1. General: Question 1: Please confirm the incumbent contractor is Heibar Elite, LLC
Response: Yes.
2. RFP Page 4 of 38 - Activity 1- Transition-in Bullet e
Comment: Based in the Draft RFP Vape Inspection Services Q&A we understand the minor references can be removed from the paragraph. We also understand the awardee will be responsible to obtain from the incumbent contractor “all current contact information for all inspectors …currently employed by the incumbent contractor and any subcontractor(s) and all current contact information for all inspectors…who participated in an FDA inspection within the past five years while employed by the incumbent contractor, any subcontractor, or a preceding contractor.”
Question 2: Please clarify the intent of this subtask is for the incumbent contractor and any subcontractor to provide a list of all inspectors employed full-time, part-time or as a 1099 independent contractor who participated in an FDA inspection within the past five years.
Response: The intent of this subtask is for the new contractor, if applicable, to receive, store and manage the information required in the contract. The new contractor, if applicable, would need to know prior and current information in order to continue providing services to the Government. In addition, the Government requires that all inspectors be available to testify on any inspections conducted by them for five year after said inspections. Therefore, in the case of a change in provider, it would be necessary for the new contractor to retain all information needed for the Government to contact the prior inspectors.
3. RFP Page 37 of 38 - Relevant Past Performance
Question 3: We respectfully request FDA increase the number of most relevant past performance from three (3) to four (4) allowing offerors to identify up to four (4) most relevant contracts currently being performed or contracts that have been completed but performed within the last three (3) years from the issuance of this solicitation.
Response: The FDA respectfully declines the request.
