Solicitation Summary
This is a Request for Bid (RFB 605 2100000718) issued by the Commonwealth of Kentucky, specifically the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Traffic Operations. The solicitation seeks bids for pedestals and bases, a rebid of previous solicitation that includes components such as aluminum poles, breakaway bases, brackets, and related hardware. The solicitation contains two commodity groups with multiple line items: Group 1 covers Lines 1–2 and Group 2 covers Lines 3–8, with bidders required to bid all lines within a selected group to be considered for award. The RFB was issued on June 2, 2021, with a bid closing date and time of June 22, 2021, at 1:30 PM Eastern Time. The written question deadline was June 11, 2021, at 4:00 PM, with Commonwealth responses due by June 15, 2021, at 4:00 PM. The tentative award date is July 8, 2021. The resulting contract will be a Master Agreement beginning upon award and expiring June 30, 2022, with the option for four additional one-year renewal periods subject to written approval from both the vendor and KYTC Division of Purchases and potential renegotiation of terms.
All bids must be submitted electronically through the Kentucky eProcurement system (Vendor Self Service), with bidders required to enter $0.01 and zero delivery in the system while submitting actual bid prices on the attached Bid Sheet as an attachment. Pricing is evaluated on a best-value basis with 95 points allocated to price (lowest bidder receives maximum points with subsequent bidders scored proportionally) and 5 points allocated to delivery time. The Commonwealth reserves the right to award to multiple vendors and to extend the contract up to 90 additional days beyond all renewal periods. Delivery must be F.O.B. Destination Freight Prepaid and Allowed, with shipments directed to the KYTC Division of Traffic Operations Transportation Warehouse in Frankfort, Kentucky. Price increases are not permitted during the first 12 months; only one price increase is allowed during the contract period if based on industry-wide changes and submitted with 30 days' notice and supporting documentation. Late delivery penalties of 1 percent per day apply unless delays result from factors outside vendor control. Specifications require compliance with federal Buy America provisions for manufacturing processes, MASH standards for breakaway bases, and FHWA-approved manufacturers, with all steel and aluminum components manufactured in the United States. The contract may utilize funding from the Federal Highway Administration's Emergency Relief program.

Commonwealth of Kentucky may be deemed non-responsive.
The Commonwealth of Kentucky shall not be bound by any part(s) of the bidder’s response to this solicitation that contains information, options, conditions, terms, or prices neither requested nor required in the solicitation. In the event of any conflicts between the specifications, terms and conditions indicated by the Commonwealth and those indicated by the contractor, those of the Commonwealth take precedence.
The contract supersedes all bids or other prior agreements, oral or written, and all other communications between the parties relating to this subject.
This solicitation specifies requested items. It is not the intention of this solicitation to eliminate vendors or manufacturers of similar or equal equipment of the types specified. It should be noted, however, that these requested items are written around specific needs of State agencies. Vendors are cautioned that changes made to the solicitation other than in the designated fields for response shall render the response invalid and result in a non-responsive bid. Otherwise, it will be considered that items offered are in strict compliance with these specifications, and the successful bidder shall be held responsible for delivering materials that meet these specifications. Any exceptions shall be marked as such within the body of the bid and explained on a separate page.
The Commonwealth is not bound to accept any exceptions.

Bidders may bid brands/specifications they consider to be equal by specifying the brand(s)/specifications and inserting the brand name(s), model number(s), etc. on which they are bidding. Bids offering “equal” products/specifications will be considered for award if such products are clearly identified in the bid and are determined by the State to meet or exceed fully the minimum essential specifications and salient characteristics referenced in the Solicitation. Bids that contain products/specifications that fail to meet the minimum essential requirements shall be deemed non-responsive.
Bidders who propose alternate brands/specifications should enclose descriptive literature with their bids so that the equality can be verified. Failure to enclose sufficient literature may result in a non-responsive bid. If the brands are not changed, the contract will be written accordingly and the successful bidder shall be required to deliver the brands/specifications stated in the solicitation.
Unless otherwise indicated in the bid, it is understood and agreed that any item offered or shipped on this bid shall be new and the latest or current model year and be in first class condition. Any unit failing to meet the foregoing requirements shall be returned to the contractor, at their expense, and replaced with a new unit.
