DESCRIPTION
I. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, 13.106-1(b) (ii), and 13.5 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are requested and a written solicitation will not be issued. The solicitation is being issued using simplified acquisition procedures.
II. In accordance with the Agreement of Defense and Cooperation between the Kingdom of Spain and the
United States of America, any contract resulting from this notice/solicitation can only be entered into with companies authorized to carry out these activities in Spain under Spanish law. Companies must meet the requirements established by Spanish legislation for execution of Government works. In addition, in accordance with the Agreement of Defense Cooperation between the U.S.A. and the Kingdom of Spain, Annex 6, Article 1 (3) “The contractors must meet the requirements established by Spanish legislation for execution of government works. A breach of contract on the part of a contractor shall have the same consequences for the contractor for purposes of future contracting with the Spanish government as would occur with a breach of a contract with the Spanish public administration.” and (5) " Spanish material, labor, and equipment shall be used whenever feasible and consistent with the requirements".
NOTE: THIS SOLICITATION IS INTENDED ONLY FOR LOCAL SOURCES IN ACCORDANCE
WITH FEDERAL ACQUISITION REGULATION 5.202(a)(12) and 13.104(b). LOCAL SOURCES
ARE THOSE SOURCES NORMALLY RESIDENT, LICENSED AND REGISTERED TO
CONDUCT CONSTRUCTION BUSINESS IN SPAIN. OFFERS FROM NON-LOCAL SOURCES
WILL NOT BE CONSIDERED UNDER THIS SOLICITATION.
III. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2025-03, effective date 17 Jan 2025.

The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery. The contractor shall deliver all Line Items to: (either are acceptable)

II. FAR 52.212-1, Instructions to Offerors--Commercial Items (Sep 2023) applies to this acquisition
III. FAR 52.212-2, Evaluation--Commercial Items (Nov 2021), applies to this acquisition.
a. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Acceptability is equal to price.
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation & specifications provided.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
b. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
c. BASIS FOR AWARD / EVALUATION PROCEDURES:
i. The lowest priced quote will be evaluated for technical acceptability. If the lowest priced quote is found technically acceptable, the award will be made without further consideration. If the lowest quote is deemed technically unacceptable, the next lowest quote will be evaluated for technical acceptability, and so on until an award can be made to the lowest priced technically acceptable quote. Award will be made on the initial evaluation of quotes received in response to this RFQ. Therefore, offerors are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint.
IV. FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items (May 2024) is included in this solicitation. The contractor must have a valid Representations and Certifications filed in the System for Award Management (SAM) and furnish the government a completed copy of the record with its offer.
V. FAR 52.212-4, Contract Terms and Conditions-Commercial Items (Nov 2023) applies to this acquisition.

VIII. All firms must be registered and active in the System for Award Management (SAM) database at https://www.sam.gov/SAM/ to be considered for award. Proposal must be directly submitted by the firm registered in SAM that is intended to be the successful awardee. Proposals submitted by another firm on behalf of a SAM registered company with the intention of being award “care of” will not be accepted. All proposals must include registered DUNS, CAGE code, and Tax ID and small business status.
IX. Submit proposal via email to TSgt Terrel E. Cloud at terrel.cloud@us.af.mil, and SSgt Keif Gardner at keif.gardner@us.af.mil. Submittal of multiple proposals will not be accepted.
A Response to this RFQ must be received via e-mail no later than 09:30 A.M. Local Standard Time (ChST) on 15 April 2025. Oral proposals will not be accepted. Emailed proposals must be received at the stated addressee email inbox on time and the addressee must be able to open the email and all attachments. No other email receipt will be acceptable. The Government does not accept responsibility for non-receipt of proposals. It is the vendor’s responsibility to request and receive confirmation of proposal receipt.
