About this file
This is a Solicitation Modification (Addenda #2) issued by the Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Traffic Operations, for a rebid of pedestal and bases for traffic control applications. The solicitation requests various components including 4.5-inch outer diameter aluminum schedule 40 poles with breakaway bases cast from 319 aluminum alloy, slip fitter assemblies, bracket systems, post tops, pedestrian detector housings, and pole foot hub plates with conduit hubs. All items must meet FHWA/KYTC MASH testing standards and specifications from manufacturers such as Component Products, Frey Manufacturing, and Pelco Products. The solicitation is organized into two groups: Group 1 (Lines 1-2) and Group 2 (Lines 3-8), with vendors required to bid all lines within a selected group to be considered for award. The deadline for written questions was June 11, 2021, at 4:00 PM, with the Commonwealth's response issued via addendum on June 15, 2021. Bids are due electronically through the Kentucky eProcurement system by June 22, 2021, at 1:30 PM Eastern Time. The tentative award date is July 8, 2021. The resulting master agreement shall be effective upon award and expire June 30, 2022, with options to extend for four additional one-year periods with written approval from both the vendor and KYTC Division of Purchases.
Bidders must submit pricing on an attached bid sheet as an electronic attachment to the eProcurement system, with specific instructions to enter $0.01 as a placeholder price online. All actual bid prices and delivery times must be clearly specified, as vague delivery terms such as "as required" or "as soon as possible" will result in non-responsive bids. The award will be based on best value using a ranking approach with price weighted at 95 points and delivery weighted at 5 points, with the lowest bidder receiving maximum points and subsequent bids scored proportionally. All manufacturing processes for steel and iron materials must occur in the United States in compliance with "Buy America" provisions under Title 23 Code of Federal Regulations 635.410, and aluminum components must be produced, milled, fabricated, and manufactured in the United States. The contract may be funded in part by the Federal Highway Administration's Emergency Relief (ER) program and is subject to federal provisions including cargo preference requirements for U.S.-flag vessels for international shipments. Pricing is firm for the first 12 months with only one price increase permitted thereafter, based on industry-wide changes and subject to 30 days' notice and justification. Delivery is expected at the earliest possible date, with late delivery penalties of one percent per day deducted from invoices for each day beyond the contracted delivery date. Bidders must register in the Commonwealth eProcurement System prior to submission and may claim resident bidder status or qualified bidder status (such as Kentucky Correctional Industries or nonprofits serving individuals with severe disabilities) if applicable, with appropriate affidavits required.

It should be noted, however, that these requested items are written around specific needs of State agencies. The Commonwealth reserves the right to consider bids non-responsive if they do not comply with the specifications contained herein.
Vendors are cautioned that changes made to the solicitation other than in the designated fields for response shall render the response invalid and result in a non-responsive bid. Otherwise, it will be considered that items offered are in strict compliance with these specifications, and the successful bidder shall be held responsible for delivering materials that meet these specifications. Any exceptions shall be marked as such within the body of the bid and explained on a separate page.
The Commonwealth is not bound to accept any exceptions.

Bids offering “equal” products/specifications will be considered for award if such products are clearly identified in the bid and are determined by the State to meet or exceed fully the minimum essential specifications and salient characteristics referenced in the Solicitation. Bids that contain products/specifications that fail to meet the minimum essential requirements shall be deemed non-responsive.
Bidders who propose alternate brands/specifications should enclose descriptive literature with their bids so that the equality can be verified. Failure to enclose sufficient literature may result in a non-responsive bid. If the brands are not changed, the contract will be written accordingly and the successful bidder shall be required
