Vendors must submit complete pricing pages as failure to do so may result in bid disqualification. All deliveries are F.O.B. destination, meaning the vendor bears all shipping costs and risk of loss. Payment will be processed according to West Virginia state procedures. Unacceptable items will be returned at the vendor's expense with no restocking charges, and vendors must either arrange return within five days or reimburse the Agency for return delivery costs. Vendor default includes failure to provide items meeting specifications, non-compliance with applicable laws, or failure to remedy deficient performance, with available remedies including immediate contract cancellation and obtaining the contract item from a third party at the vendor's expense.
