Laser Advancements for Next-generation Compact Environments (LANCE) Broad Agency Announcement (BAA)
FA9451-17-S-0008
Questions and Answers #2 31 January 2017
Q: Can the Government confirm there is no Organizational Conflict of Interest (OCI) concern or mitigation plan needed for contractors awarded contracts (Prime or Sub) under more than one SHiELD procurement? Can the Government clarify if an OCI mitigation plan is required for contractors awarded contracts (Prime or Sub) under more than one SHiELD procurement?
A: As stated in the LANCE Briefing for Industry (BFI) Questions and Answers (Q&A) dated 06 December 2016, the Government foresees no OCI constraint should one or more of the contracts under SHiELD be awarded to the same prime contractor.
The SHiELD program does however, require all awardees (prime and sub) to work together for a successful demonstration. Therefore, a potential OCI has been determined to exist due to the possibility of the contractor of this project (LANCE) accessing proprietary information of other companies during contract performance. Therefore, offerors shall provide complete information for previous or ongoing work (that is in any way associated with the contemplated acquisition), as well as a mitigation plan for any potential or actual conflicts of interest. Ref: FA9451-17-S-0008, Full Text Announcement, Section XI., Paragraph A.1.-3. on Pages 19-20.
Offerors should also refer to AFFARS 5352.209-9000 ORGANIZATIONAL CONFLICT OF INTEREST (OCT 2010)(Tailored) - ALTERNATES III AND VI on Pages 29-30 of FA9451-17-S-0008 Attch 5 – Draft Model Contract (FA9451-17-C-0008). This clause is used with Alternates III (used when the contractor will be obtaining access to proprietary information) and VI (used when it is necessary to have the restrictions of this clause included in all or some subcontracts, teaming arrangements and other agencies calling for performance of work related to this contract).
Q: Data Item A003 Technical and Cost Status Report Blk 4 Remarks state that “The contractor shall submit all Cost and Schedule related reporting under Data Item A005, Integrated Program Management Report (IPMR) from the first full accounting month under contract through delivery and acceptance of hardware under CLIN 0003” Data Item A005 Blk 14 Remarks state reports will be submitted through technical completion. Can the Government clarify if submittal of Data Item A005 is required after delivery of the hardware or through technical completion?
A:
A003 reports shall be submitted through technical completion; the cost information (which is normally included in this type of report) shall be submitted as follows:
From the first full accounting month through hardware delivery, costs and schedule related reporting shall be submitted under A005.
After hardware delivery, total contract expenditures and funds remaining shall be submitted under
A003.
A005 reports (which include more than just cost information) shall be submitted through technical completion.
Q: Several of the Contract Data Requirements Lists (CDRLs) define the schedule milestone for initial/draft submissions and the Government’s review of the documentation, but do not provide the schedule milestone for submittal of final versions. Can the Government provide the final version scheduling milestone for these data items?
A: CDRLs with only a draft date are anticipated to be living documents that will be updated as the design matures and additional information is available. The date for the final deliverable should be tied to specific program events (e.g. acceptance testing) and will be negotiated with final award; however, offerors may propose timelines for updates and final deliverables based on their laser system development strategy.
Q: In the BAA Instructions for completing the Contractor’s Statement of Work (Paragraph C.2.9
pg. 16). Bullet 2 directs the inclusion of the ACA statement from BAA Section VI.D. Can the Government clarify the specific wording required from BAA Section VI. D to be included in the
CSOW?
A: All of section VI.D. as stated (including the table) needs to be included.
Q: Are Contractors allowed to establish Non Disclosure Agreements (NDAs) with the Non- Government advisors prior to their evaluation of the Proposals?
A: If the offeror requests an NDA to be completed, the Non-Government Advisor will not have access to the proposal until the NDA is in place. The Government will facilitate completion of any required NDAs.
Q: Can Government supply latest versions of RDOI 61-103, AFRLI 61-103 and AFI AFMC SUP1 62- 601?
A: These documents are available at http://www.e-publishing.af.mil/.
