SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

The purpose of this amendment is to incorporate questions and answers, update clause 52.212-2 (Evaluation – Commercial Items) and extend the solicitation closing date to 19 Dec 2011, 12pm CST.

FIRST: The following question and answer are hereby incorporated into the twelve (12) month Chiller Lease requirement.

1. PWS paragraph 1.2.1.3 states the contractor shall run conduit and appropriate wiring for rental chiller to 460V/3phase/60hertz electrical breaker box on roof. The contractor shall ensure chiller is hooked up and running properly IAW manufactures specifications.

Question: Will the contractor be responsible for providing a certified electrician for the electrical hookup?

Answer: No, the Government shall complete all electrical hookups on the Chiller rental. The contractor is not responsible for this and shall not provide an electrician. The contractor shall run conduit and appropriate wiring for the hookup to the electrical breaker box.

SECOND: Clause 52.212-2 is hereby updated and the following procedures will be utilized during proposal evaluations.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Lowest Price

Factor 1 – Cost/Price

(b) Each offeror shall propose a firm fixed price for the twelve (12) month Chiller Lease (CLIN 0001). Each offeror shall propose a labor rate for the maintenance (CLIN 0002) portion of this contract. The total cost for the maintenance (CLIN 0002) will be evaluated by multiplying the proposed labor rate by the estimated hours. The estimated hours for the maintenance portion have been established at 30 hours for twelve (12) months. These estimated hours are for evaluation purposes only. The total maintenance price will be added to the proposed Firm Fixed Price for CLIN 0001 amount to determine the offerors total evaluated price.

(c) Reasonableness will be assessed by performing a price analysis, comparing the prices proposed with other prices received and other pricing information that the Government may obtain internally or through market research. In the event that discussions are held, the price evaluation may be used in limiting the number of proposals determined to be in the competitive range. Normally, price reasonableness is established through adequate price competition, but may also be determined through cost and price analysis techniques as described in FAR 15.404.

(d) Unrealistically low proposed costs or prices, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement or the offeror has made an unrealistic proposal.

(e) Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items. Offers that are determined to be unbalanced may be rejected if the Contracting Officer (CO) determines that the lack of balance poses an unacceptable risk to the Government.

(f) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

THIRD: The solicitation closing date has been extended to 19 Dec 2011, 12pm CST.

FOURTH: All other terms and conditions remain unchanged and in full effect.
