Section M - Evaluation Factors for Award (Services)

M-1 BASIS FOR AWARD

M-1.1 The Government's evaluation of offeror's proposals will be conducted utilizing the evaluation factors of: 1. Technical and 2. Price. Evaluation of these factors will utilize a Lowest Price, Technically Acceptable (LPTA) evaluation approach in accordance with FAR Part 15 and the DoD Source Selection Procedures, as supplemented; whereby the Government seeks to award to the offeror whose proposal, conforming to the solicitation and for which all non-price factors have been determined acceptable, represents the lowest evaluated price. Under the LPTA evaluation process, trade-offs will NOT be permitted between price, and the non-price factors. Only one award will be made as a result of this solicitation.

M-1.2 The Government intends to award a contract without discussions. Upon completion of the Government's initial evaluation of proposals, exchanges with offerors may occur, for purpose of clarifications and communications in accordance with FAR Part 15. The Government reserves the right to conduct discussions with offerors for the purpose of negotiations at any point during the evaluation if deemed in the best interest of the Government. Once discussions, if conducted, have been concluded, the Contracting Officer will request Final Proposal Revisions from each of the offerors remaining within the competitive range.

M-1.3 Award of Order Requirements. Upon award, the Government intends to issue the first Order for AGEA services for the first 12-months of the 24-month ordering period. The Government reserves the right to issue an Order, subject to the availability of funds, within 60 days of award of the Requirements contract.

M-2 EVALUATION FACTORS FOR AWARD

M-2.1 In order to be considered awardable, there must be an acceptable rating in every non-price factor/sub factor. The two (2) evaluation factors used to evaluate proposals are: Factor 1 Technical and Factor 2 Price.

M-2.2 Factor 1 Technical. The government will evaluate technical proposals and the below listed sub-factors on a pass/fail-basis, assigning an overall rating of Acceptable, or Unacceptable. An unacceptable rating for any of the below sub-factors will result in an unacceptable rating for the Technical primary factor. Technical Acceptability shall be evaluated against the following sub-factors where all sub-factors are considered equal:

M-2.2.1 Factor 1 Technical: Subfactor 1 Aircraft Performance. The offeror will be acceptable if each proposed aircraft meets the requirements described in PWS paragraph 3.1 Aircraft Specifications.

The Offeror shall demonstrate how each proposed aircraft will meet the requirements described in PWS paragraph 3.1 Aircraft Specifications. Supporting data (e.g. OEM flight manuals, published performance data, etc.) shall be submitted to substantiate the aircraft meets the performance requirements.

M-2.2.2 Factor 1 Technical: Subfactor 2 Technical Approach. The offeror will be acceptable if the technical approach meets or exceeds the minimum requirement of Aerial Gunnery-Electronic Attack described in PWS paragraphs 3.1.1 though 3.2.5. The Offeror shall describe its technical approach to meet or exceed the minimum requirements of the Aerial Gunnery-Electronic Attack PWS paragraphs

3.1.1 through 3.2.5. The technical approach shall include at a minimum: 1) plan for complying with all United Kingdom (UK) regulations for operating within UK airspace and obtaining approval to operate within said airspace; 2) plan for storage area of aircraft and associated equipment; 3) plan for meeting flight operations that may be scheduled at any time during daylight hours, Monday through Friday, throughout the year with a reasonable amount of time for scheduling coordination.

M-2.2.3 Factor 1 Technical: Subfactor 3 Safety. The offeror will be acceptable if past aircraft incidents and accidents information is disclose, provides a summary of previous incidents and corrective actions to reduce future incidents. Offerors shall fully disclose all past aircraft incidents and accidents within the past 5 years (as defined by National Transportation Safety Board 830 or indigenous equivalent). Offers will provide summary of Final Accident Reports. In response to previous incident(s), describe corrective actions taken to reduce or eliminate possible future occurrences. Offerors shall describe how the offeror will respond to future incident(s) or accident(s) to reduce or eliminate future risk. Describe process for ensuing safety compliance required for flight operations in the locations to be used for these operations.

M-2.2.4 Factor 1 Technical: Subfactor 4 Past Experience. The offeror will be acceptable if two contracts of same/similar scope and performed recently within three years for aerial gunnery and electronic attack as well as aircraft and equipment. Provide evidence of two contracts of same/similar performance and/or scope of work as the PWS. Contract performance shall be within three (3) years from the issuance date of this solicitation and meet the following criteria:

a) Provided Aerial Gunnery training services to the Military IAW PWS paragraph 3.2.

b) Provided Electronic Attack training services to the Military IAW PWS paragraph 3.3.

c) Provided Aircraft and equipment that meets or exceeds minimum requirement IAW PWS paragraph 3.1.

Evidence of prior experience shall include the following information:

Verified, up-to-date name, address, email of company representative

M-2.3 As a result of the government's evaluation of the aforementioned technical sub-factors of Technical and all associated elements accordingly, a determination of acceptable or unacceptable will be assigned to the Technical factor using the following ratings and descriptions:

M-2.4 Factor 2 Price. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

M-2.4.1 The Government will evaluate prices submitted in the Price Schedule (Attachment 4). Failure to propose all CLINs will render the proposal non-responsive. The total offered price shall include all cost associated with operating in the United Kingdom. Should the Government require a cost breakdown of the total offered price, the offeror will be required to submit this information.

M-2.4.2 The Government Evaluation Team will present a Total Evaluated Price (TEP) to the Source Selection Authority. An offeror's TEP will be determined by multiplying the quantities for each CLIN (0001-0002) identified in the Price Schedule (Attachment 4) by the proposed unit price to calculate the extended annual total amount for each CLIN. The extended prices for each CLIN will then be added together.

M-2.4.3 In the event there is a difference between a unit price and the extended total amount, the unit price will be held to be the intended offer and the total of the CLINs will be recomputed accordingly. If the offeror provides a total amount for a CLIN but fails to enter the unit price, the total amount divided by the respective CLIN quantity will be held to be the intended unit price.

M-2.4.4 Offerors should propose the best available pricing to the Government for each CLIN in arriving at the most competitive price. Price information submitted in each offeror's price proposal, as required by Section L - Instructions, Conditions, and Notices to Offerors, will be evaluated to determine if proposed prices are fair and reasonable IAW FAR 15.305. The Government may use any of the price analysis techniques IAW FAR 15.404-1(b) to determine reasonableness. Prices will be evaluated for balance IAW 15.404-1(g). Unbalanced pricing may pose an unacceptable risk to the Government and may be a reason to reject an offeror's proposal.
