About this file
This is a memorandum from the New York Department of Corrections and Community Supervision (DOCCS) regarding Gender-Based Violence (GBV) competitive procurement requirements effective November 5, 2025, issued under State Finance Law 139-m. The memorandum applies to all Departmental Service Areas (DSAs) and Stewards and requires any entity bidding on competitive procurements for state agency contracts to implement a Gender-Based Violence and the Workplace policy. All formal competitive procurements, including Invitations for Bid (IFBs), Requests for Proposals (RFPs), and Requests for Applications (RFAs), must include an attestation form and template language addressing this requirement. The memorandum directs agencies to update all attachment and checklist listings on competitive solicitations to reference the GBV form and to include specified IFB/RFP/RFA language in solicitation documents, placing it alongside other State Finance Law requirements such as Executive Order 16, Sexual Harassment Prevention, and conflict of interest provisions.
The memorandum provides four reference documents to support implementation: an Office of Domestic Violence (OPDV) memo regarding GBV changes under Executive Order 17, an FAQ document for state agencies regarding State Finance Law 139-m, an OPDV GBV Workplace Bidder Model Policy available to potential bidders, and a letter for current New York State vendors providing information about the new requirement and available resources. Agencies are directed to contact the Contract Procurement Unit at 518/436-7886 option 7 or DOCCSContracts@doccs.ny.gov for additional assistance with implementation.
