SUPPLIES OR SERVICES AND PRICES/COSTS
The anticipated period of performance is for 60 months (1-Year Basic Period with four 1-Year Options) for the Remanufacture specified in the schedule and as outlined in the attachments thereto.
This is a Remanufacture requirement. No Government Furnished Material shall be provided. Contractor Furnished Material (CFM) is required for all remanufacture described herein.
The contractor shall furnish and deliver to the Government the supplies necessary to perform the following in accordance with the Terms and Conditions contained in this contract.
Upon receipt of an order, the Contractor shall furnish all plant, labor and equipment, and technical expertise to perform the remanufacture described herein. All such items as may be set forth on order issued by the Government hereunder shall be remanufactured, modified, tested, and prepared for storage and shipped to the Government.
Notes:
1. Some of the units listed below, upon disassembly and/or inspection, may be determined to be beyond repairable limits specified in the work specifications and/or technical orders. Any cost for work performed by the Contractor, prior to the determination that such equipment is beyond repairable limits, shall be included in the unit price of the listed item. CONDEMNED
UNITS WILL NOT BE COUNTED AS PRODUCTION.
2. GOVERNMENT PROPERTY FURNISHED FOR REMANUFACTURE (IAW FAR 16.503(c)): Failure of the Government to order such items set forth as Best Estimated Quantities and Maximum Quantities in the Schedule shall not entitle the contractor to any equitable adjustment in price under the Government Property clause of the contract.
3. CONTRACTOR FURNISHED MATERIAL (CFM): The Statement of Work (SOW), including paragraph 1.12 "Remanufacture Procedures", contains information regarding authorized sources for component parts. The SOW is included in Section J as Attachment 6. Offerors may want to conduct a market analysis of component part availability when establishing unit prices.
4. Accelerated delivery is desirable and acceptable.
5. The Best Estimated Quantities (BEQ) set forth in CLINs 0001 et al DO NOT in any way describe this requirement and should not be used in connection with the offeror’s price proposal except as follows. The stated BEQs and Amount headers are included solely to evaluate offeror price proposals and will only be used by the government to evaluate offeror price proposals and as a check to ascertain potential mistakes in bid. Offerors are required to complete the Pricing Matrix attached to this solicitation in accordance with Addendum to 52.212-1, Instructions to Offerors. OFFERORS SHOULD ONLY CONSIDER THE MINIMUM QUANTITIES AND MAXIMUM QUANTITIES IN ESTABLISHING THEIR UNIT PRICES. See FAR 16.504.
The contract minimum quantity is 10 EA.
The contract maximum quantity is 720 EA.

3.0. Factor 1 - Price
These instructions are to assist you in submitting information required to evaluate the reasonableness of your proposed prices/costs. Compliance with these instructions is mandatory and failure to comply may result in rejection of your proposal.
3.1. General Instructions
Information beyond that required by this instruction shall not be submitted, unless you consider it essential to document or support your price position. The proposed unit prices shall be input into the Pricing Matrix (Attachment 1) in the worksheet entitled “TEP”. All amounts shall be proposed in U.S. Dollars. If additional rationale is deemed pertinent to support the prices in the Pricing Matrix, provide it in the worksheet provided in Attachment 1 entitled “Additional Rationale (Optional)”. Contractor format is acceptable.
3.1.1. Price Reasonableness
Offerors’ proposals will be evaluated for reasonableness, as well as completeness. Normally, price reasonableness is established through adequate price competition, but may also be determined through proposal analysis techniques. The burden of proof for credibility of proposed prices rests with the Offeror. The Government reserves the right to request pricing information from Offerors during the evaluation, such as assumptions, historical data, projections, expertise, management decisions, methodology for blade pricing, etc. It shall be noted that completeness is one aspect of price reasonableness. For completeness, Offerers must provide unit prices for all listed items in the Pricing Matrix (Attachment 1).
3.1.2. Balanced Pricing
The Government will evaluate proposals for balanced pricing. The Offeror is cautioned against submitting an offer that exhibits unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonable or unrealistic prices. For this acquisition, balanced pricing is determined with respect to year-to-year price variances for separately priced Contract Line Item Numbers (CLINs) or SubCLINs. Offerors shall provide rationale for any proposed CLIN price increase greater than five percent from one year to another, or any proposed CLIN price decrease from one year to another. Unexplained price variances from year-to-year could suggest unbalanced pricing. Also, an offer could be so grossly unbalanced that acceptance of the offer would be tantamount to allowing an advanced payment. If what appears unbalanced is due to sound rationale associated with, for example, the proposal’s technical approach or emerging technologies, it is in the Offeror’s best interest to provide explanations or supporting rationale for any significant annual CLIN price variances.
3.1.3. Price Realism
Offerors’ proposals will be evaluated for price realism. To be realistic, the proposed price must demonstrate an adequate understanding of the requirement. Unrealistic prices may be grounds for eliminating a proposal from the competition based on an apparent lack of adequate understanding of the requirement. The Government reserves the right to request pricing information from Offerors during the evaluation, such as assumptions, historical data, projections, expertise, management decisions, methodology for blade pricing, etc.
3.1.4. Total Evaluated Price
Offerors shall complete the Pricing Matrix (Attachment 1). Offerors must ensure all required proposed pricing is provided, ensuring all periods of performance are priced. These include one (1) one-year Basic Period and four (4) one-year Option Periods. Any omission of required pricing may result in an unfavorable proposal evaluation. An incomplete Pricing Matrix (Attachment 1) will be considered unreasonable since pricing completeness is part of the price reasonableness criteria.
Proposed unit prices will be evaluated using Best Estimated Quantities (BEQs) consisting of estimates provided by the Government per year. The quantities utilized in the Pricing Matrix are based on historical analysis of the number of estimated annual quantities required per year of contract performance. These estimates are for evaluation purposes only and do not guarantee any level of effort or buy quantities after contract award. The proposed unit prices will be multiplied by the annual BEQs to determine the Total Evaluated Price (TEP) for evaluation purposes. The resulting contract will be an Indefinite Delivery Indefinite Quantity (IDIQ) contract vehicle. To reiterate, the Offeror shall take into account the minimum and maximum quantities when determining the proposed pricing for this effort.
As this effort is Firm Fixed Price, all risk associated with fluctuations in estimated quantities, data based on historicals, subcontractor pricing at all tiers, market changes, etc. is to be considered and priced into the proposed prices. Offerors shall be held to their proposed pricing.
3.2. Pricing Information Requirements
FAR 12.209 gives the requirement to establish price reasonableness in accordance with FAR 13.106-3 (Simplified Acquisition Procedures), FAR 14.408-2 (Sealed Bidding), or FAR 15.4 (Contract Pricing by Negotiation), as applicable. Although this is a commercial FAR Part 12 RFP, FAR 15.4 applies as appropriate. Specifically, FAR 15.404-1 applies regarding proposal analysis. Price analysis techniques shall be utilized to ensure fair and reasonable pricing IAW FAR 15.404-1(b).
IAW FAR 15.403-1(b)(1), prices based on adequate price competition do not require submission of certified cost or pricing data. IAW FAR 15.403-3(a), however, data other than certified cost or pricing data may be required to support price reasonableness. FAR 15.403(a)(1) provides for obtaining data other than certified costs or pricing data if needed to determine price reasonableness. Therefore, the FAR does not preclude the requirement for obtaining data other than certified cost or pricing data under certain circumstances and the Government reserves the right to obtain data as appropriate. Should the PCO determine proposed prices appear unreasonable or the possibility that an Offeror does not fully understand the requirement, the Offeror(s) may be required to support the proposed pricing via data other than certified cost or pricing data. If, after receipt of proposals, the PCO determines that there is insufficient information available to determine price reasonableness and none of the exceptions in FAR 15.403-1 apply, the Offeror shall be required to submit certified cost or pricing data.
3.2.1 Rounding
All proposed dollar amounts shall be rounded to the nearest cent (two decimal places). If any pricing proposal deviates from this format, the Government will apply the specified format to determine the extended pricing and Total Evaluated Price (TEP).
3.2.2. Submission of Attachment 1 - Pricing Matrix
Submit the fully completed, electronically encoded Attachment 1 - Pricing Matrix in support of the proposed TEP.
The Pricing Matrix proposed pricing must be consistent with your approved estimating system. All unit prices for each CLIN which requires proposed pricing must be provided. The Pricing Matrix shall remain locked without any revisions, adjustments, or tampering by Offerors. The Pricing Matrix submitted must comply with the following format requirements:
a. Data file should be submitted on a CD.
b. Data file should be .xls file format (MS-Excel 2016 or earlier).
4.0. Solicitation Requirements
4.1. Solicitation/Contract Form SF 1449
The Offeror shall complete Blocks 17 and 30 of the SF1449. Signature by the Offeror on the SF1449 constitutes an offer, which the Government may accept.
4.1.1. Contract Clauses
The Offeror shall complete provisions/clauses as required.
4.1.2. Representations, Certifications, and other Statements of Offerors The Offeror has completed the annual representations and certifications electronically via the System for Award Management (SAM) at http://www.sam.gov/portal. After reviewing the SAM information, the Offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, are correct. Please insert “NONE” (if applicable) in FAR 52.212-3(b)(2) so the Government can determine the provision has been completed instead of missed.
4.2. Ombudsman
An Ombudsman has been appointed to hear concerns from Offerors or potential Offerors during the proposal development phase of this acquisition. The Ombudsman for this acquisition is OC-ALC/PZC. This does not diminish the authority of the program director or CO, but communicates Offeror concerns, issues, disagreements and recommendations to the appropriate Government personnel. When requested, the Ombudsman shall maintain strict confidentiality as to the source of the concern. The Ombudsman does not participate in the evaluation of proposals or in the source selection process; interested parties are invited to call OC-ALC/PZC at 405-736-3273.
