About this file

This document is a set of General Requirements for Contractors addressing environmental compliance, waste management, and hazardous material control for work performed at the 914th Air Refueling Wing installation in Niagara Falls, New York.

The contractor must submit a detailed Waste Management Plan (WMP) no fewer than 30 days prior to any on-site work and obtain formal written approval before commencing activities. The WMP must include a Project Waste Summary table identifying all potential waste streams with estimated quantities, waste classifications (Inert Debris, Non-Hazardous, Universal, Hazardous, Recyclable, Salvageable), proposed management methods, and identified licensed haulers and permitted facilities. The contractor shall make a good faith effort to divert a minimum of 50 percent by weight or volume of all non-hazardous project waste from landfill disposal through source reduction, salvage, reuse, and recycling, following the waste management hierarchy in that priority order. For any non-hazardous waste proposed for landfill that has a viable recycling market, the contractor must provide written cost-effectiveness justification. The contractor is responsible for all waste characterization activities and costs, including sampling and laboratory analysis, and must submit analytical reports and proposed characterization to the Contracting Officer for approval.

The Government retains sole authority as the legal waste generator and must sign all waste profiles and hazardous waste manifests. The contractor is strictly prohibited from signing hazardous waste manifests in the generator section and must prepare all manifests unsigned for Contracting Officer signature using the official generator identification: 914th Air Refueling Wing, 914th MSG/CEV, 2405 Franklin Drive, Niagara Falls, NY 14221, EPA ID NY0570024273, Small Quantity Generator status. The contractor must maintain a Waste Diversion Log and submit quarterly reports and a final project waste report summarizing all waste activities, diversion rates, weigh tickets, receipts, and executed hazardous waste manifests. For contractor-supplied hazardous materials, the contractor must submit a Chemical/Hazardous Material Request/Authorization with current Safety Data Sheets no fewer than 30 days prior to use and obtain approval before procurement or transport. Any unused hazardous materials must be removed from the installation prior to final project acceptance, and the contractor is prohibited from abandoning such materials; any disposal costs incurred by the Government will be deducted from final payment.

General Requirements for Contractors: Environmental - Waste, and Hazardous Material Management

1.0 General

This document specifies the Contractor's responsibilities for environmental compliance, waste management, and the control of hazardous materials for all work performed on this installation. The Contractor shall plan, manage, and document all related activities in accordance with these requirements. Failure to submit required plans, obtain necessary approvals, or adhere to these terms will be considered a material breach of this contract.

2.0 Waste Management Plan (WMP) Submittal

2.1. Pre-Construction Submittal: No fewer than 30 days prior to the start of any on-site work (including clearing, grubbing, or demolition), the Contractor shall submit a detailed Waste Management Plan (WMP) to the Contracting Officer for review and approval.

2.2. No On-Site Activity: No project-related activity may begin on-site until the WMP is formally approved in writing.

2.3. The WMP shall, at a minimum, include the components outlined in Sections 3.0, 4.0, and 5.0 of this document.

3.0 Part A: Project Waste Summary and Diversion Plan

This part of the WMP requires the Contractor to perform a thorough pre-project assessment to identify, estimate, and plan for the diversion of all potential waste streams, with a focus on cost-effectiveness.

3.1. Waste Diversion Goal: The Contractor shall make a good faith effort to divert a minimum of 50% by weight or volume of all non-hazardous project waste from landfill disposal. The diversion goal will be met through a combination of source reduction, salvage, reuse, and recycling.

3.2. Waste Management Hierarchy: The Contractor shall develop the WMP in accordance with the following waste management hierarchy, prioritizing strategies in the order listed:

1. Source Reduction: Minimizing the amount of waste generated.

2. Salvage and Reuse: Diverting materials for reuse on-site or for donation/sale.

3. Recycling: Processing materials into new products.

4. Landfill Disposal: The option of last resort for materials that cannot be diverted.

3.3. Project Waste Summary Table: The WMP must include a Project Waste Summary presented in a clear, tabular format. This table shall include:

* Waste Stream Identification: A comprehensive list of all potential waste materials.

* Estimated Quantities: An estimate of the volume or weight for each waste stream.

* Waste Classification: Classification for each stream (Inert Debris, Non-Hazardous, Universal, Hazardous, Recyclable, Salvageable).

* Proposed Management Method: The proposed method aligned with the Waste Management Hierarchy.

* Proposed Facilities and Haulers: Identification of intended, licensed haulers and permitted disposal or recycling facilities.

* Cost-Effectiveness Justification for Landfill Disposal: For any non-hazardous waste stream proposed for landfill disposal that has a viable recycling market, the Contractor must provide a brief written justification demonstrating that landfilling is the most cost-effective option.

4.0 Part D: Waste Characterization, Profiling, and Shipping Document Execution

This section defines the responsibilities for waste analysis, the preparation of disposal profiles, and the legal execution of shipping documents. The Government, as the legal 'Generator' of the waste, retains sole authority for signing all waste profiles and hazardous waste manifests.

4.1. Waste Characterization and Analysis: The Contractor is responsible for all activities and costs associated with waste characterization, including sampling and laboratory analysis. The Contractor shall formally submit all analytical reports and a proposed waste characterization to the Contracting Officer for review and approval.

4.2. Waste Profile Preparation: Upon approval of the characterization, the Contractor shall prepare all required waste profile forms and submit the fully prepared, but unsigned, documents to the Contracting Officer for signature.

4.3. Hazardous Waste Manifest and Shipping Document Execution:

* STRICT PROHIBITION ON SIGNATURE: Under no circumstances is the Contractor, or any of its employees or subcontractors, authorized to sign a hazardous waste manifest or any other shipping document for hazardous waste in the section designated for the 'Generator.'

* The Contractor shall fully and accurately prepare the Uniform Hazardous Waste Manifest for each shipment and present the unsigned manifest to the Contracting Officer or their designated representative for signature prior to shipment.

4.4. Generator Identification and Address: The Contractor shall use the following official information in the 'Generator' section of all waste profiles, manifests, and shipping documents:

* Generator Name: 914th Air Refueling Wing

* Mailing Address: 914th MSG/CEV, 2405 Franklin Drive, Niagara Falls, NY 14221

* EPA ID Number: NY0570024273

* Generator Status: SQG (Small Quantity Generator)

5.0 Part E: Reporting and Documentation

5.1. Waste Diversion Log: The Contractor shall maintain a current Waste Diversion Log for all material removed from the site, detailing the material type, quantity, destination facility, and management method (e.g., Landfilled, Recycled).

5.2. Formal Submittal Requirements: The Contractor shall submit:

* Quarterly Waste Diversion Reports: Summarizing all waste activities for the quarter, including the diversion log and copies of all weigh tickets and receipts.

* Final Project Waste Report: At project completion, as a condition of final payment, providing a cumulative summary of all waste generated and the final, overall project diversion rate.

5.3. Manifest and Disposal Record Submittal: As part of the reports, the Contractor must provide copies of all fully executed hazardous waste manifests, specifically the copy signed by the designated disposal facility and returned to the Generator.

6.0 Part F: Contractor-Supplied Hazardous Material Control and Management

This section outlines the requirements for all hazardous materials (HAZMAT) the Contractor intends to bring onto the installation.

6.1. Hazardous Material Approval Submittal:

* No fewer than 30 days prior to planned use, the Contractor shall submit a completed a Chemical/Hazardous Material Request/Authorization, for each hazardous material.

* A complete and current Safety Data Sheet (SDS) must be attached to each request.
