The following have been modified:

ADDENDUM TO FAR 52.212-1

The following amendments have been made to FAR clause 52.212-1:

1.0 INFORMATION TO OFFERORS

1.1. This acquisition will be conducted as a Small Business set-aside. In addition, this Source

Selection is subject to the preference required by the Randolph-Sheppard Act (RSA). Therefore, a proposal is expected from the Maryland State Licensing Agency (MSLA) in response to this solicitation. This acquisition will follow the Best Value Trade-Off process.

These instructions provide the offeror guidance in preparing the written proposal and describe the approach for development and presentation of the proposed data in response to this solicitation. The offeror’s proposal shall include all data and information requested by this solicitation and shall be submitted in accordance with these instructions. The offer shall be compliant with the requirements as stated in the solicitation, Performance Work Statement

(PWS), Contract Data Requirements List (CDRLs), terms and conditions and representations and certifications. Non-conformance with the instructions provided in this Information to Offerors may result in an unfavorable proposal evaluation.

1.2. The proposal shall be clear and concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government’s requirements, but instead provide convincing rationale to address how the offeror intends to meet or exceed these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities or experience and will base its evaluation on the information presented in the offeror’s proposal.

1.3. Proposal Documentation

1.3.1. Complete in its entirety the “Offeror” portion of the Standard Form 1449. An official having authority to legally bind the company contractually shall sign and date the SF1449 IAW

FAR 4.102. One copy of the SF1449 shall bear an original signature.

1.3.2. Amendments. Offerors shall acknowledge any and all amendments per the directions on the amendment cover page (Standard Form 30). One copy of each amendment shall bear an original signature. Failure to acknowledge any amendments to the solicitation may result in the offeror being deemed nonresponsive. Award CANNOT be made to a nonresponsive offeror.

1.3.3. Representation, Certifications, and Other Statement of Offerors. The offeror shall complete all necessary fill-ins and certifications required by this solicitation and only submit those pages. Ensure compliance with the on-line representations and certifications (ORCA) requirements in SAM. (https://www.sam.gov/portal/public/SAM/).

1.3.4. Authorized Offeror Personnel. Provide the name, title, and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government. If this point of contact is not the CEO, Division President or

Vice President, provide the name, title, telephone number and email address.

1.3.5. Company/Division Address, Identifying Codes, and Applicable Designations. Provide company/division’s street address, county and facility code; Cage code; DUNS code; Tax

Identification Number; size of business (large or small); and labor surplus area designation. This same information shall be provided if the work for this contract will be performed at any other location(s). List all locations where work is to be performed and indicate whether such facility is a division, affiliate, or subcontractor, and the percentage of work to be performed at each location.

1.4. Elaborate formats, bindings or color presentations are not desired or required. Oral

Presentations will not be permitted.

1.5. Offerors shall submit a complete package by the closing date of the solicitation. All required clause fill-ins, pricing and past performance information shall be received timely or the offeror will be excluded from any further action on this acquisition.

1.6. This acquisition is under Collective Bargaining Agreement (CBA) between Industrial, Technical and Professional Employees Union, OPEIU Local 4873, AFL-CIO and Blackstone

Consulting, Inc. covering Food Service Employees at Fort Meade, Five Hats Dining Hall in Fort

Meade, MD, effective 1 March 2014, and Supplemental Agreement, effective 20 August 2015.

Successor contractor shall pay wages and fringe benefits at least equal to those agreed upon by the predecessor contractor IAW FAR 22.1008-2(b). An increase of wage determination or CBA will be adjusted during the base year of the contract and the current CBA expires, if necessary.

1.7. Debriefings. The Contracting Officer will promptly notify offerors of any decision to exclude them from the competitive range; whereupon, they may request and receive a debriefing in accordance with FAR 15.505. Offerors excluded from the competitive range may request a pre-award debriefing or they may choose to wait until after the source selection decision to request a post-award debriefing. However, offerors excluded from the competitive range are entitled to no more than one debriefing for each proposal. The CO will notify unsuccessful offerors in the competitive range of the source selection decision in accordance with FAR

15.506. Upon such notification, unsuccessful offerors may request and receive a debriefing.

Offerors desiring a debriefing shall make their request in accordance with the requirements of

FAR 15.505 or 15.506, as applicable.

The Government reserves the right to award without discussions; therefore, offerors are advised that taking exceptions to any requirement specified in this solicitation may result in the

Government finding the proposal unacceptable. Clarification of Government requirements shall be handled by submitting questions/recommendations prior to submission of proposals. If offerors still find it necessary to take exception to any of the requirements specified in this solicitation, clearly identify each exception in the overview sections of the appropriate volume along with a complete explanation of why the exception was taken and the resulting benefit to the Government. Exception to solicitation requirements may require the Government to amend the solicitation to reflect a changed requirement. The Government will consider the absence of a stated exception to mean the offeror takes no exception to the solicitation and the proposal will be evaluated as submitted.
