This is a 100% small business set-aside for NAICS code 339999 with a size standard of 500 employees. The non-manufacturer rule and limitations on subcontracting will apply at the order level.

S SOW 11 Figure 10.1 The current illustration does not include coordination between the Primes and the OEMs. Suggest arrows be inserted that flow both ways between the MAC Prime and the MAC OEM for both R&R Reporting and R&R Coordination
The Government will not have privity of contract with the OEMs; the reporting mechanisms and coordination requirements will need to be agreed upon between the MAC Primes and the OEMs as required in order to fulfill the requirements of the SOW.
S SOW 12 11.1 Responsibilities for Warranty processing is not specifically addressed
Section 10.1 Warranty Repair and Return states: The Contractor shall coordinate with the OEM and/or report the status of warranty repair items as illustrated in Figure 10.1. There are no non-warranty repair and return requirements included in the SOW; there are no non-warranty repair or return CLINS in the model contract. See Amendment 01. SOW Figure 10.1 cross-reference is added to SOW Section 11.2.

S Sec L 5 3.2.3 Is the Government requesting a narrative on our full export control process or a singular example of ITAR compliance?
Section L 3.2.3 states: "The Offeror shall provide a narrative that describes the necessary steps to accomplish OCONUS shipping of an item with ITAR restrictions. The narrative shall describe corporate processes to ensure ITAR violations do not occur..." The Offeror would need to discuss the corporate processes in describing the steps to accomplish OCONUS shipping for an item with ITAR restrictions.

S SOW 2 1 Will goods and/or services made or provided by a company owned in full or in part by a prime contractor on the MAC contract be allowed to be sold on the MAC contract.
At this time the Government is not restricting MAC Primes from quoting supplies/services manufactured by a company owned in whole or in part by a MAC Prime in response to a fair opportunity request for quote/proposal.
Requirements will be solicited in terms of performance, functional, and physical specifications. If a particular item/service is required then the Government will prepare a brand name/sole-source J&A and will also determine what contract vehicle is most appropriate for the acquisition of those particular supplies/services.
S SOW 4 4.2 Is the Government going to allow MAC Contract Holders to also be an SE&I or ICP Prime?
Refer to Model Contract Clause 5352.209-9000 Organizational Conflict of Interest, Alt V, paragraph (b), and 5352.209-9001 Potential Organizational Conflict of Interest. If the SE&I Prime or Sub is also a MAC Prime; then it will be excluded from participating in MAC delivery orders that provide a solution that is developed/produced/identified by the SE&I contract. The potential OCI created by the ICP and MAC relationship may be mitigated; an OCI mitigation plan would need to be submitted for Government review and approval; the requirement to submit an OCI mitigation plan is dependent on the timing of the MAC and ICP awards.
S Sec M 1 1.1 Will specific NAICS codes be provided per FORQ/P to determine if there is a class waiver of the Non-Manufacturer's Rule for the items being requested?

RFP Previously, on FBO the Government stated that it was seeking a small business waiver for this solicitation. Has there been any update to that status of that waiver request or is it still pending? If it is still pending, does the Government have any indication whether the waiver request will be successful?
The Government requested a blanket waiver to the NMR; however, the request was disapproved. If, and when necessary during contract performance, the Government will seek a NMR waiver at the order-level.

2 2.2 3,4 Can the government please clarify if an 11x17 page is equivalent to one (1) page or two (2) pages?
See Amendment 01. Clarifying language has been added to Section 2.2.
Each face of an 11 x 17 sheet of paper containing information will be treated as two pages. If both faces contain information, the sheet will be treated as four pages.

Both Government and Non-Government personnel have signed NDAs. Refer to Section L Section 2.9.

2 1.0 7-May Can the government please clarify if there will be a contingency plan if SW SE&I and SW ICP contracts are protested/delayed?
No; the SW-MAC can stand alone.
