About this file

This document is a Final Lead-Containing Material Statement of Work/Specifications prepared for the California Department of Education (CDE) Diagnostic Center located at 4339 State University Drive in Los Angeles. The project involves a Ceiling Tile Replacement Project that requires lead-based paint (LBP) survey and remediation across the facility's first and second floors. A comprehensive survey conducted by Panacea, Inc. in November 2023 identified multiple areas with lead-containing materials, including ceramic wall tiles, metal door frames, windowsills, stringers, and risers. The contractor will be responsible for stabilizing or removing poor-condition paint, properly handling and disposing of lead-containing materials, and ensuring worker and environmental safety throughout the renovation process.

The project requires the contractor to obtain necessary permits, conduct timely inspections, and comply with all applicable federal, state, and local regulations regarding lead-containing materials. The scope of work includes removing or stabilizing approximately 3,700 square feet of ceramic wall tiles, 123 door frames, 20 window framing systems, 20 linear feet of stringers, and 80 square feet of risers containing lead-based paint. The contractor must submit detailed pre-job and post-job documentation, including work plans, health and safety plans, respiratory protection plans, and various logs and testing results. The work will be performed in multiple phases, with specific attention to minimizing disruption and maintaining safe egress paths during the renovation.

STATEMENT OF WORK/SPECIFICATIONS

C23-978F – Lead SOW Page 1 of 10

1.0 DESCRIPTION OF WORK

The site/property is described and located as follows:

THE CALIFORNIA DEPARTMENT OF EDUCATION (CDE) DIAGNOSTIC CENTER

4339 STATE UNIVERSITY DRIVE

LOS ANGELES, CALIFORNIA 90032

A lead-based paint (LBP) survey was conducted by Panacea, Inc. (Panacea) for the Ceiling Tile Replacement Project in November 2023. Panacea’s survey findings are summarized in Section 4.1, Table 1 of this Statement of Work (SOW) for use by the Bidder/CONTRACTOR (hereafter referred to as “CONTRACTOR”). Panacea’s survey results (table and figures) are attached to this lead SOW.

This SOW requires the CONTRACTOR to stabilize all paint and coatings in poor condition (including loose, non-intact, chalking, scaling, flaking, peeling, checking, etc.) (collectively referred to hereafter as “paint”) at the site relating to LBP, lead-containing material (LCP), and lead-containing hazardous waste (LCHW).

The CONTRACTOR shall obtain all necessary permits and/or notifications for removal once the contract is issued and before beginning any work. The CONTRACTOR shall arrange timely inspection of all items to be removed and site conditions to ensure proper stabilization, removal, and disposal of paint and associated components in the Diagnostic Center in compliance with all applicable laws and regulations, and this SOW.

The work shall include the removal or stabilization and disposal of poor-condition paint (LBP or LCP) as well as removing any LCHW resulting from the CONTRACTOR's removal or stabilization procedures. The CONTRACTOR shall properly protect its workers and the environment from these materials and properly handle, transport, and dispose of the materials and/or associated components. It is the sole responsibility of the CONTRACTOR to verify the quantities of LBP and LCP provided herein and estimate the amount of work required to protect its workers and the environment from LBP and LCP.

2.0 OBJECTIVE

The objective of this work is to properly remove or stabilize and dispose of all poor-condition paint (LBP or LCP) from the Diagnostic Center in locations where renovation activities will occur for the Ceiling Tile Replacement Project.

3.0 DEFINITIONS

• Lead-Based Paint (LBP) – LBP is defined as paint or surface coating containing lead equal to or greater than 0.7 milligram per square centimeter (mg/cm2) by area or 0.5 percent (or 5,000 parts per million [ppm]) by weight. The 0.7 mg/cm2 by area is based on the Los Angeles County (LAC) Health and Safety Code, and 0.5 percent by weight is

C23-978F – Lead SOW Page 2 of 10 based on U.S. Department of Housing and Urban Development (HUD) guidelines and regulations.

• Lead-Containing Material (LCP) – LCP is defined as any material containing detectable lead concentrations, regardless of the testing method used, including LBP.

This definition is based on the California Division of Occupational Safety and Health Administration (DOSH) regulations, which define lead as metallic lead, all inorganic lead compounds, and organic lead soaps at any detectable concentration.

• Lead-Containing Hazardous Waste (LCHW) – LCHW is defined as any waste in which representative samples of that waste exhibit certain toxic characteristics as determined by Title 22 California Code of Regulations (CCR) Section 66261.24 (22 CCR 66261.24) and/or the Resource Conservation and Recovery Act (RCRA).

4.0 NOTIFICATIONS TO CONTRACTOR

It is the sole responsibility of the CONTRACTOR to verify the quantity of LBP and LCP, verify the amount of work required to remove or stabilize LBP and LCP, comply with all applicable laws and regulations, and protect its workers and the environment.

Aside from the LBP (equal to or greater than 0.7 mg/cm2 by area or 0.5% by weight) described in this SOW, the CONTRACTOR is hereby notified that it shall assume all painted/coated surfaces in the renovation areas contain detectable amounts of lead or LCP (detectable lead less than 0.7 mg/cm2 or 0.5 percent by weight).

The CONTRACTOR should be aware that this is a multi-phased project. The phasing schedule is included in the attachments.

4.1 PRESENCE, LOCATIONS, AND QUANTITIES OF LBP

Panacea’s survey report indicated that LBP and LCP were detected at various concentrations.

The LBP found in the renovation areas are listed in Table 1 below. All other painted surfaces shall be assumed and handled as LCP. For details of the survey results, see the table and figures in attachments.

All poor-condition paint shall be removed or stabilized and disposed of as a part of the scope of work in this SOW.

Notes:

1. mg/cm2 = milligrams per square centimeter; LBP = lead-based paint; SF = square feet; LF = linear feet; “~” = approximately.

2. Refer to figures in the attachments for area/room designations and components containing LBP.

4.2 LEAD-BASED PAINT

In 1978, the Consumer Product Safety Commission (CPSC) established a maximum lead content in paint of less than 0.06 percent (600 ppm) by weight in a dry film of newly applied paint. CPSC had since lowered the maximum lead concentration from 600 ppm to 90 ppm in 2008. However, paint with these concentrations (600 or 90 ppm) is not considered LBP but LCP

(HUD, 2012).

HUD specifies that LBP exists when paint contains lead equal to or greater than 1.0 mg/cm2 by area or 0.5 percent by weight (HUD, 2012). California Department of Public Health (CDPH) adopted HUD's LBP definitions in Title 17, CCR, Section 35033 (CDPH, 2018).

The LAC Health and Safety Code, Chapter 11.28.010, defines “dangerous levels of lead-bearing substances” as “any paint, varnish, lacquer, putty, plaster, or similar coating or structural material which contains lead or its compounds in excess of seven-tenths (0.7) of one milligram per square centimeter.”

Typically, the area concentrations are based on field XRF analysis, while the weight concentrations are based on one of several laboratory analytical methods such as atomic absorption spectrometry (AAS) and inductively coupled plasma-atomic emission spectrometry

(ICP-AES).

C23-978F – Lead SOW Page 4 of 10

The HUD and CDPH definitions are the generally accepted industry standards for determining the presence or absence of LBP and typically applicable to occupied residential and commercial structures. However, in the absence of LBP under HUD and CDPH definitions, lead can be and often is still present in paint and surface coatings. Therefore, in the absence of LBP as tested using an XRF analyzer or laboratory method, the CONTRACTOR is required to comply with DOSH lead regulations applicable to worker exposure and with 22 CCR 66261.24 and RCRA regulations applicable to hazardous waste disposal.

4.3 WORKER EXPOSURE STANDARDS

Due to the growing concerns related to workplace lead exposure, the Federal Occupational Safety and Health Administration (OSHA) promulgated a lead standard for the construction industry in Title 29, Code of Federal Regulations (CFR), Part 1926.62 (29 CFR 1926.62), on May 4, 1993. DOSH adopted and revised the OSHA standard under CCR, Title 8, Section

1532.1 (8 CCR 1532.1) (DOSH, 2007). Under 29 CFR 1926.62 and 8 CCR 1532.1, lead is defined as metallic lead, all inorganic lead compounds, and organic lead soaps. Lead paint is included in this regulation; however, it is not defined with any given concentration.

DOSH established exposure levels for lead in the construction industry at an action level (AL) of 30 micrograms of lead per cubic meter (µg/m3) of air and a permissible exposure level (PEL) of 50 µg/m3 calculated as an 8-hour time-weighted average (TWA) (DOSH, 2007). For certain construction activities involving lead paint, OSHA requires that an employer treat employees as if they were exposed to lead at a certain level and implement employee protective measures until exposure assessment using air sampling indicates otherwise. These activities and assumed levels of exposure are summarized in the table below (DOSH, 2007).

ACTIVITIES

ASSUMED LEVELS OF EXPOSURE

(µg/m3)

Manual demolition of structures

Manual scraping

Manual sanding

Heat gun applications

Power tool cleaning with dust collection systems

Spray painting with lead

Exposure >50

Use of lead containing mortar

Lead burning

Rivet busting

Power tool cleaning without dust collection system

Cleanup of dry expendable abrasives

Abrasive blasting enclosure movement and removal

Exposure >500

Abrasive blasting

Welding

Cutting

Torch burning

Exposure >2,500

The detection limit of the XRF analyzer is generally considered to be accurate when concentrations of lead in paint are greater than 0.7 mg/cm2. The accuracy of the laboratory

C23-978F – Lead SOW Page 5 of 10 analytical methods is typically expressed in parts per million (or below the CPSC 0.06 percent by weight). When an XRF analyzer does not detect lead in paint, a high likelihood exists that the same paint may contain lead above the detection limits of laboratory analytical methods such as AAS and ICP-AES. DOSH regulations are not based on the concentrations in paint but rather on the exposure levels in air and/or blood. Therefore, it is prudent to indicate that the CONTRACTOR or its subcontractor shall provide proper personal protection equipment for its workers and/or perform exposure assessments when the listed tasks/activities are triggered.

This SOW and the assumption that all painted surfaces are presumed to contain detectable lead serve as a notification to the CONTRACTOR as to the presence, locations, and quantity of known/assume LBP in the renovation areas. Should the CONTRACTOR disagree with the assumptions made, then the CONTRACTOR’s price shall include all testing, evaluating criteria, and removing LBP and LCP based on its evaluation at no additional cost to the Department of General Services (Client).

4.4 LEAD-CONTAINING HAZARDOUS WASTE

Regulation 22 CCR 66261.24 states that when representative samples of a waste exhibit certain toxic characteristics then the waste is considered hazardous. Lead-containing waste is regulated as a hazardous waste if it exhibits one of the three threshold concentrations: total threshold limit concentration (TTLC), soluble threshold limit concentration (STLC), and/or Toxic Characteristic Leaching Procedures (TCLP). Interpretations of the waste concentrations are presented below for CONTRACTOR's reference.

• TTLC equal to or greater than 1,000 milligrams per kilogram (mg/kg) (or 0.1 percent)

- The TTLC for lead is 1,000 mg/kg. If the sample concentration is at or above 1,000 mg/kg, then the represented material/waste when demolished will be considered as a California hazardous waste.

- Additional TCLP analysis is required to determine whether the California-regulated waste is a RCRA hazardous waste. If the TCLP result is at or above 5 milligrams per liter (mg/L) of solution, then the waste is a RCRA hazardous waste. If the TCLP is below 5 mg/L, then the waste is considered to be a California-regulated waste (i.e., non-RCRA hazardous waste).

• TTLC between 50 and 1,000 mg/kg (or 0.005 to 0.1 percent)

- If the sample concentration is between 50 and 1,000 mg/kg, then additional testing using the California-mandated waste extraction test (WET) can be conducted to further characterize the waste. The STLC for lead is 5 mg/L. At or above 5 mg/L of lead, the material would need to be disposed of as a California hazardous waste.

Below 5 mg/L of lead, the waste is considered as construction debris or non-hazardous waste.

C23-978F – Lead SOW Page 6 of 10

- If the sample concentration is between 100 to 1,000 mg/kg, then additional testing using the TCLP can be conducted to further characterize the waste. The TCLP for lead is 5 mg/L. At or above 5 mg/L of lead, the material is classified as RCRA hazardous waste. Below 5 mg/L of lead, the waste is considered as non-RCRA hazardous waste; however, the STLC analysis is still required to determine if the waste is a California-regulated waste.

• TTLC less than 50 mg/kg (or 0.005 percent)

- If the sample concentrations are less than 50 mg/kg, then the waste is considered as construction debris or non-hazardous waste.

5.0 GENERAL REQUIREMENTS

The CONTRACTOR shall assume that all painted/coated surfaces contain LBP or LCP and shall include in its bid price the following:
