CDRL GENERAL NOTES/INSTRUCTIONS

1. SCOPE: This Contract Data Requirements List (CDRL) establishes the data to be delivered by the Contractor and the submittal, approval and distribution requirements of all the CDRL data items contained herein. The Contractor shall utilize best commercial practices and the guidance referenced in paragraph 12 of these general notes/instructions in meeting the requirements of this CDRL.

2. GENERAL: The Data Item Description (DID) specified in the CDRL is in the Acquisition Streamlining and Standardization Information System (ASSIST) database.

3. TAILORED DATA ITEMS: A slash (/) and the letter "T" (e.g., DI-ILSS-80569/T) added to the DID number in Block 4 of the CDRL (DD Form 1423-1) denotes that the DID has been tailored to comply with specific system requirements. The tailoring instructions are listed in Block 16 of each affected DD Form 1423-1.

4. MODIFICATION OF DATA REQUIREMENTS:

a. From time to time during the performance of this contract, the Procuring Contracting Officer (PCO) may, unilaterally, change the place of delivery and the technical office for any line item of contract Exhibit A (DD Form 1423-1) hereto, at no change in contract price, notwithstanding the provision of the clause of Section I entitled “Changes.” If there is a change in the place of delivery the Contractor and the PCO may mutually agree to an extension of the data submittal requirement date.

b. From time to time during the performance of this contract, the PCO may, unilaterally, increase or decrease the number of addresses and/or increase or decrease the number of paper copy deliverables (regular or reproducible) specified for any data item of the CDRL hereto, at no change in price provided that the increase in the total number of paper copies (regular or reproducible) for an individual line item of data shall not be greater than one hundred-fifty percent (150%) of the total number of paper copies (regular or reproducible) initially specified in the CDRL nor shall the decrease in the total number of paper copies (regular or reproducible) for an individual item of data be greater than fifty percent (50%) of the total number of paper copies (regular or reproducible) initially specified in the CDRL. In the event of an increase greater than such 150% or of a decrease greater than fifty percent (50%), the parties will negotiate any equitable adjustments in accordance with the procedures of the “Changes” clause. The Contractor shall provide electronic access to all CDRL deliveries without any limitation on number of users.

c. From time to time during the performance of this contract, the PCO may, unilaterally, make other administrative and clarification changes to the CDRL hereto, and the contract price will constitute full satisfaction of any entitlement of equitable adjustment under the “Changes” clause provided the Contractor agrees to accept such change at no change in contract price.

FA8625-16-C-6599

d. Unilateral actions pursuant to (a), and (b) above shall be by the issuance of

PCO Letter (PCOL) followed by a Supplemental Agreement to this contract, which will reference this clause as its authority. Any action directed by this clause shall be effected by the Contractor beginning with the first submission of the particular data item or items after receipt by the Contractor and PCO’s direction.

5. DATA SUBMITTAL APPROVALS: The following definitions apply to Block 8 of the DD Form 1423-1:

a. The use of an "A" in Block 8 indicates that Government approval of the identified document is required to assure that the Contractor is sufficiently prepared to proceed to the next phase of the contract in addition to verifying compliance with the DID and CDRL requirements and requires advance written approval prior to preparation and publication of the final document. Unless otherwise specified on the DD Form 1423-1, the Office of Primary Responsibility (OPR) noted in block 6 will review the data submitted for approval and the PCO (AFLCMC/WLJC) will notify the Contractor of approval/disapproval or corrective action required within forty-five (45) calendar days after receipt of data submittal. If the program office is not able to respond within forty-five (45) calendar days, the Contractor will be notified and a new mutually agreed upon suspense date will be established. If the program office has not provided approval/disapproval/intent to extend due date within forty-five (45) calendar days, the data will be considered automatically approved. However, the Contractor shall notify the program office via telecon or fax prior to assuming approval.

b. If Block 8 has an “N/A” these data items are considered non-approval, however this does not relieve the Contractor of the responsibility of compliance with applicable regulations, standards, procedures, etc. All data submissions are subject to review and approval by the procuring agency for departure from said compliance. Block 8, left blank, does not require a draft submission in advance of the final document unless otherwise specified on the DD Form 1423-1. The presence or absence of an “A” in Block 8 does not relieve the Contractor of the responsibility of full contractual compliance and all data will be subject to review and acceptance by the Government.

c. The PAR program office will formally respond to the Contractor within forty-five (45) calendar days after receipt of any data that is technically disapproved. Data submittal requirements shall not be considered to have been met until the procuring agency has determined that all contractual requirements have been met regarding the identified data.

6. REVISIONS TO DATA SUBMITTALS AND RESUBMITTALS OF DATA:

a. Unless otherwise specified, data submittals that are disapproved by the Government, shall be revised and resubmitted by the Contractor within thirty (30) calendar days after receipt of PCOL. If the Contractor cannot resubmit within thirty (30) calendar days, the PAR Data Manager shall be notified within fifteen (15) calendar days and a new mutually agreed upon suspense date will be established.

b. Data submittals that are approved contingent upon revision shall be revised and distributed within thirty (30) calendar days after receipt of PCOL, or as specified in the

FA8625-16-C-6599

delivery requirements of the applicable DD Form 1423-1. If the Contractor cannot resubmit within the required time, the PAR Data Manager shall be notified within fifteen (15) calendar days and a new mutually agreed upon suspense date will be established. Final distribution shall be accomplished within thirty (30) calendar days after receipt of approval or completion of corrective action constituting approval.

7. DATA PREPARATION:

a. Data submitted by the Contractor shall conform to the quality requirements specified on the CDRL for each data item. If the data preparation instructions contained in Block 16 of the DD Form 1423-1 are different from the instructions contained in the DID, the DD Form 1423-1 instructions shall have precedence.

The Government will request from the Contractor, by PCO Letter, submittal of revision(s) to a final data delivery. If the Contractor identifies the need for a revision to a final data delivery, the Contractor shall request from the Government, by contracting letter, approval to proceed with submittal of revised data.

9. DOCUMENTATION MARKING: DoD Directive 5230.24, Distribution Statements on Technical Documents, provides policy and guidance on marking documents.

Air Force Instruction (AFI) 61-204, Disseminating Scientific and Technical Information, specifies certain distribution statements to be used on data to control distribution by government agencies such as the Defense Technical Information Center (DTIC).

a. Distribution Statements: Block 9 of the DD Form 1423-1 annotates the relevant distribution statement applicable to the data to be submitted. This distribution statement shall have precedence over other technical documentation on this contract, unless otherwise specified by the PAR program office.

b. Export-Controlled Warning Statement: In addition to the distribution statement annotated in Block 9 of the DD Form 1423-1, the following warning statement shall also apply on all technical data on this contract:

“WARNING” - This document contains technical data whose export is restricted by the Arms Export Control Act (Title 22, USC, Sec 2751, et seq.) or the Export Administration Act of 1979, as amended, Title 50, USC, App 2401, et seq. Violations of these export laws are subject to severe criminal penalties. Dissemination in accordance with provisions of DoD Directive 5230.25.

When it is not technically feasible to use the entire statement, an abbreviated marking may be used, and a copy of the full statement added to the “Notice to Accompany Release of Export- Controlled Data” required by DoD Directive 5230.25.

c. Contractor Imposed Distribution Statements. Part 35, of the Federal Acquisition Regulations (FAR) stipulates control procedures for contractor controlled technical information in which the government has limited rights. These procedures shall be followed as described in AFI 61-204, Disseminating Scientific and Technical Information.

d. DESTRUCTION NOTICE – For classified documents, mark documents with the following statement “Destruction Notice - Follow the procedures in DoD 5220.22-M, National Industrial Security Program Operating Manual (NISPOM), Section 5-705, or DoD 5200.1-R, Information Security Program Regulation, Chapter VI.” For unclassified, limited documents, (i.e., not approved for public release) mark documents with the following statement “DESTRUCTION NOTICE – Destroy by any method that will prevent disclosure of contents or reconstruction of the document.”

e. The contractor is responsible for ensuring adequate marking and security measures are in place to prevent unauthorized access to electronic data. The contractor is not authorized to provide copies of any data on the CDRL to activities who are not specifically identified in the distribution block of the CDRL without written government approval from the AFLCMC/WLJ program office.

FA8625-16-C-6599

10. METHOD OF TRANSMITTAL:

a. In addition to DD Form 250 Material Inspection and Receiving Report requirements (where applicable), all data submittals shall be accompanied by a letter of transmittal and the Government shall acknowledge receipt and acceptance, where Government approval is required. All deliverables shall be directed to the OPR listed in Block 6 of the DD Form 1423-1 regardless of the method of data submission (i.e., paper copy, CD ROM/DVD, on-line access, e-mail message, provided at a review, etc.) The letter of transmittal shall include as a minimum: reference to the contract number, program name, data item number, title, CDRL sequence number, revision level, any Contractor's control number assigned to that data, and the method of submittal.
