About this file

This is a Commercial Item Sole Source Justification document for a Federal acquisition by the United States Marshals Service (USMS) Northern District of Texas.

The USMS is establishing a one-year maintenance contract for an air conditioning unit at the Fort Worth facility, with an anticipated period of performance from July 20, 2026, to July 19, 2027. The estimated total contract value is $2,992.50. The sole source vendor is Texas Total Comfort Systems, LLC (UEI: GHFKHJG8QLL3), an approved GSA vendor. The justification for limiting sources to a single vendor under FAR Overhaul Part 6.103-1 is based on the requirement that only one responsible source can satisfy agency requirements. The A/C unit cools the cellblock and surrounding office areas where detainees are held during transfer or court proceedings and where attorneys meet with inmates. The USMS determined that proper maintenance is critical for facility safety, detainee well-being, and court operations. The contracting officer noted that limited market research was conducted due to GSA facility access approvals already granted to Texas Total Comfort Systems, and obtaining approval for additional vendors would create operational delays. The proposed price of $2,992.50 is considered fair and reasonable based on FAR Overhaul Part 15.404-1(b)(4). The document includes certifications and approvals from the Technical Point of Contact (Annette Dominguez), Supervisory Contracting Officer (Freddie Everett), and Contracting Officer (Julie M. Simpson), with publication requirements to be fulfilled in accordance with FAR Overhaul 5.102.

Indicate Authority for Limiting Sources

FAR Overhaul Part 6.103-1 Only one responsible source and no other supplies or services will satisfy agency requirements. 41 U.S.C. 3304 (a)(2).

Requirements of the Procurement that makes it necessary to limit sources.

USMS has the responsibility to properly cool the area for prisoners to be held while in transfer or waiting on court. This space is also used for attorneys to meet with the inmates.

Should the unit not be properly maintained it creates safety concerns for the District Office, the safety of the Judiciary and Court, facility safety as well as the safety and well-being of the detainees, to include in-custody criminal and material witnesses.

Texas Total Comfort Systems, LLC, is an approved GSA vendor who can work in this facility.

Results of Market Research

Due to the approvals granted by GSA to work at this facility, limited market research was conducted. While other vendors could potentially perform this service, granting them access to the facility would take additional time, which could impact the agency as discussed above.

Actions to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services

Obtaining approval from GSA to do work in their facility could impact the agency and having maintenance available to keep this unit in working order is vital to USMS operations.

Soliciting is not advantageous to the government due to the reasons discussed above. This notice will be posted in accordance with FAR Overhaul Part 5.
