This is an Invitation to Bid (ITB) document from the Florida Fish and Wildlife Conservation Commission (FWC) seeking competitive pricing for sand pine regeneration removal services across approximately 797 acres at various locations throughout Telogia Creek Wildlife Management Area in Liberty County, Florida. The project involves removing sand pine trees from three distinct encroachment levels designated as "Light," "Moderate," and "Heavy," with vendors required to submit cost-per-acre pricing for each category. A mandatory pre-bid conference and site visit meeting is scheduled for September 28, 2026, at 10:00 AM ET at coordinates 84.9152123 W, 30.4162534 N, with attendance required for bid responsiveness. The deadline for submitting written questions is October 2, 2026, at 5:00 PM ET, and sealed bids must be received by October 16, 2026, at 1:00 PM ET at the FWC Purchasing office in Tallahassee, Florida. The public bid opening will occur on the same date and time, with an anticipated award date of October 20, 2026. Work may commence upon purchase order execution and must be completed and invoiced by June 15, 2027, representing an initial contract term of one year with optional renewal for up to two additional years under the same terms and conditions.

Bidders must submit pricing on a cost-per-acre basis for the three sand pine removal levels, with the award going to the responsive and responsible bidder submitting the lowest total summed cost across all three categories. All bids must include mobilization and transportation costs, and vendors are responsible for obtaining all required permits and complying with federal, state, and local environmental guidelines and best management practices. Bidders must be registered in MyFloridaMarketPlace (MFMP) and, where applicable, the SunBiz system prior to bid opening and must provide a minimum of three references for similar completed projects. The Commission requires proof of workers' compensation insurance (if more than four employees), automobile insurance, and public liability and property damage insurance. Invoicing and full payment occur only after work completion and FWC verification, with liquidated damages assessed at $100 per calendar day for delays beyond the June 15, 2027, completion date unless delays result from circumstances beyond the contractor's control. No partial payments are authorized for this project, and the contractor must remove all equipment and debris upon completion before final payment is awarded.

BIDDER ACKNOWLEDGMENT

In order for this bid to be valid, the bid must be completed in its entirety, signed by the Bidder and returned, as part of the bid or the bid will be rejected. By affixing your signature to the ITB Bidder Acknowledgement Form (page 2), the Bidder hereby states that the Bidder has read all bid specifications and conditions and agrees to all terms, conditions, provisions, specifications, and is currently licensed to do business within the State of Florida, if required by State or Federal Law, for the services or commodities the Bidder will provide the Commission under these bid specifications.

REFERENCES

Each prospective Bidder shall provide a minimum of three (3) references for similar projects completed. Current contact names and phone numbers shall be included with the bid package. See the attached references form for reference requirements.

EQUAL BIDS

A Bidder will not be permitted to amend or supplement its Bid in response to such request for clarification. If the tie has not been broken by application of the aforementioned statutes, the Commission will proceed with a random selection to decide the award.

SUPPORTING/SUPPLEMENTAL INFORMATION

The Commission requires that bidders submit all required technical, specification, and other supporting information with their bid, so that a detailed analysis and determination can be made, by the Contract Manager that the product/service offered meets this ITB’s specifications and that other requirements of this ITB have been met. However, provided a bid meets the requirements for a definite, firm, unqualified, and unconditional offer, the Commission reserves the right to request supplemental information from the bidder after the bids have been opened to ensure that the products/services offered completely meet this ITB’s requirements. The requirement for such supplemental information will be at the reasonable discretion of the Commission and may include the requirement that a bidder will provide a sample product(s) so that the Commission can make a first-hand examination and determination.

A bidder's failure to provide this supplemental information or the product sample(s), within the time set by the Commission, will cause the Commission to consider the Contractor non-responsive and reject the Contractor’s bid.

Bidders are cautioned that Florida law generously defines what constitutes a public record and grants broad rights of public access to those records; see, for example, section 119.07, F.S. If a Bidder believes that its response contains information that is confidential or exempt from disclosure under Florida Law, the Bidder shall clearly segregate and mark that information (for example, stamp each page "Confidential" and place it in an envelope marked "Confidential") and briefly describe in writing the grounds and specific legal citations for claiming exemption from the public records law. 4. GENERAL SPECIFICATIONS

4.1. Vendors are responsible for knowing and complying with federal, state, and local guidelines and Best Management Practices for conducting operations in pine flatwoods and ecotones around cypress domes and wetlands to avoid or minimize impacts to sensitive vegetative communities.

4.2. Protection of Work – The Vendor shall perform the work in a safe and careful manner and will furnish and use such safety devices, methods, and measures as are required to protect the Vendor and their employees thereof, FWC personnel, and the public against bodily injury or damage to property.

4.3. Vendor shall work with the Project Manager to determine the order in which areas are to be treated and shall provide a work schedule specifying an estimated completion date. The Project Manager must be notified at least two days before work commences on the site, and the Vendor will obtain advance approval from the Project Manager prior to making a change to the agreed upon work schedule. Changes to the agreed upon work schedule may be granted by the Project Manager if weather conditions prevent completion of work according to these specifications. Exceptions will not be made for unfavorable weather conditions that do not prohibit the completion of work according to these specifications.

4.4. The Vendor shall furnish all labor, equipment, supplies, materials and fuel necessary to successfully provide the service in accordance with the specifications contained herein. In the event of an equipment malfunction or breakdown, the Vendor shall be capable of replacing essential equipment within 48 hours to avoid unnecessary delays.

4.5. The Vendor will not subcontract, assign, or transfer any services without the prior written consent of the FWC Contract and Project Managers. If permission is granted, the Vendor is responsible for ensuring that work is performed in accordance with the specifications contained herein. The Vendor is solely responsible for all financial arrangements and payments to any subcontractor or assignees.

4.6. All equipment must be thoroughly cleaned of all dirt and vegetative debris before entering or re-entering the WMA to prevent the introduction or spread of invasive or exotic vegetation. FWC staff reserve the right to inspect equipment prior to its use on the area to ensure it is free of vegetative contamination and require equipment to be removed from property and properly cleaned prior to commencing work as needed.

4.7. It shall be the responsibility of the Vendor to keep all roads and firelines open and unblocked during operations and to keep gates closed and locked while conducting work and after leaving the project site. Any equipment left in the area during the project will be at the Vendor’s risk.

FWC will not accept any responsibility for equipment left on site.

4.8. Any damage to existing state or county property (i.e. roads, culverts, low water crossings, fences, gates, signs, or natural resources) caused by the Vendor and not within the scope of the project work will be the responsibility of the Vendor. Road ditches will be cleaned out where equipment crosses in or out of work areas. Care will be taken to avoid excessive rutting as specified by the Project Manager. The Vendor shall be responsible for the conduct of hired personnel at all times while within the project area.

4.9. The Vendor shall remove all extraneous materials, equipment, and litter associated with the project from the area before final payment will be awarded. It is the responsibility of the Vendor to see that the area is cleaned upon completion of the project.

4.10. In the event historical or cultural artifacts are uncovered during work, the Vendor shall immediately halt activities within that area and notify the Project Manager.

4.11. The Vendor is expected to avoid harassment of wildlife on state managed lands. The willful take of any animal species while working on state lands, will void the contract and the vendor may be subject to legal penalty under applicable wildlife laws. Gopher Tortoises and their burrows occur at low densities on some of the work sites. All known burrows will be flagged by the manager, and a map will be presented to the vendor of the known burrows prior to work initiating. No heavy equipment shall be operated within 25 feet of any known tortoise burrow.

If a new tortoise burrow is discovered or suspected, the vendor shall contact the land manager immediately and work shall cease within 25 feet of the location until confirmation has been made.

4.12. Stop Work Clause – The Project Manager or designated representative reserves the right to halt work and/or dismiss the Vendor if the work is not being completed in accordance with the specifications contained herein. Work will not resume until the deficiency or deficiencies are corrected. The Project Manager or designated representative also reserves the right to halt work for the following conditions: excessively wet conditions, unacceptable levels of ground disturbance, unsafe operation of equipment, unacceptable damage to non-target plant species, working in unapproved areas, and failure to make suitable progress.

4.13. Work should be quoted and performed at a cost per acre rate. The quote price shall include mobilization and transportation of all necessary equipment to and from the work sites.

4.14. Payment will be based upon the actual number of acres treated in accordance with the specifications contained herein, to be determined by the Project Manager or designee, using GPS equipment and GIS software. Any questions regarding the specific acreage given for each site shall be resolved with the Project Manager before the Vendor commences operations. FWC will deduct from payment the cost per acre for any areas mowed that do not satisfactorily meet the specifications provided herein.

5. PROJECT SPECIFICATIONS

5.1. Only Sand Pine found in confirmed Long-leaf pine stands will be removed.

Ch. 287 Invitation to Bid – Revised 07.01.2026 FWC 26/27-15, Page 15 of 66

5.2. The total acreage has been divided into three groups (“Light”, “Moderate”, and “Heavy”), with each group representing a level of sand pine encroachment.

5.3. The Project Manager will provide detailed maps outlining the areas where sand pines are to be removed and all work must only occur within these boundaries (Figure 2). This acreage is given only as a guideline for preparing your quote and should not be construed as representing actual quantities under this contract. FWC reserves the right to increase or decrease acreage based on the quoted cost per acre and available funding. Exact locations may also be modified based on site conditions or other factors.

5.4. The project entails 100% removal of all sand pine tree species including but not limited to regenerated and seedling sand pines within the target areas (Figure 2).

5.5. Only sand pines should be removed; all other pine species (i.e. longleaf, loblolly, or slash pine) will be left intact.

5.6. Hand pulling should be the primary method of removal and sand pines less than ½-inch in stem diameter must be pulled by hand. However, brush saws and chainsaws will be acceptable for removing sand pines with greater than ½-inch stem diameter.

5.7. When using saws, sand pines must be cut below the lowest live branches. Preferably, they should be cut at or slightly above ground level to allow for ATV and UTV clearance of undercarriage, A-arms, axles, and differentials.

5.8. Treated sand pines should be left where they are cut or pulled and should not be piled.

5.9. If a treated sand pine falls or leans onto any surrounding non-target tree (other pine species including but not limited to Long Leaf Pine), then the vendor must push it off or cut it further to ensure that it is lying on the ground and that the surrounding/impacted longleaf(s) remains upright.

5.10. Herbicidal treatment of cut stumps is not requested or necessary.

5.11. To ensure complete and efficient treatment, work should be conducted along transects.

Individuals should walk along transects spaced ≤5 feet apart. Any saplings with a stem diameter greater than ½ inch should be marked and subsequently treated by brush saw or chainsaw. Transect specifications may be amended to increase efficiency with the approval of the Project Manager.

5.12. Upon completion of services, the Vendor shall remove and dispose of all trash and debris from the WMA. FWC will not pay for hauling, dumping, tipping, trash, hazardous waste, or other related waste fees.
