CLIN 00131.3.1 Off Base Disposal/CLIN 0013 “The Contractor shall be responsible for any permit or fees associated with the use of off‐base disposal locations and shall separately invoice the tipping fees to appropriate CLIN for payment.”. a) Please confirm whether or not the government will reimburse the actual disposal costs incurred regardless of the Unit Price the contractor bids on. For example, if the contractor collects 150 tons during a given month and the disposal facility charges are $15,000 for that month, the government would reimburse the contractor $15,000.00 regardless of the Unit Price amount the contractor bid for CLIN 0013 for tipping fees. B) If this is correct, then it seems that the Unit Price for this Line Item for all years should be factored out or extended by the government for price evaluation purposes. This would avoid a contractor entering an unrealistically low price for the line item, to keep their price down, when the government would still be required to reimburse the contractor based upon the submitted disposal invoice. There have been numerous contractors in this space over the past several years who try to “game the system” by doing this exact thing. They bid a low tonnage amount on the bid sheet , and then submit the actual, higher priced invoices for reimbursement after contract award. In order to combat, the Government has been utilizing Not To Exceed amounts for the disposal CLINs for each year so that this Line Item will not be manipulated for price evaluation purposes. If this is incorrect, please state so and explain how the contractor should bid this.
This will be a firm‐fixed price (FFP) contract, which is not subject to adjustment, per FAR 16.202‐1. The contractor will only be able to invoice and be paid for the FFP amount per ton, as indicated on CLIN X013 in Attachment 7 ‐ Pricing Schedule. The estimated quantity of 1940 tons per year for CLIN X013 is based on historical data. Vendors should use their best business judgment to develop a FFP amount per ton across the life of the contract.

Attachment 4; Q&A Submission 1 (Answer 4)
The US economy is very turbulent to say the least. What if New Mexico implements a massive increase of say 2 to 3% to the NMGRT, or worse case 10%. How can the contractor just absorb that %, there is no way to plan for that? We need some sort of assurances that the Government would do the right thing at some % threshold and assist the contractor. Please advise
