52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1) Price

2) Technical/Past Performance

Price – Offerors shall submit prices as indicated on Attachment entitled “Price Schedule”.

Price Reasonableness - The existence of adequate price competition is expected to support a determination of price reasonableness. Price analysis techniques may be used to further validate price reasonableness. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information in accordance with FAR 15.4 may be required to support the proposed price.

Technical Acceptability – Offerors shall provide the manufacturer and Model numbers of applicable equipment offered to fulfill the requirements as stated in Statement of Work (SOW), along with the features and functions of model offered. Offerors shall also provide a detailed configuration of proposed mailing system that will fit and function within specified location (see drawing/layouts for size constraints). The offeror shall provide a brief narrative that addresses the offeror’s ability to meet the requirements, along with applicable warranty information for equipment offered.

Past Performance – The Offeror shall submit three references for mailing systems where offeror installed and provided service and maintenance support at customer site. References shall include model purchased, quantity and contact person’s name, phone number. References should consist of similar services performed within the past three years.

This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR15.101-2. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. The Government intends to make an award without discussions. Discussions, if necessary, will be conducted in accordance with FAR 15.306. Award will be made to the responsible offeror whose proposal conforms to all solicitation requirements, such as terms and conditions, representations and certifications, technical requirements, and also provides the lowest price to the Government.

Offeror’s are requested to complete representations and certifications online at https://orca.bpn.gov/.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
