About this file

This document presents the terms and conditions for a Master Agreement issued by the Maine Department of Transportation for the supply of Fastfill product (manufactured by FlexCrete) in 55-pound bags. The contract period runs from April 20, 2011, through April 19, 2013, with a two-year term. The contract is structured on an as-needed basis, with delivery required to six regional bridge maintenance storefronts located throughout Maine: Scarborough (Region 1), Washington (Region 2), Dixfield (Region 3), Hancock and Carmel (Region 4), and Presque Isle (Region 5), as well as to the Augusta Bridge Maintenance Division headquarters. The Director of the Division of Purchases may extend the contract beyond the stated expiration date with contractor consent.

Pricing under this contract is fixed for the entire duration with no escalation permitted, and the vendor is responsible for freight costs on a FOB delivery site basis. The State of Maine requires that vendors accept the state procurement card as a form of payment without surcharge regardless of payment method, and all invoicing must be separated by individual order and delivery location. Orders totaling $5,000 or less are submitted directly to the vendor via email, while orders exceeding this threshold require Division of Purchases approval and encumbrance. The successful bidder must also agree to extend contract pricing to political subdivisions and Maine school districts either unconditionally or with specified conditions. The contract includes a 30-day cancellation clause at the Division's discretion or immediate cancellation for non-compliance with contract terms, and all vendors must comply with Maine's chemical substance identification law requiring current Material Safety Data Sheet submission.
