About this file

This document is the Special Instructions and Conditions for a government procurement opportunity for Miscellaneous Frozen Foods. It outlines the requirements for vendors submitting bids, including inspection, labeling, storage, and delivery specifications for the frozen food products. All meat and poultry items must be processed in USDA-inspected facilities, and vendors must provide Certificates of Compliance for items over $50 per unit. The facility reserves the right to cancel or adjust quantities with 10 days' notice, and delivery must be made on the specified dates. The procurement is open to participation in the Federal Government Donated Commodity Program, and bids must be submitted both with and without consideration of government-donated commodities.

The document also addresses pricing and acceptance terms. Vendors will be responsible for the cost of any laboratory analysis if product ingredients do not meet regulations. Final acceptance of frozen items may be based on inspection of the thawed product up to 15 business days after delivery. The facility is eligible to participate in the Federal Government Donated Commodity Program, and items designated as such must be bid both with and without consideration of government-donated commodities.

SPECIAL INSTRUCTIONS AND CONDITIONS

MISCELLANEOUS FROZEN FOODS

1. INSPECTION: All meat and poultry products must be processed or manufactured in plants operated under the Meat and Poultry Inspection program of the Food Safety and Inspection Service of the U.S. Department of Agriculture or under an inspection program approved by that agency. The official inspection legend and plant number must appear on all shipping containers and/or individually packaged items.

2. CERTIFICATE OF COMPLIANCE: Those items on the purchase proposal costing more than $50.00 per item per delivery must be accompanied by a Certificate of Compliance at time of delivery. The Certificate of Compliance is certification by the vendor or producer that the delivered item complies with the specification under which it is purchased.

3. CONTENTS: Product items shall contain only those ingredients specified. Amounts and kinds of ingredients must be within tolerances permitted by the appropriate regulations. As specified, soy protein concentrate may be used as a binder only and may not exceed 4% of total weight. The facility reserves the right to submit samples for laboratory analysis, within 72 hours after delivery. If ingredients do not meet the appropriate regulations, the cost of laboratory analysis will be charged to the vendor.

4. LABELING: Shipping containers and/or individually packaged items shall be labeled, printed or stenciled with product identification, name and location of packer or distributor, net weight and appropriate ingredient statement.

5. STORAGE AND DELIVERY TIME: Products shall not be held in freezer storage more than 60 days. All items must be delivered within seven (7) days of compliance certification.

6. PRODUCT CONDITION AT DELIVERY: Frozen items shall have an internal temperature of not higher than 10 degrees F (-12.2 degrees C) at time of delivery and shall show no evidence of defrosting, refreezing, freezerburn, dehydration or mishandling.

7. ACCEPTANCE OF FROZEN ITEMS: To prevent mass nesting of frozen products, units must be individually frozen to a solid state, packaged or unpackaged as specified, before being placed in master container. Final acceptance of frozen items may be based on inspection of the thawed product, not to exceed 15 business days after delivery.

8. CANCELLATION CLAUSE: Quantities listed are estimates only and may be increased or decreased in accordance with the actual requirements of the facility. With notification ten days prior to delivery, the facility reserves the right to cancel any quantity of the order and agrees to pay the vendor only for products actually accepted by the Department.

9. DELIVERY DATES: Delivery must be made on the dates as specified in contract. Non-compliance will be cause for rejection unless prior approval for change is granted by the Director of Dietary Services.

10. FEDERAL GOVERNMENT DONATED COMMODITY PROGRAM: This facility is eligible to participate in the Federal Government Donated Commodity Program. Items so designated are to be bid both with and without Government Donated Commodities (GCD) and will be awarded by the lowest bid.
