(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 1 July 2010 through 30 June 2011.
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the
Schedule.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

PKJ L CLAUSES
PKJ L001 - GENERAL INFORMATION (88 CONS/PKJ)
1. Point of Contact. The Buyer listed in Block 9A, page 1 of this solicitation is the sole point of contact for this acquisition. Address any questions or concerns you may have to that person. Written requests for clarification may be sent to the address located in Block 7 of the SF 1442.
2. Debriefings. The Contracting Officer (CO) will promptly notify Offerors of any decision to exclude them from the competitive range, whereupon they may request and receive a debriefing in accordance with FAR 15.505.
The CO will notify unsuccessful Offerors in the competitive range of the source selection decision in accordance with
FAR 15.506. Upon such notification, unsuccessful Offerors may request and receive a debriefing. Offerors desiring debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.
3. Discrepancies. If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the buyer in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
4. Mandatory Submission. The offeror shall submit a paper copy of the SF 1442, front and back, including the proposed amount in block 17, the appropriate original signatures, and acknowledgement of all amendments as required, along with Section B through Section M and reference information. Original paper Bid Bonds with appropriate signatures and raised corporate seals shall be submitted. Proposals that do not comply with the above requirements may be considered non-responsive to the solicitation.
5. Subcontracting Plan Submission. Large businesses whose proposal exceeds $1,000,000.00 shall submit a subcontracting plan with their proposal. The following information is provided as the minimum acceptable agency goals:
a. Small Business = 23%
b. Small Disadvantaged Business = 5%
c. Woman-Owned Small Business = 5%
d. Veteran-Owned Small Business = 3%
e. Service Disabled Veteran-Owned Small Business = 3%
f. HUBZone = 3%
Proposals that do not meet the minimum requirements as stated above may be considered non-responsive to the solicitation.

PKJ L002 ALT I – PROPOSAL PREPARATION INSTRUCTIONS
A. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate parts, Part I – Technical
Qualifications, Part II – Price Proposal, and Part III – Past Performance Information.
B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer’s opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; Offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
C. Specific Instructions:
1. PART I – TECHNICAL PROPOSAL – Limited to no more than twenty (20) pages for
Factors (a) and (b) and no more than fifty (50) pages for Factor (c). Submit original plus one (1) copy.
(a) Sub Factor – Certifications: Provide documentation showing current certifications to install and perform warranty repairs for the following roofing systems: “Butler”, “MBCI”, and “Zip Rib” metal roofing systems; “Johns Manville”, “Suprema”, “GAF”, “Firestone”, and “TAMKO” built-up roofing systems; “Firestone” and “Carlisle” rubber systems.
(b) Sub Factor – Qualifications: Provide the qualifications of the firm and the key personnel to perform the work included in this solicitation. The statement of qualifications for the firm shall include the firm’s legal name and business address, year the firm was established, name and address of the parent company (if any), principal officers of the firm, and any other information considered relevant to establishing the firm’s qualifications. Key personnel required to provide statements of qualifications are the firm’s owner or chief executive officer (CEO), the individual who will be assigned as the project manager and work leaders/foremen responsible for this effort. The statement of qualifications for these individuals should include the name of the individual and their title, their assignment on this project, years of experience with this firm and their previous firms.
(c) Sub Factor – Management Plan: Provide a management plan that addresses the following:
1. How the firm will rotate and distribute their work crews among multiple open projects, including the firm’s current equipment and vehicles in order to be able to meet the following on-call requirements:
a. Emergency Service Calls - Respond within 2 hours of notification, stay on the job until the problem is corrected.
b. Urgent Service Calls - Respond within 24 hours, correct the problem within 5 days of original notification.
c. Routine Service Calls - Respond within 72 hours, correct the problem within 5 days of original notification.
2. How the firm will manage five (5) major roofing projects which would run concurrently at different Wright-
Patterson AFB locations; and how the firm would mobilize to handle several emergency responses simultaneously.
3. Where the local office will be located/or pre-qualified subcontractors within Dayton, OH area (as defined in this solicitation) as well as a mobilization plan from these locations.
(d) Sub factor – Quality Control Plan: Provide a quality control plan that Illustrates an adequate inspection system and inspection plan to ensure contract compliance. One that requires contractor to maintain inspection records and make them available to the Government and allows [but does not require or obligate] the
Government to do its own tests and inspections.
2. PART II – PRICE PROPOSAL – Submit original and one (1) copy
(a) Complete blocks 14 through 20 of the RFP Section A, SF 1442. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These sections constitute the model contract.
(b) Insert proposed unit and extended prices in Section B for each Contract Line Item Number (CLIN), including all option periods.
(1) Offerors are to provide a unit cost and total cost for each line item on the Price
List, Exhibit 1. The total cost column on the Price List will be added together for all line items to create an overall total cost for each performance period (Base Year, Option Year 1 and Option Year 2). The overall total cost will be moved from the Price List to its respective CLIN in Section B.
(2) All Price List line items are to be completed. If not, this may make the offeror non-responsive.
(c) Complete the necessary fill-ins and certifications in Sections I through K. Section K shall be returned in its entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in. Also complete bid schedule fill-ins (Exhibit 1.)
(d) If FAR 52.204-8 is included in RFP Section K, the offeror shall go to the ORCA website at https://orca.bpn.gov/ and complete the certifications and representations.
(e) If applicable, provide a letter from the Small Business Administration (SBA) showing proof of Section
8(a) or HUBZone status.
3. PART III – PAST PERFORMANCE INFORMATION – Limited to no more than one (1) page per contract listed. Only references for same or similar type project desired. Submit original plus one (1) copy.
(a) Offerors shall submit information on contracts they consider relevant (in terms of scope, magnitude, and complexity) in demonstrating their ability to perform all requirements as specified in the project specifications and drawings. This information may include data on efforts performed by other divisions, corporate management, and critical subcontractors or teaming contractors, if such resources will significantly influence the performance of the requirements.
(b) If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent past performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of past and present relevant contracts. Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
(1) For all current or past contracts deemed relevant, provide all the information requested in the following paragraphs:
a. Company/Division Name
b. Program Title
c. Contracting Agency

f. Dates Performed
g. Contract Value (including any option years)
h. Name, Address & Telephone/Fax Number of Government
Program Director/Manager, Administrative Contracting Officer (ACO) or CO.
i. Explain in sufficient detail which aspects of each contract are deemed relevant to the proposed effort.
j. Relevancy Data: Indicate if the offeror was the prime contractor or a subcontractor and provide the name of the prime contractor if the offeror was a subcontractor. Indicate the percentage of the project actually performed by the offeror and the type of work that was performed. If the offeror performed as part of a teaming arrangement or joint venture, indicate the names of all team members and the work performed by each. If necessary, the offeror may include additional comments to clarify the relevancy of the project.
(c) Offerors shall submit no more than five (5) relevant contracts/jobs performed presently or within the past three (3) years. Offerors are required to explain what aspects of each contract are deemed relevant to the proposed effort. Offerors are permitted, but not required, to submit information on significant achievements or explain past problems considered relevant to the requirements. The Government may submit past performance questionnaires to the references provided.
(d) In addition to the data provided by each offeror in this part of the proposal, the Government may use data obtained from other sources (Past Performance Information Retrieval System, which pull information input into
CCASS; other Government sources, commercial sources, etc.) in the development of the Integrated Past
Performance Assessment Rating.
(e) If no past performance information is submitted as a part of the offeror’s proposal, the entire proposal will be considered non-responsive and will not be considered for award. For those offerors who do not have any relevant past performance information to submit, a statement to that effect will satisfy the requirement for a past performance volume.
Documents submitted in response to this RFP must be fully responsive to and consistent with the following:
1. Requirements of the RFP including the Contract Line Item Numbers (CLINS), drawings, specifications, and government standards and regulations pertaining to the specification.
2. Evaluation Factors for Award in Section M of this RFP.
3. Any limitation on the number of proposal pages. Pages exceeding the page limitations set forth in Section L will not be read or evaluated, and will be removed from the proposal.
4. Format for proposal Parts I, II, and III shall be as follows:
(a) A page is defined as one face of a sheet of paper containing information.
(b) The proposals will be on 8 ½” x 11” paper except for fold-outs used for charts, tables, or diagrams, which may not exceed 11” x 17”.
(c) Typing shall not be less than 12 pitch.
(d)Elaborate formats, bindings or color presentations are not desired or required.
