ESG-001 DELIVERY ORDER PROCESS

ESG-001 DELIVERY ORDER PROCESS

1. DELIVERY ORDER CONTRACT

a. The Government intends that this solicitation may result in award of at least two indefinite delivery indefinite quantity (ID/IQ) contracts. Products will be procured via the award of Delivery Orders issued against the basic contract. There are two procedures to be followed for the submission of offers for award of Delivery Orders.

b. Initial Delivery Orders. The Government intends to award delivery orders to meet the minimum contract requirements in accordance with FAR 16.505 (b) (2) (iv). Offerors shall complete CLINs 0001, 0004, 0007, 0014, and 0016 with the firm fixed price offered. One or more delivery orders will be issued to each awardee to meet the minimum quantity of the contract. The quantity identified in each CLIN represents the total amount that the Government intends to order initially to cover minimum order quantities of all awardees, and does not represent the minimum amount that each offeror may receive. Initial Delivery

Orders may not be identical in quantity or amounts and these differences shall not constitute grounds for a protest.

c. Subsequent Delivery Orders. The Government intends to order additional products, up to the stated contract maximum value, throughout the period of this contract. Special procedures and regulations apply to the award of subsequently awarded Delivery Orders. These procedures are provided below.

2. DELIVERY ORDER PROCEDURES (SUBSEQUENT DELIVERY ORDERS)

a. Delivery Orders will be used to acquire MAJCOM and Base CONUS requirements. All Air Force contracting offices that support these locations are authorized to place Delivery Orders against this contract.

The buying office placing an order has broad discretion in determining which awardee should receive a

Delivery Order. The buying office shall provide awardees with the base’s specific needs, i.e. fixture options. Price will be the only evaluation factor that will be considered in arriving at an award.

b. The price of the Delivery Order. The following will be considered in evaluating prices proposed:

1. Completeness. All price information required by the Delivery Order proposal request has been submitted.

2. Reasonableness. The degree to which the proposed prices compare to the prices a reasonably prudent person would expect to incur for the same or similar product. For products identified in the contract pricing CLIN schedule, the Delivery Order price may not exceed the price in the CLIN.

c. Delivery Order Proposal Request, Proposal Submission, and Delivery Order Award. The process for requesting Delivery Order proposals, evaluating the proposals, selecting an awardee for each Delivery

Order, issuing the Delivery Order, and the commencement of services under each Delivery Order is shown below.

1. Delivery Order Proposal Request.

i. The buying office will issue a written Delivery Order Proposal Request and will forward it to all awardees unless one of the exceptions to the fair opportunity for consideration listed in FAR clause 16.505 (b)(2) applies.

ii. The Delivery Order Proposal Request will include as a minimum the following information:

A. Date of order

B. Contract number and order number

C. Contract item number

D. Description of products

E. Quantity required

F. Unit price

G. Accounting and appropriation data

H. Payment office address

I. Invoicing and acceptance instructions [NOTE: The contractor shall only invoice and be paid for actual products shipped. Only the Prime Contractor shall submit the invoice.]

J. Any other pertinent data

2. Proposal Submission.

i. All awardees are expected to participate in the competition for each delivery order proposal request under this contract. If an awardee is unable to submit a proposal, a brief written statement as to why the awardee is unable to submit a proposal is required.

ii. The awardee's delivery order proposal shall include a price section. The awardee’s delivery order proposal shall be submitted to the buying office within seven (7) calendar days of the delivery order Proposal Request Date of Order, unless a longer period is granted by the ordering buying office. If the 7th calendar day falls on a Saturday, Sunday, or a Government holiday, the awardee’s Delivery Order proposal shall be due on the first work day following the 7th calendar day. Delivery order proposals shall be valid for a minimum of 60 calendar days after the required submission date.

3. Delivery Order Award.

i. Upon completion of the evaluation of the awardees’ Delivery Order proposals, the buying office will issue a Delivery Order to the awardee whose proposal is the lowest price.

ii. Any questions pertaining to the Delivery Order proposal request shall be submitted to the buying office in writing within seven (7) calendar days of Delivery Order proposal request issuance. In the event issues pertaining to a Delivery Order proposal request cannot be resolved to the satisfaction of the buying office, the buying office reserves the right to withdraw or cancel the proposed Delivery Order without award. In such event, the awardees will be notified, via letter or email, of the buying office's decision and this decision shall be final and conclusive and shall not be subject to the "Disputes" clause.

4. Performance.

i. When the awardee experiences any delays in accomplishing a specific delivery, the awardee shall notify the ordering buying office immediately. The ordering buying office will evaluate the situation to determine if an extension of the dates is appropriate. If an extension is not approved, the Government may terminate the delivery order for cause or seek other remedies as appropriate.

ESG-002 – AFWAY II LANGUAGE

ESG-002 – AFWAY II LANGUAGE

Notification of AFWay II Requirement

1. The Air Force is in the final stages of implementing a new e-procurement tool. This new application, AFWay II, will establish a ―store-like‖ environment for AF buyers to purchase certain kinds of goods and services at Air Force

Base installations throughout the Continental United States (CONUS). It is similar to other commercial purchasing sites available on the Internet. This new tool will allow the AF to more aggressively manage cost by restricting the choices buyers will have when they need to make purchases, e.g. taxiway lighting. This new tool will also help ensure that the Air Force’s awardees capture a larger share of the overall spend.

2. To support the shopping and e-ordering capability within this tool, the AFWay II office will need to load supplier agreements (pricing, terms, etc.) into the AFWay tool. The Air Force’s designated preferred suppliers will be required to provide an electronic catalog for all of the items they will be selling to the Air Force. The catalog will need to include a digital picture as well as complete information on each product. The files provided as Attachment

3, Attachment 4, Attachment 5, Attachment 6 and Attachment 7 will be used by the successful offeror(s) to create an

XML catalog. The catalog.xml, options.xml, picture files and thumbnail files will be provided to the AFWay II office upon contract award.

3. In addition, upon contract award the successful offeror(s) shall, upon AF request, be required to:

a. Register for all company employees who will interface with the e-procurement tool to access the system for future orders and requests for quotes.

b. Obtain PKI certificates for all company users. For more information on this requirement please go to the following website: http://iase.disa.mil/pki/eca/index.html.

c. Apply for Global Exchange (GEX) access to send catalog files to AFWay II. The files provided as

Attachment 8, Attachment 9, and Attachment 10 explain the application process.

4. As the AFWay II e-procurement tool is finalized, additional information will be provided that may require Air

Force awardees to obtain AFWay training, administer product information on the AFWay site, and/or provide additional information that will allow access to the AFWay site.

ADDENDUM 52.212-1

Addendum to 52.212-1 – INSTRUCTION TO OFFERORS

The instructions permit the inclusion of any additional data or information an Offeror deems pertinent within the stated page limitations. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make an award based on initial proposals received, without discussion of such proposals. The Offeror shall make a clear statement in the proposal documentation that the proposal is valid for 90 days.

2. If an Offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unclear or unsound, the Offeror shall immediately notify the Contracting Officer in writing with supporting rationale. All questions in reference to this solicitation shall be submitted to Molly James, Contract Specialist, at molly.james@wpafb.af.mil and Sharma Wilkins, Contracting Officer, at sharma.wilkins@wpafb.af.mil.

In submitting a proposal, Offerors are agreeing to the terms and conditions as written in this RFP. Offerors shall submit an original paper copy of the completed proposal and two (2) exact copies as described below. If there are discrepancies between the original paper copy and duplicate copies, the original paper copy proposal will take precedence and will be the one evaluated. If an Offeror’s proposal is determined unacceptable upon completion of proposal evaluations, the Offeror will be notified promptly of the basis for the determination.

4. The Contracting Officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial proposals, the Contracting Officer will review this determination and if, in the Contracting Officer’s opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the Contracting Officer determines that adequate price competition no longer exists, Offerors may be required to submit information to the extent necessary for the Contracting Officer to determine the reasonableness and affordability of the price.

5. In addition to the proposal, Offerors must submit the following: 1) Manufacturer data sheets shall be submitted with the proposal for review and consideration of the award. 2) A copy of the Airport Lighting Equipment Program

Certificate of Conformance signed by the Program Administrator in accordance with FAA Advisory Circular

150/5345-53C shall be submitted with the proposal. 8. Proposals are due at 1100 hours Eastern Daylight Savings Time on June 27, 2011. Proposals shall be delivered to the attention of Molly James, 771 ESS/EGA, 1940 Allbrook Drive Door #15, Wright-Patterson mailto:molly.james@wpafb.af.mil mailto:joshua.holbrook@wpafb.af.mil

10. Standard commercial packaging applies to this acquisition.

11. Proposal Content:

a. VOLUME I – TECHNICAL CAPABILITY PROPOSAL (1). The Technical Capability Volume (Volume I) shall not make reference to cost or price information. The proposal shall meet all technical capability/technical requirements stated in FAR 52.212-2 elsewhere in the

RFP to be eligible for award. The Offeror should provide documentation which supports all the evaluation factors contained in the addendum to FAR 52.212-2 below. The information provided should be adequate and sufficient to allow the Government to evaluate an Offeror’s technical capability.

(2). As the technical approach will primarily describe and demonstrate the capability of the Offeror to fulfill all requirements stated in FAR 52.212-2, the technical capability proposal should be specific and complete in every detail.

(3). It is the Offeror’s responsibility to ensure the completeness of the technical capability proposal; therefore, the technical evaluation panel for the Government has been instructed to evaluate on the basis of the information provided. The Government shall not assume an Offeror possesses any capability unless specified in its proposal. Understanding of the requirements must be demonstrated by more than a reiteration of them.

Repeating the technical requirements without sufficient elaboration will not be acceptable. Statements such as ―the Offeror understands,‖ ―can or will comply with all the requirements,‖ ―standard procedures will be employed,‖ etc., are insufficient.

(4). The specific topics to be addressed in Volume I are stated in addendum to FAR 52.212-2.

Any factor determined unacceptable will render the entire Technical Proposal as unacceptable. Upon final determination that a proposal is unacceptable, the PCO will promptly notify the Offeror submitting the proposal that it will not be considered for award and shall indicate in general terms the basis for the determination.

Proposals should cover all aspects of technical requirements. Offerors should, to the maximum extent possible, clearly communicate and articulate how the proposed product meets these evaluation factors. If it is not mentioned, the presumption by the evaluators will be that it does not meet the criteria and was thus not included in the proposal for that reason.

Subcontracting Plan Submission: IAW FAR 52.219-8 and FAR 52.219-9, large businesses whose proposal exceeds

$550,000 shall submit a subcontracting plan with their proposal. The following information is provided as the agency goals:

(3). Service-Disabled Veteran-Owned Small Business= 3%

(4). Small Disadvantaged Business= 5%

(5). Women-Owned Small Business= 5%

Offerors shall explain if subcontracting is not achievable for this RFP.

Failure to submit will result in an Offeror’s proposal being found non-responsive.

b. VOLUME II – PRICE PROPOSAL

(1) General – All information relating to pricing data shall be included in this volume. Under no circumstances shall pricing data be included elsewhere in the proposal. Should such pricing data be included in the technical capability, the result will be removal of such pricing data and all other information included on the same page with such data. This could result in the exclusion from evaluation of critical technical capability/technical information. The price proposal shall contain the following in the order shown:

i. Cover letter, only if Offeror desires to provide a cover letter for the Pricing Proposal.

ii. The pricing schedule for CLINs 0001-0016 (base award contract) shall be quoted as not to exceed pricing (―unit price‖) and is to cover all types of L-861T and L-852T fixtures.

iii. Pricing schedule within the CLIN structure of the RFP. Fill in amounts for unit price, max amount and max net amount prices. All dollar amounts shall be carried out two (2) decimal places.
