JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

This Justification and Approval to request authority for Other Than Full and Open Competition supports requirements generated for the Air Force Sustainment Center (AFSC), 638 Supply Chain Management Group (SCMG), and the 408 Supply Chain Management Squadron (SCMS) / (GULB). The contracting office for this requirement is AFSC/PZABB. The purchase request number supporting this contracting action is FD2060-14-00009. FY14 funds will be used for this requirement.

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

Due to the circumstances described herein, this activity requests authority to acquire non-recurring engineering services for Form, Fit and Function Interface (FFFI), redesign, development of data, manufacturing, and delivering prototypes that will meet legacy LRU specification requirement for the Backward Wave Oscillator Assembly (BWOA) applicable to the ALQ-155 system on the B52 aircraft. The Justification and Approval authority for Other Than Full and Open Competition as prescribed by FAR 6.302- 1(a)(2), only one or a limited number of responsible sources and no other types of supplies or services will satisfy agency requirements will be utilized for this effort. This action will result in a new predominantly Cost Plus Fixed Fee (CPFF) C- type engineering services contract. A Cost Plus Fixed Fee (CPFF) contract type was determined for this development effort due to circumstances and uncertainties which do not allow the requirement to be defined sufficiently for a fixed price type contract. The period of performance will be 36-month basic with no options or ordering periods (FY14-FY17). The sole source requirement will be obtained from the following source:

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S

NEEDS

Under the contemplated engineering services contract, CAP Wireless will provide the following services to the United States Air Force (USAF) which are required to support the ALQ-155 Weapon System that is installed on the B-52H aircraft.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE

OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE

(APPLICABILITY OF AUTHORITY)

Research has identified the CAP Wireless company (CAGE 1S2F4) as the currently qualified source with the unique technical expertise, experience and business relationships to satisfy the Government’s requirements for this highly specialized engineering services redesign requirement. CAP Wireless will be redesigning the ALQ- 155 BWOA and applicable components using proprietary solid state technology that can meet the high power and high frequency requirements of the ALQ-155 Band 10S Receiver Transmitter. A FY04 Maintenance Engineering Product Sustainment Tool (MPST) Project 883 was approved for NSN 5960-01-094-4134EW with subsequent NGC Rolling Meadows (RM) contract F09603-03-D-0002-0003 for Form, Fit, Function, and Interface (FFI) redesign and qualification. NGC Rolling Meadows (RM) division was awarded the contract but was unsuccessful in satisfying the Government’s requirements, passing qualification testing, and delivering a quality, affordable, and timely redesign of the BWOA that met legacy Line Replacement Unit (LRU) specification requirements. Market research was conducted and concluded that CAP Wireless was the only vendor that was found to meet Government requirements.

CAP Wireless has successfully demonstrated their proprietary solid state technology to the Government under contract FA8650-05-C-1829-010 for the ALQ-161 program. CAP Wireless’ technology is also the only available technology that can fit within the specifications of the Line Replaceable Unit (LRU) and meet the frequency specifications required for the ALQ-155 Receiver Transmitters. The amps in their solid state technology are low voltage, which creates higher reliability rates and less arcing potential in the frequency band width.

It would have been uneconomical for the Government to purchase the data for the BWOA because the technology is obsolete. Also, the Original Equipment Manufacturer, Litton, no longer exists in the market.

Reverse engineering is not feasible due to the hazardous material inside the oscillator and obsolescence. The oscillator contains a tube with beryllium and the Government no longer has the capability to procure this material. Navy Crane can perform small repairs on connectors, but cannot physically open the tube.

Therefore, the available market research information supports that the form, fit and function redesign should be awarded to CAP Wireless due to their success with previous performance on the SBIR program where they have demonstrated their ability to perform this degree of work. Also, CAP Wireless’ proprietary solid state technology is the only technology that can meet the requirements of this effort.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM

AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement will be synopsized on the Federal Business Opportunities (FedBizOpps) web page as required by FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Any source who responds to the Government as a result of this synopsis will be identified to the prime contractor as a potential source for subcontracting possibilities.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST

TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide certified cost and pricing data to be used in supporting the Government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from the Defense Contract Audit Agency (DCAA), Defense Contract Management Agency (DCMA), and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15 ensuring the ultimate cost to the Government is fair and reasonable.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A

STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

As described in Section VI above, market research, in accordance with FAR Part 10, was conducted in June 2013 by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

Internal knowledge possessed by the AN/ALQ-155 engineering staff was queried. Engineering is actively engaged in component product sustainment, staying current with industry developments by reviewing industry reports, trends and product developments, talking with field personnel, reviewing applicable company portfolios on a regular basis, and maintaining an active dialog with the sustainment parts suppliers. Review of several industry-wide searches on the Internet, using the following Acquisition Center of Excellence (ACE) recommended component search engines:

The Government found several companies that have the capability to make solid state amplifiers. None of these companies have produced a product that combines to match the frequency range and power range needed for this effort except CAP Wireless, a small business. The power output on all products from these other companies is significantly below the requirement for this effort. Even the items that met the frequency requirements, did not meet the power requirements. Also, many of these solid states use cable connectors, instead of, waveguide. CAP Wireless is the only vendor that has successfully demonstrated a product in a Government test environment and proven that they can meet the power and frequency requirements, as well as fit into the required space allowed.

Therefore, the research of available market information supports the form, fit, and function redesign of the http://www.bpn.gov/ccrsearch/ asset from CAP Wireless due to the company’s ability to meet the power and frequency bandwidth specifications and hardware specifications with their proprietary solid state technology. CAP Wireless’ data was developed under the SBIR contract, so the data will became available to the Government five years after the SBIR contract expires. This will occur in time for production of the BWOA and the production will be competed under full and open competition.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

See Section VI above.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

No other source(s) other than CAP Wireless has expressed an interest in this acquisition at this time. In the event a contractor expresses interest during the solicitation phase, then the procedure described in Section VI above will be followed.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT

ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

The required data and data rights for this engineering services effort are not in the Government’s possession and cannot be obtained until five years after the SIBR contract expires. The SBIR expired in September 2013.

This engineering services effort will include a requirement for a full technical data package in order to promote competition for future manufacturing and repair efforts. With the delivery of a technical data package, the Government will be able to compete production under an insurance policy buy type contract.

Production is anticipated to occur in FY16.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that the contracting officer has determined this document to be both accurate and complete to the best of the contracting officer’s knowledge and belief (FAR 6.303-2(b)(12)).

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
