The “Coordinator” labor category title provided in the labor rate pricing chart in Section B.4 (page 2) and the labor category descriptions provided in Section C.5 (page

From the draft solicitation- the task order has been removed and offerors shall propose on the base IDIQ only.

e. and Activity

6, para. 1.

For transition-in activities, the RFP states that the Contractor shall obtain “all current contact information for all…minors currently employed by the incumbent contractor…” Similarly, transition-out activities require the Contractor to provide current contact information “for all . . . minors who participated in an FDA inspection.” The RFP does not have any other mentions of minors working on this project and the pricing table provided in Section B.4 does not provide a labor category for Offerors to bid minors.

May the government please confirm that minors will not be working on the contract awarded from this solicitation?

The government will not be using minor for these inspections. We can remove the minor’s reference from both paragraphs

Section Paragraph Question FDA Response

Evaluation Factors provide a response for both the IDIQ and the Task Order. For example, the instructions indicate that a project plan/approach must be included with Offerors technical volume, but it does not indicate if the project plan/approach should be for the overall IDIQ, specific Task Order or both. As well, the pricing table provided in Section B.4 and Attachment 1 only allow Offerors to provide hourly rates for IDIQ labor categories but do not allow for specific Task Order pricing.

portion from the pre-solicitation has been removed.

Proposal Instructions

Format

The RFP states, “Proposals shall be submitted in two separate volumes (For IDIQ and Task Order Proposal):”

This instruction is confusing.

Is the government requesting 2 separate volumes for the IDIQ and Task Order separately (4 total volumes) or 2 volumes in total with the Technical encompassing both an IDIQ and Task Order response and the Price encompassing both IDIQ and Task Order pricing?

Offerors shall only propose on the base IDIQ. The task order portion from the pre-solicitation has been removed.

L.2 Proposal

Instructions

Project Plan/Approach

At the end of the second paragraph there is a requirement for Offerors to address the special requirements listed in Section H of the RFP as part of the project plan. Section H describes the CPARS requirements and evaluation process.

Would the Government please confirm whether Section H is the correct reference for this evaluation criterion?

Reference has been updated from the draft solicitation.

Evaluation Criteria

Staffing and Commissionable

Employees (Section L);

Criteria 2 (Section M)

The Draft RFP requests offerors to identify inspectors/commissionable employees that can perform the activities in the SOW and to provide resumes and letters of commitment for each identified personnel. It is unclear, however, how many Inspectors/commissionable employees the Government is looking for offerors to provide for IDIQ purposes. Would the Government be willing to establish a sample number for consistency and Section M.

evaluation purposes?

The offeror should propose a sample number of five (5) inspectors/commissionable employees for evaluation purposes only.

Criteria

Relevant Past Performance (Section L);

Criteria 3

(Section M)

Would the Government please confirm that past performance may be from both a prime and subcontractor?

Correct, past performance from either experience will be considered.

Would the Government please confirm that the reference to Section H in this criteria description should be Attachment 2?

This section from the draft solicitation has been revised.

Discussion: Section states that “Proposals shall be submitted in two separate volumes (For IDIQ and Task Order Proposal).”

Question: Can you confirm that a separate TO SOW was not included in the draft documents?

Can you also confirm that this means Volume I and II should be submitted for the IDIQ and the TO – two separate sets of the proposal?

Only an IDIQ RFP will be issued at this time. A RFTOP may be issued at a later date.

CLAUSES BY

FULL TEXT

Discussion: FAR 52.212-5 CONTRACT TERMS AND CONDITIONS

REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--

COMMERCIAL ITEMS (DEVIATION 2013-O0019) (NOV 2017)

Question: Clause includes flow down requirements for clauses not otherwise incorporated. Are we to assume all clauses listed within (b)(1) of this clause will be incorporated into the RFP and subsequent contract?

An updated version of 52.212-5 with the appropriate clasues check will be included to the RFP.

FDA-RFP-

1190619, Page 28 / Section Volume I – Technical

Staffing and Commissionable Employees

Discussion: Section states that “FDA prefers a majority of the Inspectors conducting the compliance check inspections be dedicated on a full-time basis.”

Question: Inspectors are required to be state employees, how is the contractor expected to hire them on a full-time basis as they are already required to be employed by the state?

That means that we prefer inspectors to be full time, it is not required. They can be part time state employee and work full time for this project. The same clause says that they can use Part time employees.

FDA-RFP-

1190619, Page 28 / Section Volume I – Technical

Staffing and Commissionable Employees

Discussion: Section states that “FDA prefers a majority of the Inspectors conducting the compliance check inspections be dedicated on a full-time basis. If the Contractor utilizes part-time Inspectors, those inspectors must maintain regular performance of inspections in order to remain active on this contract. Inspectors that do not perform a minimum of 10 inspections per month will be deactivated from the program”

Question: Does the government anticipate the volume of inspections to substantiate the requirement of 10 inspections per month at each of the multiple performance locations for them to stay active?

Yes, the requirement is for the inspector to conduct at least 10 inspections during a month, it does not say that it has to be 10 in each state.
