Pre-Proposal Conference for Production Overhead Manpower Services Solicitation - FA857122R0001

Date 10/22/2021

Rules of the Conference

1. We will not be answering questions during this conference. All questions should be submitted in writing by the due date. Answers shall be posted on https://sam.gov/.

2. This is set aside for SBA certified 8(A) contractors only.

3. All instructions discussed in this meeting are intended to be in accordance with the RFP. If anything is said that contradicts the RFP, the instructions in the RFP shall take precedence.

Requirements of the solicitation

A. What contractors are required to submit:

1. Completed Offer, including Cover Letter – Volume 1 (Volume 1, completed solicitation shall consist of the completed and signed solicitation, to include any amendments issued, with a cover letter delineating any exceptions taken to the solicitation terms and conditions with accompanying rationale. Offerors shall ensure that all clauses and provisions that require "fill-in" information are appropriately completed) e.g. 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment.

This shall be IAW Sections 1.3 & 1.5 of Attachment 4 of the solicitation (Attachment 4:

Addendum For FAR Provisions 52.212-1__5 Oct 2021)

2. Pricing. Final BEQ WRALC Production Overhead Spreadsheet (Attachment 7). Offered prices shall be annotated on the provided Final BEQ WRALC Production Overhead in Attachment 7 ONLY. Complete column F of the Price List sheet and columns D & E of the BEQ Total Evaluated Price sheet. The Total Evaluated Price (TEP) shall be calculated by using the BEQ TEP sheet located on attachment 7 and example is located on that sheet. The TEP shall be in cell E29 of the BEQ TEP Sheet.

This shall be IAW Section 1.3 & 1.6 of Attachment 4 of the solicitation (Attachment 4:

B. How should contractors submit the required items

D. What are the evaluation criteria

These shall be IAW the FAR Provision 52.212-2 Evaluation-Commercial Items on page 61 of the solicitation

Price – Total Evaluated Price (TEP) is calculated by finding the total value of each priced CLIN and then finding the sum of all the priced CLINs

E. Plan of executing evaluation

These shall be IAW the FAR Provision 52.212-2 Evaluation-Commercial Items on page 61 of the solicitation

The following Gates will be used to evaluate the proposals:

1) In Gate 1: All proposals received will be ranked from lowest to highest total evaluated price (TEP). The offeror with the lowest TEP will move to Gate 2.

2) In Gate 2: The offerors security clearance shall be verified using National Industrial Security Program (NISP) Central Access Information Security System (NCAISS). If the offeror does not have an approved Facility Clearance Letter with Secret or higher access, the offer shall be considered “nonconforming” to the solicitation and shall no longer be eligible for award. If the offeror in Gate 2 is considered “nonconforming”, the next lowest priced offer in Gate 1 shall be evaluated in the same manner. This selection process shall continue until an offerors security clearance is verified with Secret or higher access. Once verified the offer shall move to gate 3.

3) In Gate 3: A complete evaluation of the price factor (reasonableness and balance) shall be conducted for the offeror with the lowest TEP and has a verified security clearance. If deemed reasonable and balanced. Then the offeror shall move to gate 4.

4) In Gate 4: The contracting officer shall make a determination of responsibly in accordance with FAR 9.103(b). If deemed responsible, this offeror shall be the apparent successful offeror and the contracting officer shall proceed with the award process. If the contracting officer makes a determination of non-responsible, the contracting officer shall follow the procedures outlined in FAR 19.6.

Price – Total Evaluated Price (TEP) is calculated by finding the total value of each priced CLIN and then finding the sum of all the priced CLINs.

The total value of each priced CLIN is calculated by multiplying the monthly rate (provided by the offeror on attachment 7 of the solicitation) per individual per position by the BEQ annual quantities. (CLINS 0007, 1007, 2007 shall not be priced on this solicitation and therefore shall not be included in the TEP. These CLINS shall be negotiated at the time of travel.)

(b) Pre-offer qualification requirement: Prior to submitting an offer, vendors must meet the following qualification. If a vendor submits an offer without meeting the below qualification, the offer shall be considered “nonconforming” to the solicitation and will no longer be eligible for award.

Security Clearance: The Offeror shall ensure applicable contractor/subcontractor personnel have security clearance(s) at the SECRET level for proper accomplishment of contract/order requirements. The security clearance(s) shall be obtained in accordance with the Department of Defense (DD) Form 254, Department of Defense Contract Security Classification Specification prior to submittal of an offer. The offeror must have a Facility Clearance Letter approved at the Secret level prior to submittal of an offer.

Past performance record and history will be assessed as one of the multiple standards required for a successful offeror to be determined responsible as described in FAR 9.104

Price Reasonableness. For the price to be reasonable in its nature and amount, it should not exceed that which would be incurred by a prudent person in the conduct of a competitive business. The existence of adequate price competition is expected to support a determination of reasonableness. Price analysis techniques may be used to further validate price reasonableness.

If adequate price competition is not obtained and/or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information in accordance with FAR 15.4 may be required to support the proposed price.

Balance. Unbalanced pricing exists when, despite an acceptable Total Evaluated Price, the price of one or more contract line items is significantly overstated or understated due to an illogical progression of unit prices from program year to program year, unit prices that do not take into account quantity variations, or front-loading CLINs that do not represent the true cost of that CLIN. The definition of "Front-Loading" is to concentrate costs in an early period. Front- Loading will be viewed as materially unbalanced since acceptance of the proposal would result in an advance payment. The Government will analyze the proposed prices to determine whether there are unbalanced separately priced line items or sub-line items. Prices submitted will be compared and evaluated to assure that a logical progression exists as related to price and quantity changes within each offeror's response to the pricing structure in the Schedule. Offerors are cautioned against submitting an offer that contains unbalanced pricing; offers that are determined to be unbalanced may be rejected if it is determined the lack of balance poses an unacceptable risk to the Government.
