Failure to meet a requirement may result in an offer being ineligible for award.

The Government’s terms, conditions, and respective clauses contained within this solicitation are prescribed in accordance with United States Federal Acquisition Regulations (FAR), and are not subject to conditionally proposed revisions or changes requested by offerors. Offerors’ specific terms and conditions that may be contingently proposed for subsequent inclusion into the contract, if awarded, will not be considered by the

1. A maximum of 3 persons per company will be allowed to participate.

2. Contractor shall provide the names, DOB, and Driving License or Passport Number of company representatives attending the site visit not later than 1630 hours British Summer Time on 4 June 2018, to: Brandon Hagler at brandon.hagler@us.af.mil & Maria Calimlim at maria.calimlim@us.af.mil.

3. All questions received prior to and during the site visit will need to be recorded and submitted by contractors, in-writing, to the aforementioned contracting POC’s for answering.

4. All questions and answers will be recorded and published on the Federal Business Opportunities website for all interested parties to view.

5. The last date to submit questions regarding the solicitation is 11 June 2018, by 1630 hours British Summer Time.

INFORMATIONAL PRICING NOTE:

TUPE - (Transfer of Undertakings (Protection of Employment) Regulations 2006

Definition. The United Kingdom’s Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) is the main piece of legislation governing the transfer of an undertaking, or part of one, to another. The regulations are designed to protect the rights of employees in a transfer situation.

During the solicitation phase and award of the resultant contract the Government does not have access to specific

TUPE information nor becomes involved with related TUPE processes and associated liabilities (to include indemnification) that may transpire during pre-award or post-award phases between transferor and transferee.

While the Government fully understands the relevance of TUPE-information in proposing fixed prices, the responsibility to provide TUPE-information rests solely with the transferor; governed by Regulation 11 of the

Transfer of Undertakings (Protection of Employees) Regulations 2006 (TUPE). As the transferor need only provide TUPE information to the transferee prior to the transfer, the Government will only make available the listing of the current, incumbent contractor(s) with associated points of contact if requested. The Government is not responsible for determination of TUPE applicability; the responsibility lies solely with the transferor.

As this is a firm-fixed price requirements contract it is incumbent upon the offeror to calculate any anticipated

TUPE pricing at time of quote submittal. TUPE costs cannot be submitted as a conditional quote, if submitted as such the offeror’s quote will be considered unacceptable and the offeror may be excluded from competition.

End of Addendum

ADDENDUM TO 52.212-2

Addendum to 52.212-2 Evaluation – Commercial Items

BASIS FOR CONTRACT AWARD: The Government’s evaluation of offeror’s quotes will be conducted utilizing the evaluation factors of: Technical Capability, Price, and Past Experience. Evaluation of these factors will utilize a fair and reasonable evaluation approach; whereby the Government seeks to award on the basis of the lowest price of quotes which meet the listed technical specifications, price, and past experience. Only those offerors whose quotes are determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. Under the evaluation process, trade-offs will NOT be permitted between price, and the non-price factors.

Only one award will be made as a result of this solicitation.

The Government intends to award a contract without discussions. However, the Government reserves the right to conduct discussions if deemed necessary. Upon completion of the Government’s initial evaluation of quotes, exchanges with offerors may occur, for purposes of clarifications, communications, and/or discussions.

6. EVALUATION FACTORS FOR AWARD:

a. Technical Capability. The government will evaluate technical quotes on the sub-factors listed below on an acceptable or unacceptable basis. An unacceptable rating for any of the below sub-factors will result in an unacceptable rating for the Technical Capability primary factor. Accordingly, under this evaluation approach, offerors who receive an unacceptable rating for this factor may not be considered for award. However, the

Government reserves the right to conduct discussions if deemed in its best interest. Technical Acceptability shall be evaluated against the following sub-factors where all sub-factors are considered equal:

i. Subfactor 1: Quality Control Plan

Measure of Merit: This requirement is met when the offeror has thoroughly and successfully demonstrated the ability to meet all quality control activities identified in 52.212-1 Addendum, Quality Control Plan. Additionally, evaluation will be based on whether the offeror’s overall control of quality addresses and meets the specified performance thresholds for each requirement in

Attachment 1, Performance Work Statement, Section 2.0 – Services Summary.

ii. Subfactor 2: Licenses/Insurance/Registration

Measure of Merit: This requirement is met when the offeror submits all licenses, insurance documentation, and company registration required under UK Law.

As a result of the government’s evaluation of the aforementioned technical sub-factors, a determination of acceptable or unacceptable will be assigned for this factor of Technical Acceptability using the following ratings and descriptions:

Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable

Quote clearly meets the minimum requirements of the solicitation.

Unacceptable

Quote does not clearly meet the minimum requirements of the solicitation.

b. Price Evaluation. The Government will evaluate prices submitted in Attachment 2, Pricing Schedule. Failure to propose on all CLINs will render the quote non-responsive.

i. During the evaluation process, the Government Evaluation Team will validate a total price for each offeror’s quote. An offeror’s total price will be validated by multiplying the quantities identified in the Request for Quote by the proposed unit price for each CLIN of ALL ordering periods to derive at the extended total amount for each CLIN. The extended prices for each CLIN will then be added together.

ii. Offerors should propose the best available pricing to the Government for each CLIN in arriving at the most competitive price. Additionally, as this requirement is commercial in nature and will result in a

“firm-fixed-price” requirements contract, a comparison of offeror’s total price will satisfy the requirement for price analysis, in establishing price reasonableness. The Government may determine that an offer is unacceptable if the prices are significantly unbalanced.

c. Past Experience.

i. Measure of Merit: This requirement is met when the offeror thoroughly, completely, and accurately submits all of the following criteria listed in this subfactor. Past experience will be evaluated for its completeness in addressing relevant past experience comprising of the two (2) required years of verified recent, and relevant past experience performing Hoods & Ducts Cleaning services. This requirement will be met when an offeror provides documentation of the experience acquired in the timeframe specified and has demonstrated the relevancy of the experience with Hoods & Ducts

Cleaning services. Contact information will be verified to ensure the experience submitted meets the relevant experience required in this solicitation.
