About this file

This file is a Vendor Questions and Answers document that addresses clarifications for the FRTIB Legal Support Services RFQ (Solicitation Number FRTIB1-26-Q-0020). The document contains seven government responses to vendor questions submitted on June 15, 2026, covering submission requirements, evaluation criteria, and Statement of Work (SOW) clarifications.

Key clarifications include: (1) resumes are required only for Key Personnel identified in the RFP, with position descriptions and qualification narratives for the three designated labor categories (Program Manager, Staff Attorney—Privacy, and Staff Attorney—General Law), but sample resumes for non-Key Personnel are not required; (2) the Price Volume consists of two sections to be submitted as separate files—Section 1 (Price Narrative in PDF or Word format) and Section 2 (Pricing Tables in unlocked Excel format with traceable formulas); (3) the government acknowledged an error stating "three sections" when only two sections exist; (4) Technical Approach and Past Performance are weighted equally and together are more important than Price, though specific percentages were not provided; (5) the Staff Attorney (General Law) is expected to support both Task 2 (General Legal Advice) and Task 3 (Litigation Support), while the Staff Attorney (Privacy) primarily supports Task 1 (Privacy Office), and offerors may propose additional non-Key Personnel for litigation support if needed; and (6) the Program Manager serves as the primary contractor interface with FRTIB for contract management and coordination across all task areas but is not required to be a full-time, on-site, billable resource and may work remotely. The RFQ due date was amended from June 29, 2026 to July 6, 2026.

16/15/26E.1.1 Submission of OfferE.1.1 states "Resumes are also excluded from the page count".The solicitation does not specify what resumes are required in the Technical response. If resumes are required as part of the solicitation response, can FRTIB clarify which resumes are required (Key Personnel Management Team, sample resumes for the 3 Key Personnel LCATs specified in the RFP, etc.).Offerors should not include general staff resumes beyond what is explicitly requested. For purposes of proposal evaluation, the following applies:
•Key Personnel :

Resumes are required only for those individuals identified as Key Personnel in the RFP. These resumes should demonstrate that the proposed individuals meet the minimum qualifications outlined in the solicitation.

• Labor Category (LCAT) Descriptions:

Offerors should provide position descriptions and qualification narratives for the three Key Personnel labor categories (LCATs) identified in the RFP, consistent with Section L instructions.

Sample or representative resumes for LCATs are not required unless explicitly requested elsewhere.

Management/Staffing Approach:

The Technical Proposal should describe the management structure, staffing approach, and personnel qualifications at a high level, but should not include resumes for non-Key Personnel.

If Offerors are uncertain whether a position qualifies as Key Personnel, they should refer to the RFP definition and designation of Key Personnel. No additional resumes beyond those specified will be evaluated.

26/15/26E.1.4 Volume III - PriceE.1.4 states "The price quote shall include the following details:..."Can FRTIB confirm that the seven (7) details requested in this section are to be included in Volume III - Price, Section 1: Price Narrative. The Government confirms that the seven (7) administrative details identified in the RFQ (Items 1–7) are required elements of the overall price quotation submission.
36/15/26E.1.4 Volume III - PriceE.1.4 states "The Contractor's Price Quote shall consist of three (3) sections".E.1.4 states that "The Contractor's Price Quote shall consist of three (3) sections", however only specifies two (2) sections - Section 1: Price Narrative; and Section 2: Pricing Tables. Can FRTIB clarify if there is an additional section to be included in the price volume? The Government acknowledges the inconsistency in Section E.1.4. The reference to “three (3) sections” is in error. Offerors shall structure their Price Quote using the two (2) sections explicitly identified in the solicitation:

Section 1: Price Narrative Section 2: Pricing Tables

46/15/26E.1.4 Volume III - PriceE.1.4 states " Quoters shall ensure the pricing table accurately calculates the total proposed price. Submit in Microsoft Excel format (Office 2010 or later) as an unlocked workbook with traceable formulas and cell formatting".Since Volume III - Price, Section 2: Pricing Tables is to be submitted as an excel document, please confirm that the complete proposal response submission is to include four (4) separate files: 1) Volume I - Technical Approach; 2) Volume II - Past Performance; 3) Volume III - Price, Section 1: Price Narrative; and 4) Volume III - Price, Section 2: Pricing Tables. As stated, Volume III – Price consists of two sections: Section 1 (Price Narrative), which is to be submitted in PDF or Microsoft Word format, and Section 2 (Pricing Tables), which is to be submitted in Excel format. Due to these differing formats, the Price Volume may be submitted as separate files corresponding to each section.
56/15/26E.2 Evaluation Factors for AwardE.2 states "The Government’s evaluation will be based on an integrated assessment of each quote, considering the extent to which the quote demonstrates a clear understanding of the requirements, a sound approach to performance, relevant past performance, and a reasonable price".Can FRTIB provide the specific weighted percentages for the three (3) evaluation criteria listed in Section E.2? If unable, can FRTIB provide the releative order of importance among the three (3) evaluation criteria? The Government will not provide specific weighted percentages for the evaluation criteria.

The relative order of importance of the evaluation factors is stated in the solicitation. As provided in Section E.2, Technical Approach and Past Performance are of equal importance and, when combined, are more important than Price. As quotations become more equal in Technical Approach and Past Performance, Price may become a more significant factor in the award decision.

66/15/26Attachment A: Statement of Work, Section 4.0 and Section 4.5SOW Section 4.0 Statement of Work Description and Specifications specifies three (3) tasks: 4.1 Task 1 - Privacy Office; 4.2 Task 2 - General Legal Advice; and 4.3 Task 3 - Litigation Support.
SOW Section 4.5 Key Personnel specifies three Key Personnel LCATs: 1) Program Manager; 2) Staff Attorney (Privacy); and 3) Staff Attorney (General Law). The SOW specifies three (3) separate legal support tasks (Privacy Office, General Legal Advice, and Litigation Support). However, the Key Personnel section lists only a Program Manager, Staff Attorney (Privacy), and Staff Attorney (General Law). Can FRTIB clarify whether a separate Staff Attorney dedicated to Litigation Support is required, or if the Staff Attorney (General Law) is expected to perform both Task 2 (General Legal Advice) and Task 3 (Litigation Support)? The Government confirms that the Contractor shall provide expertise and legal advice on issues relating to the Agency’s Privacy Program and in addition shall provide general legal support to OGC on an as needed basis. The legal support will primarily be for the Agency’s Privacy Program but may also involve general legal support to OGC’s other practice areas which include Employee Benefits, Employee Relations, Ethics, Compliance, Federal Procurement, and FOIA.

Offerors should propose a staffing approach that supports all three SOW tasks (Privacy Office, General Legal Advice, and Litigation Support). Specifically:

•The Staff Attorney (Privacy) is expected to primarily support Task 1 – Privacy Office.
•The Staff Attorney (General Law) may support Task 2 – General Legal Advice and is also expected to have the capability to support Task 3 – Litigation Support, as part of the overall legal services requirement.
•The Program Manager is responsible for overall contract management and coordination across all tasks.

Offerors may propose additional non-Key Personnel staff, including personnel dedicated to Litigation Support, as part of their technical approach if they determine it is necessary to meet the requirements of the SOW. However, such roles are not required to be designated as Key Personnel unless otherwise specified.

The Government will evaluate the adequacy of the proposed staffing approach to perform all tasks in accordance with the evaluation criteria outlined in the solicitation.

7 6/15/26 Attachment A: Statement of Work, Section 4.5 Key Personnel SOW Section 4.5 Key Personnel specifies a "Program Manager". The SOW identifies a Program Manager as a Key Personnel and states that they will serve as the primary interface with FRTIB. Can FRTIB clarify whether the Program Manager is expected to be a part of our internal management team overseeing the staffing and administration of the Legal Support Servbices IDIQ, or if the Program Manager is intended to be a deployed, billable contractor performing work on-site for FRTIB? The Government intends for the Program Manager (PM) to serve as the contractor’s primary point of contact and interface with FRTIB, with responsibility for overall contract management, coordination, and performance oversight across all task areas.

The Program Manager is not required to be a full-time, on-site, billable resource performing day-to-day legal services .

•The PM is primarily part of the contractor’s internal management structure, responsible for:
oOversight of staffing, performance, and quality of deliverables
oCoordination across all SOW task areas (Privacy, General Legal Advice, and Litigation Support)
oCommunication with the Contracting Officer (CO), Contracting Officer’s Representative (COR), and other Government stakeholders
•The PM may perform work remotely , consistent with ensuring effective contract performance and responsiveness.
