However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror conforming to the solicitation while being the most advantageous to the Government, price and other factors considered. For the purpose of conducting evaluations, the Government will first rank all offers by Total Evaluated Price (TEP) and then proceed with the simultaneous evaluation of Price and Technical. The Government will evaluate the two lowest priced responsive offers and if the lowest one amoung the two is deemed fair and reasonable and has an acceptable rating for technical capability, evaluation will cease and award will be made to that Offeror, pending compliance with FAR 9.104, without entering itno discussions as this represents the best value to the Governemtn.

(i) PART I - Price;

(ii) PART II – Technical Information (ACCEPTABLE/UNACCEPTABLE BASIS)

(b) Basis for Award. Government evaluation objective is to award to the responsive firm whose quotation is technically acceptable and will provide the best value to the Government. This evaluation process may result in an award to other than the lower quotation.

(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to 52.212-2

1. Price. Quotations rated technically acceptable shall be ranked by price.

Award will be made to the lowest Total Evaluated Price (TEP) offer, comprised of basic period, plus options, plus 6 moths option prices calculated on the basis of the fourth option price, that meets the acceptability standards for non-price factors.

Prices will be evaluated for reasonableness. If the lowest price technical acceptable quotation represents the best value for the Government, the evaluation process stops at this point, and award is made.

a. Reasonableness: Reasonable prices are those that, considering the type of business concern and organizational structure, reflect market conditions for the requested work and reasonable to both parties.

2. Technical Information. The Government shall evaluate the technical information on an acceptable or unacceptable basis as follows:

a. Verifying that all required documentation listed in the Addendum to 52.212-1, Instructions to Offerors paragraph

4. Part II Technical Information has been submitted by each firm. This factor is met when documentation from the firm is complete and technical data meets the requirement described in the Performance Work Statement. Quotes incomplete shall receive an “unacceptable” rating and shall receive no further consideration for award.
