ATTACHMENT 3 – CLAUSES/PROVISIONS

ADDITIONAL INFORMATION

1. Communications: Communications conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for quotation revision. Offerors are cautioned to submit sufficient information and in the format specified in Addendum to FAR Provision 52.212-1, Instructions to Offerors – Commercial Items. Offerors may be asked to clarify certain aspects of their quotation.

1. Government’s Intent to Award: The government intends to award a single contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest. If discussions are held, discussions will only be held with those offeror’s determined to be in the competitive range.

1. Competitive Range: The Contracting Officer may determine that the number of quotations that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted. The Contracting Officer may limit the number of quotations in the competitive range to the greatest number that will permit an efficient competition.

1. A contract issued by the Contracting Office, signed by the Contracting Officer, is the only instrument by which Government funds are obligated. The Government reserves the right to cancel this solicitation, either before or after the closing date. If you proceed with work prior to receipt of a fully executed contract, you do so at our own risk.

(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern.

(c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Director, Enterprise Sourcing Group, 1940 Allbrook Drive, Building 1, Door 24 Wright Patterson AFB, OH 45433 Phone # 937-257-3517. (d) The ombudsman has no authority to render a decision that binds the agency.

(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer.
