About this file
This is an email correspondence regarding prevailing wage compliance for the City of Santa Monica's towing and roadside services procurement. The email chain between Ernest Kwong from Fleet Management and Kim Morales, Labor Compliance Supervisor at GCAP Services, Inc., addresses whether the proposed towing and roadside services contract would be subject to prevailing wage requirements. The services encompass towing for light-duty, medium-duty, and heavy-duty vehicles, roadside assistance including tire changes and battery jumps, and special services such as inventory stocking of wheels on rims for field replacement. Services are performed both within Santa Monica and at external vendor locations, with an annual estimated spend of $300,000 over a five-year contract term.
Kim Morales confirmed that the towing and roadside services would not be covered under prevailing wage requirements, based on the service scope and delivery method described. This clarification is significant for bidders preparing cost proposals, as it indicates labor costs will not need to include prevailing wage rates mandated under California law for certain public works projects. The determination reflects that despite vehicles being used on streets and services being performed on streets, the nature of the work—particularly services performed at vendor locations rather than as public works construction—excludes the contract from prevailing wage obligations.

Hello Kim, Fleet Management is looking to go out to BID for Towing and roadside services for light/medium and for heavy vehicles and components. These trucks/vehicles are used on the street, and services are on the street.
Are they subject to the Prevailing Wage? Please see scope of services below. Services/Repairs would take place at the vendor location. Our bid is for an annual estimated spend of $300,000/year for 5 years. I appreciate your time.
“Vendor to provide towing and roadside services for light/medium-duty vehicles, for heavy-duty vehicles and for components. Towing services required to various locations in the City of Santa Monica ("City") and to vendors in the City and outside the City. Roadside services include but are not limited to changing tires and jumping batteries. Special services include but are not limited to vendor stocking inventory of wheels on rims for in-field replacement.”
Thank you, Ernest & Jen
