About this file

This is a Government-Wide Debarment and Suspension (Non-Procurement) certification form required by the Federal Transit Administration (FTA) for the Cecil County, Maryland Transit & Heavy Machinery Fleet Maintenance contract opportunity. The certification form establishes compliance requirements for contractors, subcontractors, and lower-tier participants entering into covered transactions with federal funding. Contractors must verify that neither they nor their principals, affiliates, or first-tier subrecipients are debarred, suspended, proposed for debarment, declared ineligible, voluntarily excluded, or disqualified from federal participation. The form requires certification that management has not been convicted of fraud, criminal offenses, antitrust violations, embezzlement, theft, forgery, bribery, falsification, or destruction of records related to public transactions within three years preceding the application. Additionally, contractors must confirm they are not presently indicted or criminally charged with any such offenses and have not had public transactions terminated for cause or default within the preceding three-year period.

Contractors are obligated to treat all lower-tier contracts and subcontracts equaling or exceeding $25,000, audit service contracts, or those requiring federal official consent as covered transactions under 2 CFR parts 180 and 1200. Each covered lower-tier contractor and subcontractor must comply with federal requirements and ensure that all lower-tier participants are not debarred, suspended, proposed for debarment, declared ineligible, voluntarily excluded, or disqualified from the federally funded project. Contractors must promptly notify the FTA of any information that contradicts their certification statements and provide written explanations if unable to certify compliance. An authorized official must sign the certification, attesting to the contractor's and its principals' eligibility to participate in covered federal transactions.
