined according to Subsection MEASURE AND PAYMENT for payment purposes.

ITEM 0003, TILLING, Payment for tilling as specified herein will be made at the contract unit price per acre in the schedule for tilling, which price

shall include the cost of leveling the tilled area.

ITEM 0004, PROTECTION OF EXISITING STRUCTURES, Payment for protection of existing structures will be made at the contract lump sum price in the schedule for protection of existing structures, which price shall include all costs for labor, equipment, and materials for the vibration control plan, pre-construction and post-construction condition surveys, vibration monitoring, and reporting as specified herein.

ITEM 0005, BEACH SURVEYS, Payment for conducting pre- and post-placement surveys and furnishing drawings and data will be made at the contract lump sum price in the Bidding Schedule, for beach surveys, which price shall include all costs for equipment, labor, materials, supplies, and work incidental to surveying, preparing and furnishing drawings and plots, computing quantities, and furnishing data as specified herein.

ITEM 0007, CULTURAL RESOURCE SURVEY, Payment for conducting a cultural resource survey of the proposed pipeline corridor from the Folly River Borrow Area to the pipe landing in the Folly River, and furnishing a letter of findings will be made at the contract lump sum price in the schedule for cultural resource survey, which price shall include all costs for labor, equipment, and materials for the survey(s), and reporting as specified herein.

OPTIONAL ITEM 0008, PLACEMENT OF BEACH FILL FROM FOLLY RIVER CHANNEL, shall include the cost of removal and placement of all material and the layout and accomplishment of all work, as specified herein or indicated on the contract drawings. The movement of plant within Folly River Channel shall be included in the unit price. Calculated volumes for cubic yardage of beach fill placement will be determined according to Subsection MEASURE AND PAYMENT for payment purposes.

OPTIONAL ITEM 0009, MOBILIZATION AND DEMOBILIZATION - BEACH FILL OPERATIONS

ON BIRD KEY, shall include all costs connected with the mobilization and demobilization of all the Contractor's dredging plant and equipment for beach fill operations on Bird Key.

OPTIONAL ITEM 0010, PLACEMENT OF BEACH FILL ON BIRD KEY FROM, shall include the cost of removal and placement of all material and the layout and accomplishment of all work, as specified herein or indicated on the contract drawings. Calculated volumes for cubic yardage of beach fill placement will be determined according to Subsection MEASURE AND PAYMENT for payment purposes. Placement of cubic yardage beach fill material will be in lieu of placement on Folly Beach.

1.4.3. Shoaling

If before the contract is completed, shoaling occurs in the Folly River Channel (if awarded) where compliance has been previously met, including shoaling in the finished channel because of the natural lowering of the side slopes, dredging at contract price, within the limits of available funds, may be done if agreeable to both the Contractor and the Contracting Officer.

1.5. SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with this section.

SD-01 Preconstruction Submittals

Borrow Area Work Plan;

Beach Fill Operations Plan;

Pipeline Route;

Construction and Grade Stake Recovery Plan;

SD-05 Design Data

Pre-Construction Structural Condition Survey Data;

The Contractor shall submit data from the pre-construction structural condition survey, to include field notes, sketches, photographs, survey records, and other pertinent information needed to establish baseline conditions for monitoring vibrations during construction. These data shall be submitted at least 5 working days prior to beginning any work, including operating construction equipment, on any portion of the beach which will be affected by construction activities.

Post-Construction Structural Condition Survey Data;

The Contractor shall submit data from the post-construction structural condition surveys performed by the Contractor, conducted after construction has been completed at a particular location and has proceeded at least 500 feet beyond the structure being surveyed. Data shall consist of field notes, sketches, photographs, survey records, and other pertinent information needed to document the post-construction condition of each building or other structure adjacent to the beach which may have been impacted by construction activities.

For any particular segment of the beach, these data shall be submitted within 30 days after removal of pipelines and final grading, tilling and shaping of the beach fill within that segment, provided that, the submittal of all data shall be completed prior to final cleanup and completion of the project.

Vibration Control Plan;

A Vibration Control Plan shall be submitted, in draft form, for approval at the preconstruction conference. The Vibration Control Plan shall establish procedures and control for monitoring existing structures which are adjacent to the beach and within a zone which may be impacted by vibration from the Contractor's construction activities, including daily mobilization and demobilization of equipment, and fill placement and grading operations. The plan shall include the following:

(1) Requirements for a pre-construction inventory and condition survey of all existing buildings, appurtenances, and other structures located within the zone where they may be impacted by construction; (2) The vibration monitoring program to include the method of operation, order of work, monitoring equipment information, and qualifications of personnel; and (3) Post-construction condition survey of buildings and all other structures in the pre-construction inventory and condition survey located within the zone where impacts from construction could have occurred.

Unsatisfactory Materials and Objectionable Matter Removal Plan;

FIO.

An Unsatisfactory Materials and Objectionable Matter Removal Plan shall be submitted for information at the preconstruction conference. The Removal Plan shall detail the method for identifying; separating; collecting and removing objectionable matter and unsatisfactory materials as part of the beach fill operation.

Borrow Area Work Plan;

The contractor shall develop and submit a borrow area work plan for the borrow area. For this nourishment of this project, the excavation shall be wholly within the borrow area, using a continuous dredging pattern that avoids creating isolated pockets of excavation. The dredging details shall be established by the Contractor and included in the Work Plan as specified in SECTION 01 11 00 SUMMARY OF WORK. Once approved, any proposed changes to the work plan shall be submitted in writing to the Contracting Officer. An alternative borrow plan will be considered for approval by the Contracting Officer if it is technically acceptable.

SD-06 Test Report

Field Testing Control;

Satisfactory Materials;

Certified test reports and analyses certifying that the materials placed in the beach fill conform with the specification requirements; and for all tests conducted in accordance with paragraph Field Testing Control.

SD-07 Certificates

Field Testing Control;

Qualifications of the Corps of Engineers validated commercial testing laboratory which will be performing quality control testing in accordance with this specification.

1.6. CHARACTER OF MATERIALS

Materials to be excavated are principally those which accumulated as a result of shoaling that has occurred since the areas were last dredged. The Folly River Federal Channel and Folly River Borrow Area as shown on the contract drawings were originally dredged in 1993. Since then there have numerous realignments of the Folly River Federal Channel with maintenance dredging performed in 1996, 1999, 2000, 2001, 2003, 2005 and 2013, with material placed on Folly Beach.

All detailed geotechnical data and associated narratives are provided in the ATTACHMENTS. The Government shall not be responsible for any interpretation or conclusion drawn from the data or information by the Contractor. Bidders are expected to examine the site of the work, conduct their own investigations and decide for themselves the character of the materials and the difficulties of performing the work.

1.6.1. Debris

The Government recognizes that debris may be encountered during dredging operations such as, but not limited to, logs, misplaced riprap, chains, buoy anchors, cables, miscellaneous trash, pipes, ropes, and other artificial obstructions. The Government has no knowledge of existing wrecks, wreckage, or other material of such size or character as to require the use of explosives or special or additional plant for its economical removal. If in the judgment of the Contracting Officer the debris can be removed during normal dredging operations, it shall be removed by the Contractor. Debris removed from the dredged area shall be removed from the water. Disposal shall be the responsibility of the Contractor and placement shall be outside the limits of government property. The removal and placement of this debris shall be accomplished at no additional cost to the Government. Disposal of debris will not be permitted on the riverbanks, in navigable waterways or placement areas unless otherwise specified. In case the actual conditions differ from those stated or shown, an adjustment in contract price or time of completion, will be made in accordance with "FAR 52.236-2, Differing Site Conditions."

PART 3 EXECUTION

3.1. ORDER OF WORK

There is no set order of work under this contract. The Contractor will submit a plan for performing the work. The plan shall include a schedule, equipment list and description, and description of how the work is to be accomplished, including a beach fill work plan and borrow area work plan. The work plan shall be submitted for Contracting Officer’s approval a minimum of 14 days before any construction is to be performed.

If awarded, all construction operations on Bird Key shall be completed, including demobilization, by 15 March 2018.Beach fill operations on Folly Beach should be completed by 15 September 2018.

3.2. INSPECTION

All work will be conducted under the general direction of the Contracting Officer and shall be subject to full-time inspection by his appointed Representative to ensure strict compliance with the terms of the contract.

3.2.1. Inspection Requirements

The presence of a Quality Assurance Representative shall not relieve the Contractor of responsibility for the proper execution of the work in accordance with the specifications.

The Contractor shall:

(a) Furnish, on the request of the Contracting Officer or any Quality Assurance Representative, the use of such boats, boatmen, laborers, and material forming a part of the ordinary and usual equipment and crew of the dredging plant as may be reasonably necessary in inspecting the work. However, the Contractor will not be required to furnish such facilities for the surveys prescribed in the Subsection EXAMINATION AND ACCEPTANCE.

(b) Furnish, on the request of the Contracting Officer or any Quality Assurance Representative, suitable transportation from all points on shore designated by the Contracting Officer to and from the various pieces of plant, and to and from the placement area.

3.2.2. Noncompliance

Should the Contractor refuse, neglect, or delay compliance with these requirements, the specific facilities may be furnished and maintained by the Contracting Officer and the cost thereof will be deducted from any amounts due or to become due the Contractor.

3.3. PLANT

The Contractor agrees to keep on the job sufficient plant to meet the

requirements of the work. The plant shall be in satisfactory operating condition and capable of safely and efficiently performing the work as set forth in these specifications. Inspection of equipment listed in Paragraph "Equipment and Machinery" shall be made prior to commencement of work in order to determine if it is satisfactory so as to meet the requirements of work. The plant shall be subject to inspection by the Contracting Officer and the U.S. Coast Guard at all times. The plant list is the minimum which the Contractor agrees to place and maintain on the job unless otherwise determined by the Contracting Officer, and its listing thereon is not to be construed as an agreement on the part of the Government that it is adequate for the performance of the work.

3.3.1. Equipment and Machinery

A complete listing of all dredging plant and machinery to be used in the work, including booster pumps, barges, skiffs, and other related equipment, shall be submitted with the Plant and Equipment Schedule prior to beginning work. The plant list, as specified in Section 00600 Representations & Certifications, shall include manufacturer and year of manufacture, operational capacities, safety features, operating and licensing requirements for operators, and a description of where and how the item of equipment or plant is to be employed in the work.

3.3.1.1. Capacity of Plant

No reduction in the capacity of the plant employed on the work shall be made except by written permission of the Contracting Officer. The measure of the "capacity of the plant" shall be its actual performance on the work to which these specifications apply.

3.3.1.2. Walkways and Guardrails

All floating plant and pipelines used as access ways or working platforms shall be equipped with walkways and guardrails conforming to Corps of Engineers Manual EM 385-1-1 and meet OSHA requirements for worker safety.

3.3.1.3. Signal Lights

The Contractor shall display signal lights and conduct his operations in accordance with the General Regulations of the Department of the Army and of the Coast Guard governing lights and day signals to be displayed by towing vessels with tows on which no signals can be displayed, vessels working on wrecks, dredges, and vessels engaged in laying cables or pipe or in submarine or bank protection operations, lights to be displayed on dredge pipe lines, and day signals to be displayed by vessels of more than 65 feet in length moored or anchored in a fairway or channel, and the passing by of other vessels of floating plant working in navigable channels, as set forth in Commandant U.S. Coast Guard Instruction M16672.2, Navigation Rules:

International-Inland (COMDTINST M16672.2), or 33 CFR 81 Appendix A (International) and 33 CFR 84 through 33 CFR 89 (Inland) as applicable.

3.3.1.4. Communications

The Contractor will be required to furnish, maintain, and operate one FM narrow-band radio transmitter-receiver with a capacity of not less than (1) watt, equipped for operating on maritime channels 13 and/or 16 at 156.65 MHz.

This frequency shall be used for communications with passing vessels, harbor pilots, and bridge operators and has been approved by the Federal Communications Commission for this purpose. It is not required that this frequency be disabled after termination of the contract. Contractor will be required to maintain a Contractor owned cellular phone for communication with Corps of Engineers personnel.

3.3.1.5. Automatic Identification System

The Contractor is required to have the Automatic Identification System (AIS).

The Contractor shall have AIS transponders on all floating plants at all times when working in Charleston Harbor. The AIS provides a means for ships to electronically exchange ship data including: identification, position, course, and speed with other nearby ships and VTS stations. AIS is intended to assist the vessel's watch standing officers and allow maritime authorities to track and monitor vessel movements.

3.3.1.6. Use of More Than One Dredge

No more than one dredge working under this contract shall discharge into each placement area at any given time.

3.3.2. Pipelines

The Contractor will be responsible to ensure that all pipelines are properly maintained during this contract. All pipelines for hydraulic machines must be kept in good condition at all times and any leaks or breaks along their length must be promptly and properly repaired. Dredge pipelines that are floating, to include rubber discharge hoses, or supported shall display lights at night and in periods of restricted visibility in accordance with U.S. coast Guard regulations and 33 CFR 88.15.

3.3.2.1. Submerged Pipeline

Submerged pipeline shall rest on the channel bottom where a pipeline crosses a navigation channel and while submerged, the top of the pipeline and any anchor securing the pipe shall be no higher than the required project depth for the navigation channel in which the pipe is placed. Pipelines shall not be permitted to fluctuate between the water surface and the channel bottom or lie partially submerged. Routine inspections of the submerged pipe shall be conducted to ensure anchorage.

3.3.2.1.1. Buoyant or Semi-buoyant Pipeline

Whenever buoyant or semi-buoyant pipeline is used, the dredge operator will assure that the pipeline remains fully submerged and on the bottom; whenever it is necessary to raise the pipeline, proper clearances shall be made and maintained and the entire length of the pipeline will be adequately marked.

3.3.2.1.2. Pipeline Corridor

Pipeline corridor is the route which the pipeline shall run between the dredge and the placement area via the Folly River. For the purpose of this contract there will be two areas of easement for the pipeline to come ashore from the Folly River and traverse over land to the placement area on Folly Beach.

The pipeline shall avoid damage to existing marsh. Should it become necessary for pipeline to traverse an area of marsh, Contractor shall minimize impacts to the marsh by traversing the shortest distance through the marsh, utilizing pontoon pipe when traversing areas of the marsh, etc.

3.3.2.1.3. Beach Discharge Pipelines

Pipeline placed on land shall be routed to avoid damage to sand dunes. Should it become necessary for the pipeline to cross existing dunes, the Contractor shall exercise extreme care in placing the pipeline across the dunes to the beach. Dredge discharge pipelines shall be located as far landward as practicable, but seaward of perpetual easement line PEL. Handling and placement of pipe shall be accomplished without causing damage to sand dunes and seawalls or other structures. Any damage to existing dunes or structures caused by the Contractors placement operation shall be restored or repaired by the Contractor at no additional cost to the Government. Pipeline alignments shall be subject to the approval of the Contracting Officer.

3.3.2.1.4. Marking the Location of the Pipeline

Submerged pipeline shall be marked in accordance with local USCG requirements and approved by the Government Designated Authority (GDA).

(a) Unless otherwise specified by the USCG, submerged pipelines are considered to require special marks and shall have a USCG approved flashing yellow light.

(b) Indicators, such as signs or buoys that state “DANGER SUBMERGED PIPELINE” will be placed at the beginning and end of the pipeline.

In addition, indicators are required beginning in areas which reduce the charted depth by more than 10 percent and, as a minimum, every 1000 ft. (304.8 m) to clearly warn of the pipeline length and course.

(c) If barges or other vessels are used to anchor the beginning and/or end of the submerged pipeline, they shall be lighted in accordance with 33 CFR 88.13.

(d) Within a navigation channel, each end of the pipeline shall be identified with a regulatory marker buoy.

(e) Lengths of submerged pipeline located outside of the navigation channel, which reduce the charted depth by more than 10 percent, will be identified with high visibility buoys marked with 360 degree visibility retro-reflective tape, such as orange neoprene

buoys, placed at an interval not to exceed 500 ft. (152.4 m) to clearly show the pipeline length and course.

(f) All submerged pipeline or fittings with less than six (6) feet of clearance between the top of the pipeline and mean low water will be marked with the same type of light meeting the requirements of this subsection and spaced approximately one hundred (100) feet apart.

3.3.3. Buoys

All marker buoys shall be painted yellow and display the same yellow flashing light as required for floating or supported dredge pipelines meeting the requirements of this subsection.

(1) Buoys used to anchor booster pumps

(2) Buoys used to anchor or mark stored equipment i.e. (barges, pipeline etc.)

(3) Buoys used to mark or anchor dredge pipelines and this includes floating and submerged pipeline leading to placement areas.

(4) Any other buoys the U.S. Coast Guard or Contracting Officer requires to insure a safe harbor free from hazards to navigation must be marked and display yellow flashing lights meeting the requirements stated in this subsection.

3.3.3.1. Lights, Lighted Buoys and Dredging Aids Markers

All lights, lighted buoys and dredging aids markers must be maintained, operable and on station at all times to insure a safe harbor. The placement, markings and lighting shall meet all US Coast Guard Regulations, EM 385-1-1 and the Special Requirements found in this specification.

3.3.4. Noncompliance

The Contracting Officer will notify the Contractor in writing of any noncompliance with the foregoing provisions. Such notice, when delivered to the Contractor or his authorized representative at the site of the work, shall be deemed sufficient for the purpose. Within 24 hours after receipt of such notice, the Contractor shall mail, or personally deliver to the Contracting Officer, a complete proposal of the prompt correction of the noncompliance. The Contracting Officer will review the proposal and return it to the Contractor approved, subject to such changes or conditions as he finds necessary to assure correction of noncompliance. Immediately upon receipt of such approval, the Contractor shall begin the corrective work and shall carry it to completion. If the Contractor fails or refuses to submit his proposal or to proceed with the corrective work, the Contracting Officer may suspend all or any part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such suspension shall be made the subject of a claim for extension of time nor for excess costs or damages by the Contractor. If he so elects, the Contracting Officer may cause the corrective work to be accomplished by others, in which event the cost thereof shall be chargeable against moneys otherwise due the Contractor from the Government.

3.3.5. Plant Removal

Upon completion of the work, the Contractor shall promptly remove all plant, including all pipelines, pipeline anchors, ranges, buoys, piles, and other markers or obstructions.

3.4. NAVIGATION AIDS AND DREDGING AIDS

3.4.1. Relocation of Navigation Aids for Dredging

The USCG requires notification sixty (60) days in advance to remove or relocate any navigation aids to facilitate dredging operations. Due to time constraints the Government will notify the USCG in advance of an estimated time and location that dredging operations will be accomplished. However, after award and prior to commencement of dredging it is the responsibility of the Contractor to coordinate with the USCG for the actual removal or relocation of any navigation aids within or near the areas to be dredged. The Contractor will also notify the Contracting Officer in advance of the time and location of the aids that will require relocation. The Contractor shall coordinate the removal or relocation of navigation aids with the following:

3.4.2. Aids to Navigation within the Dredging Areas

The Contractor shall be responsible for any damage to aids to navigation within the dredging areas or areas adjacent thereto caused by his operations.

3.5. MISPLACED MATERIAL

Any material that is deposited or allowed to flow elsewhere than in places designated or approved by the Contracting Officer will be considered as misplaced material and will not be paid for.

3.5.1. Dredged Material

Should the Contractor deposit any material outside the designated placement areas approved by the Contracting Officer, the Contractor shall give immediate notification of the location of the misplaced material and when

required, mark or buoy this location. If in the opinion of the Contracting Officer this misplaced material will in any way be a hazard to navigation and requires removal, the Contractor shall be required to remove the misplaced material immediately and deposit said material in an area designated by the Contracting Officer at no additional cost to the Government.

Should the dredging contractor encounter unsuitable material within the Folly River Borrow Area, he shall halt dredging activity, contact the Contracting Officer, document the coordinates of the location, and move his plant to a more satisfactory location, as described herein. The dredging contractor shall remove/dispose of the objectionable material that was placed on the beach, and then recommence work upon the authorization of the Government.

3.5.2. Equipment

Should the Contractor, during the progress of the work, lose, dump, throw overboard, sink, or misplace any material, plant, machinery, or appliance, which in the opinion of the Contracting Officer may be dangerous to or obstruct navigation, the Contractor shall recover and remove the same with the utmost dispatch. The Contractor shall give immediate notice, with description and location of such obstructions, to the Contracting Officer or Quality Assurance Representative, and when required shall mark or buoy such obstructions, until the same are removed. Should he refuse, neglect, or delay compliance with the above requirements, such obstructions may be removed by the Contracting Officer, and the cost of such removal may be deducted from any money due or to become due the Contractor, or may be recovered under his bond. The liability of the Contractor for the removal of a vessel wrecked or sunk without fault or negligence shall be limited to that provided in Sections 15,19, and 20 of the River and Harbor Act of March 3, 1899 (33 U.S.

C. 410 et seq.).

3.6. PLACEMENT OF EXCAVATED MATERIAL

3.6.1. Beach Fill Placement, General

Material dredged from Folly River Channel (if awarded), and the Folly River Borrow Area under this contract shall be transported and deposited in designated placement areas as shown on the contract drawings and in accordance with these specifications. The perpetual easement line shown on the drawings mark the landward limits of the areas available for placement of materials and constructing beach fill. The Contractor shall exclude the public from the work areas in the immediate vicinity of placement and transporting operations. Prior to placement of fill, the Contractor shall remove from the worksite all snags, driftwood, and similar debris lying within the foundation limits of the beach fill section. All debris and other materials removed from the beach shall be disposed of offsite in an approved landfill.

3.6.2. Suitable Beach Fill Material

Suitable material shall be comprised of materials by ASTM D2487 as SW, SP, SP-SM or SP-SC. This material shall be comprised predominantly of sand with

no more than 10% by weight passing the No. 200 sieve, and no more than 5% by weight coarser than the No. 4 sieve. The accumulation of fine-grained sediment having a greater than 10% fines (weight composite) or excessive amounts of shell or rock at any one location on the beach may adversely affect the ability of sea turtles to successfully nest. In the event that the amounts of sediments smaller than 0.075 mm is exceeded or shell or rock are being disposed of on the beach, the Contractor shall promptly notify the Contracting Officer or his/her Designated Representative to determine appropriate measures to be taken. The Contracting Officer or his/her designated representative will first determine if the incompatible material can be dispersed over and mixed into previously placed material. The Contractor is advised that in extreme situations where the Contracting Officer or his/her designated representative determines the incompatible material is too dense or too extensive to adequately disperse and mix, in order to prevent adverse impacts to sea turtle nesting, removal of the incompatible material from the beach may be required. The Contractor shall remove the incompatible material at no cost to the Government.

3.6.3. Public Access to Beach

Except in the immediate area where beach fill is being placed, beaches shall remain open to the public at all times during project construction. The Contractor shall make provisions as necessary to protect the public from all hazards in the construction areas. This requirement may be accomplished as the Contractor elects but must be in compliance with the requirements specified in this section, 29 CFR 1910, 29 CFR 1926, and EM 385-1-1. The Contractor’s plan to meet these requirements shall be included in the Accident Prevention Plan to be submitted and discussed at the preconstruction safety conference. At Folly Beach, the Contractor shall provide sand ramps over the discharge pipe for pedestrian access at intervals not to exceed 300 feet and at each public beach access point blocked by the pipe.

3.6.4. Beach Fill Section

Beach fill material shall be placed at the locations and in a manner to meet the design profile features and grades shown on the drawings and within the tolerances specified in Paragraph “Tolerances”, unless otherwise approved by the Contracting Officer. The sequence for placing beach fill shall be in accordance with Paragraph Order of Work. Placement shall begin at the points determined by the Contractor and included in the approved work plan and proceed continuously to the end of the beach fill berm. Any material that is deposited by the Contractor in places other than those designated or approved by the Contracting Officer shall be removed and placed at the locations directed by the Contracting Officer, at the Contractor’s expense.

3.6.5. Additional Shaping and Grading

3.6.5.1. Beach Fill Shaping and Grading

Additional shaping and grading of the beach fill beyond that specified herein may be necessary at certain locations as determined by the Contracting Officer’s Representative. Such areas include low areas between the top of the

new beach fill berm and the easement line. As directed by the Contracting Officers’ Representative, the Contractor shall perform additional shaping and grading using the Contractor’s bulldozer already onsite for regular beach fill grading operations. The locations on the beach fill will be determined by the Government.

3.6.6. Placement Methods

The excavated material shall be discharged directly into the fill section by pumping, by stockpiling the material on the beach at locations approved by the Contracting Officer and hauling or pushing the material into place in the fill section, or a combination of the two methods; EXCEPT THAT, at locations where the elevation of the existing beach or dune is less than the finished top elevation of the berm, material shall be mechanically placed in lieu of hydraulically placed to avoid placing material beyond the perpetual easement line.

3.6.7. Direct Placement

If material is placed by discharging it directly into the fill section, the dredge discharge points shall be manipulated and controlled by the Contractor in such a manner to minimize the loss of material into the surf zone. If necessary, seaward, longitudinal diking shall be utilized to keep material on the beach and within the limits of the fill cross section, by controlling the seaward flow of discharged material and preventing erosion and gullying of the beach fill. No undrained ponds or pockets of water shall be left in the fill during construction or upon completion of the work. Water shall not be permitted to flow landward of the fill section and, to the extent practicable, water shall not be permitted to pond on the upland side of the beach fill.

3.6.8. Temporary Stockpiling

If dredged material is to be temporarily stockpiled on the beach for later hauling to the fill section, the Contractor shall provide the necessary dikes, embankments, temporary bulkheads and spillways to confine the material within approved stockpile areas. For stockpile areas, the material shall be confined landward of the seaward crest of the new El. +8-foot (NAVD 88) contour. Any material that is rehandled or moved and placed in its final position by other than hydraulic methods, shall be placed in approximately horizontal layers not more than 3 feet thick. No compaction will be required.

3.6.9. Fill under Structures

Within 12 hours after placing the adjacent beach fill, void spaces under structures such as dune walkovers, piers, and boardwalks shall be completely filled where they lie within the lines and grades established for the beach fill section. If necessary, manual tools, such as shovels and rakes, shall be used to accomplish this. The areas beneath and around walkover steps and boardwalks shall be leveled to the same elevation as the surrounding beach fill.

3.6.10. Protection of Existing Dunes and Beach Berm

The Contractor's operations shall not damage the existing dunes and beach berm. Regardless of the method of placement of material into the final fill section, unless otherwise directed in writing, the Contractor shall control the discharge of dredged material onto the beach to prevent erosion or other damage to the existing dunes and beach berm. The discharge shall be controlled by back diking, embankments, temporary bulkheads, channeling, or other approved methods.

3.6.11. Protection of Existing Structures

Existing permanent structures along the beach include seawalls, bulkheads, revetments, groins, boardwalks, dune walkovers, ramps, and other structures.

The Contractor's fill placement operations shall be controlled so as not to damage any permanent structures. The Contractor’s equipment shall come no closer than 5 feet to any non-walkover structures. Protection of groins from beach fill operations and damage from equipment crossing should be detailed in the approved work plan. Any damages to existing structures resulting from the Contractor’s operations shall be paid for by the Contractor at no expense to the Government.

3.6.12. Landward Placement

The Contractor shall prevent the discharge of dredge slurry and the placement of fill landward of the limits of the fill section as shown on the contract drawings or other limits established by the Contracting Officer. Any deposits, discharge, and/or operations concerning deposition or discharge toward land and wetland areas beyond these limits shall be at the Contractor's own risk. If directed by the Contracting Officer's Representative, the Contractor shall remove such deposits at his own expense.

3.6.13. Removal of Temporary Construction

At the end of the beach fill placement operation, any back diking or embankment that is not incorporated into the permanent work shall be removed and the area graded to the existing surrounding elevations. All temporary bulkheads shall become the property of the Contractor and shall be removed from the work site before completion of all work. The area shall be regraded to the required section to eliminate ponding and erosion of the berm slope.

All equipment necessary for beach fill operations, including but not limited to heavy machinery, dredge pipe, temporary benchmarks, survey stakes, etc.

shall be removed from project site prior to completion of work.

3.6.14. Finished Beach Fill

Beach fill shall be constructed at the locations and to the lines and grades shown on the drawings. The volume of sand per linear foot of beach required at Folly Beach and at Bird Key (option) shall be placed as indicated on the drawings unless otherwise approved by the Contracting Officer’s Representative. In addition, at Folly Beach, the existing beach profiles vary over the length of the beach; therefore, advanced nourishment berm widths will vary with each cross section, in order to place the required volume of sand at each section. Furthermore, the slope of the fill placed below mean

high water will vary naturally, depending upon the character of the material being placed, placement technique, wave intensity, and tidal cycle. Control of the net in-place yardage of fill material on Folly Beach shall be accomplished by varying the width of the berm as shown on the drawings to obtain the required in-place volume per linear foot of beach fill. The finished surfaces shall be relatively smooth and free from irregularities that would affect an accurate survey. During the contract period, escarpments below elevation +6.0 feet (NAVD 88) that are more than 18 inches high and more than 100 feet long (continuously) shall be mechanically flattened to approximately the natural beach slope as it was prior to fill placement. As fill is placed, each 500-foot length of berm shall be smoothed. This shall be accomplished by dragging an approximately 30-foot long, 12-inch steel beam over the beach fill. Two-inch wide by 8-inch long straps shall be attached over the length of the beam at 12-inch spacings. A 40-foot wire rope shall be attached at the ends of the beam and pulled with a 50-foot chain. The smoothing operation shall be continuous on both sides of the discharge pipeline. Final smoothing of beach fill, including the fill at the Bird Key (option), shall be accomplished in the same manner within 48 hours after the discharge line is removed. Lines and grades and in-place volumes shall be within the prescribed tolerances specified in paragraph Tolerances, below.

3.6.15. Tolerances

At elevation +2.0 feet (NAVD 88) and above, the surface of the finished beach fill shall vary not more than 0.5 foot above or below the established grade or approved cross section. In addition, the volume of beach fill material placed per linear foot of beach shall be within plus or minus five (+5) cubic yards of the required volume shown on the drawings.
