About this file

This is a Questions and Answers document for the Pavement Maintenance Blanket Order Agreement (BOA) solicitation FA663326QA005. The document addresses four key inquiries from potential bidders regarding contract terms and obligations.

The document clarifies that contractors should incorporate costs for working in controlled or restricted areas into an amended Statement of Work and Price List. BOA holders are not obligated to bid on every task order issued; contractors may decline to bid on specific tasks if unable to perform them. Subcontracting is permitted; however, the prime contractor or BOA holder retains overall responsibility for work performance. The acquisition is designated as a 100% Small Business Set-aside, meaning Small Business Enterprise requirements or goals do not apply to BOA holders.

FA663326QA005 Pavement Maintenance BOA Q&As

1. In which pay item should we include the additional costs for working in a controlled or restricted area? Answer: Amended SOW and Price List to address “controlled or restricted area”.

2. When a request to bid a task under the BOA is issued, can we decline to bid it, or does being on the BOA mean we have to bid every task you issue? Answer: Yes, if unable, you are not obligated to bid on every task order.

3. Can we sub-contract parts of the work? Answer: Yes. But the overall responsibility still lies with the Prime/BOA holder.

4. Are there any SBE requirements or goals we need to meet? There is some language in Attachment 3 regarding SBEs but we weren't sure if there were any firm targets? Answer:

Its stated 100% Small Business Set-aside so SBE requirements or goals don’t apply.
