BASIS FOR CONTRACT AWARD: The Government expects the award to result from selection of the technically acceptable quotation(s) with the lowest evaluated price(s)/percentage(s). If deemed acceptable the offeror’s price will be evaluated. Failure to meet any guidelines, factors, or subfactors, may result in an offer being deemed unresponsive and therefore unacceptable for award.

1. The application of technical capability will be evaluated on an acceptable or unacceptable basis in accordance with the requirements stated in Addendum to FAR Provision 52.212-1, Instructions to Offerors-Commercial Items. Offerors shall meet all requirements established in this Addendum in order to be considered responsive to the requirements of this solicitation. The Government will select the quotation(s) whose technical capability is acceptable, and has the lowest proposed price/percentage.

1. Once quotations have been deemed Technically ‘Acceptable’, the contractor with the lowest price will be awarded this contract.

1. The Government reserves the right to award to a single awardee and reasonably expects to make one (1) award.

1. EVALUATION

1. Part I – Technical Capability: The offeror’s technical capability will be reviewed and assigned one of the following ratings. The ratings depict how well the offeror’s technical quotation meets or exceeds the requirements in accordance with the stated evaluation criteria and solicitation requirements set forth in Addendum to FAR Provision 52.212-1, Instructions to Offerors – Commercial Items.

RATING
DEFINITION
Acceptable
Meets specified minimum performance or capability requirements. A quotation must have no deficiencies to receive acceptable but may have one or more strengths.
Unacceptable
Fails to meet specified minimum performance or capability requirements. The quotation has one or more deficiencies and is not awardable.

The rating of the offeror’s Technical Capability will determine whether or not the Government will consider the offeror for award. The Government will proceed as follows based on Technical rating:

1. If deemed technically acceptable: Proceed to evaluate offeror’s price.

1. If deemed technically unacceptable: Halt evaluations for that offeror. Unacceptable quotations shall be deemed ineligible for award.

1. Part II – Price Evaluation: Offers shall then be ranked according to proposed price.

a. The lowest priced offeror(s) shall have an ‘Acceptable’ Technical rating. Award shall be made to the offeror(s) with an ‘Acceptable’ Technical rating and the lowest price.

b. Total price will be calculated inclusive of all Contract Line Item Numbers in the Attachment 2, Price Schedule.

ADDITIONAL INFORMATION AND GOVERNMENT RIGHTS

1. Communications: Communications conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for quotation revision. Offerors are cautioned to submit sufficient information and in the format specified in Addendum to FAR Provision 52.212-1, Instructions to Offerors – Commercial Items. Offerors may be asked to clarify certain aspects of their quotation.

1. Government’s Intent to Award: The government intends to award a single contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest. If discussions are held, discussions will only be held with those offeror’s determined to be in the competitive range.

1. Competitive Range: The Contracting Officer may determine that the number of quotations that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted. The Contracting Officer may limit the number of quotations in the competitive range to the greatest number that will permit an efficient competition.

1. A contract issued by the Contracting Office, signed by the Contracting Officer, is the only instrument by which Government funds are obligated. The Government reserves the right to cancel this solicitation, either before or after the closing date. If you proceed with work prior to receipt of a fully executed contract, you do so at our own risk.
