PERFORMANCE WORK STATEMENT
FOR
MANAGEMENT, CULTURAL SITES, NATIVE AMERICAN GRAVES
AT
VANDENBERG AIR FORCE BASE, CALIFORNIA

PART A - GENERAL REQUIREMENTS
In carrying out work assignment(s) issued under this contract, the Contractor shall furnish the personnel, services, equipment, tools, materials, vehicles, facilities supervision, and other requirements necessary for, or incidental to, the performance of work set forth herein; assure any and all program and/or project related costing information (regardless of its stage in development) is secured, as directed by the Contracting Officer (CO); and be responsible for safeguarding proprietary, and other sensitive information. The Contractor shall be immediately capable of addressing and interpreting all aspects of environmental law and regulation.
| 1.0 | Scope |
| 1.1 | Introduction |
This Performance Work Statement (PWS) defines the scope of environmental operations and services activities necessary to meet Air Force requirements to manage cultural resources at its installations.
Specifically, this PWS encompasses the full range of methods, technologies, and supporting activities necessary to support Air Force management of cultural resources sites at Vandenberg AFB (VAFB).
In the interest of attaining full compliance with the Native American Graves Protection and Repatriation Act of 1990 (NAGPRA), the 30th Space Wing at VAFB proposes to supplement its NAGPRA files and data management systems using existing and new data for the purposes of improving cultural resources management practices at NAGPRA-related sites at the base. The contractor shall assume that 35 prehistoric archaeological sites are included in this scope of work; this includes one re-interment site.
This contract shall help VAFB meet its federal agency responsibilities pursuant to the Native American Graves Protection and Repatriation Act of 1990, the Archaeological Resources Protection Act of 1970, Air Force Instruction 32-7065, the VAFB Integrated Cultural Resources Management Plan (ICRMP), and the NAGPRA Memorandum of Understanding between VAFB and the Santa Ynez Band of Chumash Indians and the Tribal Elders Council dated 2007.
1.2 Policy and Requirement Statements
It is the policy of the Air Force to use innovative and sustainable approaches to environmental management and technology to accomplish its mission. Sustainable projects do not deplete resources, cause environmental degradation, or impact to human health and may reduce the burden of compliance for the Air Force. Mission requirements are met while also balancing cost and environmental responsibility. The Contractor shall incorporate pollution prevention and sustainability initiatives into all aspects of this contract.
The Contractor shall function as an integral team member in support of the Air Force Civil Engineer Center (AFCEC) mission to include sharing of information with other AFCEC contractors, and cooperation with communities, regulators, and other government entities.
Requirements include efficient management of this contract including, but not limited to, the submission of accurate, on-time, quality contract deliverables and timely identification and solution of impediments to successful project execution. Technical requirements include, but are not limited to, early involvement in the process to allow for the development of the most cost-effective and technically sound approach or solution. The AFCEC will rely on the Contractor’s expertise in recognizing and addressing problematic issues and successful execution of this contract. The Contractor shall perform all work in accordance with federal, State of California, and local statutes and regulations. Remedies shall conform to environmental permits, decision document requirements, and other legal requirements.
2.0 APPLICABLE DOCUMENTS
The Contractor shall identify and comply with all applicable federal, State of California, and local statutes; Air Force/Military instructions, manuals, handbooks, regulations, guidance, and policy letters; and Executive Orders (EOs), including all changes and amendments in effect on the date of issuance of this contract.
The Contractor shall also utilize the following base-specific document:
· NAGPRA Memorandum of Understanding between VAFB and the Santa Ynez Band of Chumash Indians and the Tribal Elders Council, dated 2007.
Tasks under this PWS include completion of California Department of Parks and Recreation (DPR) Form 523, which can be found on the agency web site.
The Contractor shall be responsible for identifying and complying with all applicable requirements as they pertain to the project requirements.
3.0 ADMINISTRATIVE AND MANAGERIAL REQUIREMENTS
The Contractor shall perform management and planning functions, as well as performance measurement and cost status reporting during the course of this effort.
3.1 Coordination with Other Government Offices
The Contractor shall be responsible for day-to-day interface with other government work offices to include, but not limited to, civil engineering, transportation, communications, legal, operations, security forces, safety and public affairs. Topics for interface include, but are not limited to environmental restoration.
3.2 Regulatory Interface
Interactions with regulatory agencies are not expected to occur during performance of tasks under this PWS.
The Contractor is not an employee of the government and shall not represent the government in an official or unofficial capacity without the express prior written permission from the CO. In the event that any regulatory representative approaches the Contractor with a stated intent to inspect the activities of the Contractor without the previous direction of the CO, the Contractor shall respectfully decline the inspection until the CO is properly notified and a duly appointed Contracting Officer Representative (COR) is present or other direction is issued by the CO. If this is not possible, due to project constraints, the Contractor shall notify the CO, COR, and base point of contact (POC) at the earliest possible time following the inspection.
3.3 Coordination with Other Contractors
The Contractor shall cooperate fully with other contractors and government employees. The Contractor shall not commit any act that will interfere with the performance of work by any other Contractor or government employee. The CO will resolve work schedule conflicts between this contract and other contracts. The CO will provide written direction to the Contractor to reschedule work when required.
| 3.4 | Special Notification |
| 3.4.1 | Health Risks |
The Contractor shall immediately report to the CO and the COR, verbal telephone or e-mail notification pursuant to this contract, any issues or incidents which may indicate potential imminent risk to contracted, federal, or local personnel, the public at large, or the environment. Following the verbal or e-mail notification, a written notice with supporting documentation, to include photographic documentation whenever appropriate, shall be prepared and delivered within three (3) working days to the CO. (Contract Data Requirement List [CDRL] A001)
3.4.2 Identification and Change of Critical Contractor Personnel The Contractor shall submit an organizational chart displaying key personnel involved in the effort and their respective labor categories. The Contractor shall immediately notify the CO and COR, in writing or email, of any changes in critical Contractor personnel. The Contractor shall obtain CO and COR approval of any proposed changes in project personnel along with the steps taken/proposed to ensure there are no impacts to the schedule or costs associated with this contract. The Contractor shall identify to the CO and COR all subcontractors to be used under this contract, issued pursuant to this PWS, prior to signing any subcontract or initiating any work. The Contractor shall provide subcontractor qualifications to the CO and COR prior to subcontractor utilization. (CDRL A002)
| 3.5 | Work Site Requirements |
| 3.5.1 | Safety Requirements |
Contractor personnel working on VAFB must attend annual awareness training for unexploded ordnance (UXO). This on-site training is typically offered weekly and lasts about 30 minutes.
The Contractor shall be responsible for protecting the lives and health of employees and other persons on the work site; preventing damage to property, materials, supplies, and equipment; avoiding work interruptions; and complying with Occupational Safety and Health Administration (OSHA) regulations and installation safety office requirements regulations and installation safety office requirements. The Contractor shall perform all operations in a prudent, conscientious, safe and professional manner and conform to the safety requirements contained in the contract. The Contractor shall maintain training records on site and have written Health and Safety Plans (HSPs) on site and available for workers and/or regulatory review. The Contractor shall provide the CO copies of any OSHA Report(s) regarding a project site, submitted during the duration of this contract. (CDRL A003) The Contractor shall record and report promptly (within one [1] hour) by telephone or other direct means to the CO or COR, the installation POC, and to the military installation’s Safety Office all available facts relating to each instance of damage to Government property or injury to a person. In the event of an accident/mishap, the Contractor shall take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, preserve evidence until released by the accident/mishap investigative authority through the CO, and immediately report the incident to the Fire Department at 911. If the government elects to conduct an investigation of the accident/mishap, the Contractor shall cooperate fully and assist government personnel in the conduct of an investigation until said investigation is completed. The Contractor agrees that his personnel and equipment are subject to safety inspections by government personnel while on federal property.
3.5.2 Minimize Impacts to Existing Operations
Most work under this PWS will be performed at locations other than VAFB, but interactions with the VAFB Cultural Resources staff are required to obtain the necessary data and information. The Contractor shall schedule any site visits or field survey operations with installation personnel at least two weeks ahead to allow base personnel to adjust their calendars. Frequent communication and coordination with installation personnel shall be necessary to accomplish project goals.
3.5.3 Site Access Badges
Provide employee names to the COR at least two weeks prior to desired initial visit to allow sufficient time for processing base pass paperwork.
The Contractor shall verify that identification credentials presented by all Contractor and subcontractor employees to obtain security badges, passes, cards, or decals used during the duration of this contract are current and correct. As a minimum, verification should be conducted with the Social Security Administration (http://www.ssa.gov/employer/ssnv.htm), the FBI Criminal Justice Information Services, Identification & Investigative Services Section (304-625-5590) and the Form I-9 Employment Eligibility Verification (http://www.uscis.gov/portal/site/uscis). The Contractor shall monitor its employees to ensure all information remains current and to ensure all security badges or passes are returned to the base POC upon expiration of the badge, upon completion of the project, or when possession of the badge is no longer authorized (e.g., upon removal of contracted personnel from specific projects).
3.5.4 Key Control
Issuance of keys for access to locked facilities or gated areas is not expected under this PWS.
The Contractor shall establish and implement methods of ensuring that all keys issued to the Contractor by the government are not lost or misplaced and are not used by unauthorized persons. Keys issued shall not be duplicated. The Contractor shall limit access to locked areas to Contractor’s employees only.
The Contractor shall report the occurrences of a lost key to the CO or COR and installation POC as soon as known. The Contractor shall be required, upon direction of the CO, to re-key or replace the affected lock(s). However, the government, at its option, may replace the affected lock(s) or perform the re-keying itself.
4.0 MANAGEMENT, PLANNING, AND REPORTING REQUIREMENTS
The Contractor shall plan project activities including the development, implementation, and maintenance of project schedules, events, status of resources, report(s) on the activities and progress toward accomplishing project objectives, and document for Government review and approval the results of the project efforts for this contract.
4.1 Post Award Meeting/Teleconference
After the issuance of this contract, the Contractor shall schedule and conduct a post-award teleconference. The purpose of the meeting shall be to become familiar with the work requirements, information, and/or site-specific data addressed under this contract. The Contractor shall participate in and/or facilitate a meeting by teleconference to develop plans and alternatives as a working initiative to proceed/formulate the work required by this contract. The contractor shall prepare and submit an agenda, meeting minutes, and applicable presentation materials for all meetings attended. (CDRLs B001, B002, B003)
4.2 Progress Meetings
No progress meetings are required other than initial kick off meeting and submission of Draft Report.
4.3 Presentation Materials
The Contractor shall prepare and present briefing packages at meetings coordinated by the government. As part of the presentation materials, the Contractor shall prepare paper copies of all slides and overheads. (CDRL B003)
4.4 Work Breakdown Structure
The Contractor shall use the Work Breakdown Structure (WBS) to prepare proposals, project schedules, and financial report(s). (CDRL B004)
4.5 Project Planning Chart
The Contractor shall prepare and submit a Project Planning Chart (PPC) for approval. The PPC shall detail the project schedule and status through the use of Gantt charts, which shall depict percentage complete for each task. (CDRL B005)
4.6 Contractor’s Progress, Status, and Management Report
The Contractor shall prepare and submit a quarterly Contractor’s Progress, Status, and Management Report (CPSMR). The CPSMR shall be used to review and evaluate the overall progress of the project, along with any existing or potential problem areas. The CPSMR shall include a summary of the events that occurred during the reporting period, discussion of performance, identification of problems, proposed solutions, corrective actions taken, and outstanding issues. The CPSMR shall also include project schedule status and cost information. (CDRL B006)

| 4.7.1 | Work Plan |
The Contractor shall prepare and submit an abbreviated Project Activities Work Plan (WP) describing the Contractor’s plan to implement the work required in this contract. (CDRL A004)
4.7.2 Health and Safety Plan
The Contractor shall prepare and submit an abbreviated HSP, as an appendix to the WP, to comply with Air Force, OSHA, USEPA, State of California, and local health and safety regulations regarding the proposed work effort. The Contractor shall utilize to the fullest extent possible any existing related HSP, tailored to the current effort. The Contractor shall use USEPA guidelines for designating the appropriate levels of protection needed at the study site(s) as applicable. The Contractor shall maintain written certification that the approved HSP has been reviewed with all personnel that work at the project site prior to their mobilization. (CDRL A005)
4.8 Quality Control Program
The Contractor shall organize, document, prepare procedures for, and implement a management-driven system to provide maximum assurance that products and services conform to specified requirements. Products and services submitted in the performance of this contract shall be according to the American National Standard Institute (ANSI)/American Society for Quality (ASQ) standards if applicable, or Best Commercial Practice, and contract requirements. All work accomplished by the Contractor shall be of sufficient quality and level of acceptance by the Air Force, as well as federal, State of California, and local regulators.
4.9 Hazardous Materials
In the event the Contractor purchases a product that meets the tracking requirements of the Emergency Planning and Community Right-to-Know Act (EPCRA), or its state or local equivalent, or any hazardous material, the Contractor shall provide the appropriate installation office and the COR with any details required by them to accomplish tracking as soon as the acquired products are brought onto a government installation.
4.10 Pollution Prevention
The Contractor shall conduct all operations and activities with the intent of reducing the amount of energy used and pollution generated. Specific areas to be focused on are generation of solid waste, use of hazardous materials, use of ozone depleting chemicals, generation of hazardous waste, and use of energy and water.
PART B - PERFORMANCE WORK STATEMENT FOR OPERATIONS & SERVICES
5.0 INTRODUCTION
The Contractor shall provide services, support, and assistance in areas required to meet the stated objectives and to accomplish the work required under this PWS.
5.1 Continuation of Essential DoD Contractor Services During Crisis The performance of these services is not expected to be mission essential during time of crisis. Should a crisis be declared, the CO or his/her representative will verbally advise the Contractor of the revised requirements, followed by written directions.
5.2 NAGPRA Support
In cooperation with the VAFB Cultural Resources Office, the Contractor shall perform the following tasks within a 12-month period of performance.
Task 1a: Obtain Copies of Existing Records and Data for Sites with NAGPRA items Task 1b: Update/develop a comprehensive list of sites that include NAGPRA items
Task 2a: Develop a California Department of Parks and Recreation (DPR) Form 523-style summary NAGPRA form that can be included in a site file Task 2b: Populate one form for each site with NAGPRA items
Task 3a: Survey National NAGPRA Online Databases, determine which ones need VAFB data Task 3b: Enter VAFB data into National NAGPRA Online Databases as appropriate
Task 4a: Develop a GIS point layer and attribute table for sites with NAGPRA items Task 4b: Populate attribute table with data largely derived from DPR 523-style form from Task 2
Task 5a: Survey at least 5 existing award winning/highly regarded NAGPRA MOUs Task 5b: Develop draft NAGPRA MOU between VAFB & Santa Ynez Band of Chumash Indians
Task 6: Write a summary report describing work performed for this PWS that includes all final versions or final drafts of the materials that were developed for this PWS. (CDRL A006)
Special Conditions
· VAFB will provide relevant archaeological information as requested by the contractor
· All deliverables are the property of VAFB. All materials gathered and/or developed in the performance of these tasks listed shall be returned to and become property of VAFB, and shall not be used and/or distributed by the contractor without specific written permission from VAFB;
· All documents, including photographs and maps, shall be dated. Final electronic deliverables are to be in MS Word and Adobe Acrobat unless otherwise specified.
· The contractor shall not give any news releases or conduct media interviews concerning the work performed or results thereof. All information for public release will be released by the installation Public Affairs Office (PAO). All requests for information, including freedom of information act, shall be directed to the 30 CES/CEIOEA Project Manager.

7.4 Contractor Manpower Reporting Requirements
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the AF via a secure data collection site. The contractor is required to completely fill in all required data fields at http://www.ecmra.mil.
Reporting inputs will be for labor executed during the period of performance for each government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the Contractor Manpower Reporting Application (CMRA) help desk.
Uses and Safeguarding of Information: Information from the secure web site is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.
User Manuals: Data for AF service requirements must be input at the AF CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link at http://www.ecmra.mil.
