About this file

This file contains Questions and Answers for a Federal Housing Finance Agency (FHFA) solicitation for legal services. The solicitation (FHF-26-Q-0003) seeks law firms experienced in federal employment law matters, specifically for litigation support and representation before EEOC, MSPB, and federal courts. FHFA plans to award two Indefinite-Delivery, Indefinite-Quantity (IDIQ) contracts with a total maximum value of $2.6 million over five years, structured in one-year ordering periods.

Key details include the current incumbent contract with Kalijarvi, Chuzi, Newman & Fitch, P.C. (valued at $1,500,000), and an anticipated low volume of Title VII defense litigation matters (fewer than five cases per year). The contract will be predominantly labor-hour based, with task orders issued as needed. Questions are to be submitted to the Contracting Officer, Laura Baker, by 1:00 PM Eastern on January 8, 2025, with quotations due on the date specified on the Contract Opportunities webpage.

Solicitation Questions

Question #Document Name (e.g., Attachment A - Performance Work Statement, Combined Synopsis Solicitation, etc.)Document Section (e.g., Section 3 of Attachment A - Performance Work Statement, Evaluation and Selection Process Section of the Combined Synopsis Solicitation), etc.)QuestionAnswer
1Attachment A – Performance Work Statement (PWS)Background and Contract Structure / Period of Performance (IDIQ discussion)In reviewing the Performance Work Statement, the contract duration appears to allow for up to five years with one-year cycles. Can you please confirm whether the stated $2.6 million budget allocation is per year or the total value across the five-year period? The IDIQ contract(s) will have a five-year ordering period, comprised of one-year ordering periods. The total maximum value for all supplies and services across all awarded IDIQ contracts shall not exceed $2,600,000.00 over the entire life of the contract. This amount represents a ceiling value only and does not constitute a budget estimate or guarantee of work beyond the minimum guarantee of $1,000.00. Task Orders will be issued on an as-needed basis as requirements arise. Historically, work under this contract has been predominantly labor-hour.
2Attachment A – Performance Work Statement (PWS)Section 3 – Tasks (Litigation Support / Representation Before EEOC, MSPB, Federal Courts)What is the current or anticipated volume of Title VII defense litigation matters that may be delegated to the contractor under this requirement? In any given one-year period, the number of Title VII cases that may be delegated to outside counsel is typically fewer than five. FHFA anticipates the number of cases will fluctuate from year to year.
3Combined Synopsis/Solicitation (FHF-26-Q-0003)Background / Scope of RequirementHas FHFA previously contracted out this type of litigation support, and if so, at a high level, how has that engagement been structured?FHFA currently holds a five-year single-award IDIQ contract with Kalijarvi, Chuzi, Newman & Fitch, P.C. Task Orders are issued on an as-needed basis as requirements arise. Work performed under this contract has been predominantly labor-hour. The ceiling value of the single award IDIQ contract is $1,500,000.00. FHFA is recompeting this requirement as the current IDIQ is approaching its ceiling value.
