About this file
This is a Brand Name Justification document prepared by the Federal Mediation and Conciliation Service (FMCS) to support a procurement for Adobe software license subscriptions.
FMCS is requiring the purchase of Adobe Acrobat Pro for Enterprise (38 licenses, SKU 65271786BB03A12) and Adobe Creative Cloud All Apps (3 licenses, SKU 65297390BB03A12) through continuation of existing enterprise subscription agreements. The recommended NAICS code is 513210 (Software Publishers) and PSC code is 7A21 (IT and Telecom - Business Application Software), with posting planned on SAM.gov. The justification centers on maintaining continuity with FMCS's existing Adobe-based workflows and document production processes, including PDF creation, editing, combining, redaction, document preparation, graphic design, and multimedia functions. The contracting officer determined that alternative software products cannot adequately meet the government's need for Adobe licensing continuity, file compatibility, Creative Cloud access, and enterprise license administration without requiring additional testing, workflow conversion, user retraining, and transition support. While the requirement specifies Adobe brand products, the procurement will still seek competition among authorized vendors capable of providing the specified Adobe subscriptions in the required quantities and subscription terms as outlined in the solicitation.

Adobe Brand Name Justification
Adobe Acrobat Pro for Enterprise and Adobe Creative Cloud All Apps
Requirement Adobe Acrobat Pro for Enterprise and Adobe Creative Cloud All Apps license subscriptions
Recommended NAICS 513210 - Software Publishers Recommended PSC 7A21 - IT and Telecom - Business Application Software Posting Method SAM.gov Prepared By Bronson Madero, Contracting Officer
1. Purpose This document supports the use of an Adobe brand name requirement for the purchase of Adobe Acrobat Pro for Enterprise and Adobe Creative Cloud All Apps license subscriptions. The purpose is to document the basis for limiting the software requirement to Adobe products while still seeking competition among authorized vendors capable of providing the required Adobe subscriptions.
2. Requirement Description FMCS requires continuation of Adobe license subscriptions to support existing agency document, PDF, and creative software workflows. The requirement includes the following Adobe products and quantities:
Item Description SKU Qty
Adobe Acrobat Pro for Enterprise - ACROBAT
PRO SUBSCRPT DC ALL
MLP Enterprise License Subscription
65271786BB03A12 38
Adobe Creative Cloud All Apps - Creative Cloud ALL MLP License Subscription
MUN EDU NAMED USER
65297390BB03A12 3
3. Brand Name Rationale Adobe products are required to maintain continuity with FMCS existing Adobe licensing, workflows, user access, and document production processes. FMCS users currently rely on Adobe Acrobat Pro for PDF creation, editing, combining, redaction, document preparation, and related business functions. FMCS also requires Adobe Creative Cloud All Apps for users who perform creative design, publication, multimedia, and related production functions.
The requirement is for continuation of existing Adobe enterprise subscription licenses, not for a new software evaluation or migration to an alternate PDF or creative software platform. Use of alternate software would create transition risk, require compatibility review, require user retraining, and could disrupt established document and creative workflows.
4. Consideration of Alternatives Other commercial products may provide some PDF editing, document management, electronic signature, graphic design, or creative functions. However, those products would not meet the Government need for continuity of Adobe licensing, Adobe based workflows, Adobe file compatibility, Adobe Creative Cloud access, and enterprise license administration. Replacing Adobe with another product would require additional testing, workflow conversion, training, and transition support that is not part of this requirement.
5. Competition The brand name restriction is limited to the Adobe products identified above. Competition will still be sought among vendors capable of providing the required Adobe license subscriptions. Vendors must be able to provide the specified Adobe products, quantities, and applicable subscription term in accordance with the solicitation instructions.
6. Conclusion Based on the need for continuity, compatibility, and continued use of existing Adobe based workflows, Adobe Acrobat Pro for Enterprise and Adobe Creative Cloud All Apps are required to meet the Government requirement. The use of an Adobe brand name requirement is appropriate for this acquisition.
