52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

mailto:joseph.wells.4@us.af.mil mailto:joseph.wells.4@us.af.mil

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

A. TECHNICAL

B. PRICE

C. PAST PERFORMANCE

Performance-Price Trade-off (PPT): Technical Proposal Evaluation. Evaluation factors other than cost or price, when combined are approximately equal to Price.

b. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Then Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

c. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2 Evaluation – Commercial Items:

This is a competitive best value source selection in which competing offerors evaluation factors other than cost or price, when combined are approximately equal to price. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions To Offerors, the offeror accedes to the terms of this model contract. All technically acceptable offers shall be treated equally except for their prices and performance records. Failure to meet a requirement may result in an offer being determined technically unacceptable. The evaluation process shall proceed as follows:

A. Technical Acceptability. Initially, the Government technical evaluation team will evaluate the technical proposals by assigning an Acceptable or Unacceptable rating (see Table 1 below). The proposals shall be evaluated against the following sub factor:

Technical Factor: Staffing Plan

The Offeror’s proposal shall be evaluated to determine if the proposal demonstrates an acceptable management and staffing approach that reflects a clear understanding of the work required and a reasonable, well-thought-out approach that is likely to yield the required results. This includes: effective use of personnel to perform the services;

the effectiveness of the overall management methodology to manage the requirements of the PWS; the ability to resolve priority conflicts for the resources to ensure that the requirements of the PWS are met; and the Offeror’s ability to fulfill the staffing requirements of the PWS. Based upon the evaluation, the Factor will be rated on an

Acceptable/Unacceptable basis.

Table 1, Technical Ratings

Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

B. Price Evaluation. Next, the Government will rank all technically Acceptable offerors by price, including all option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in the Price

Schedule by the proposed unit price for proposed unit for each Contract Line Item Number to confirm the extended amount for each. The price evaluation will document the reasonableness and completeness of the proposed total evaluated price. The Government reserves the right to perform price realism analysis.

NOTE: In order to meet the requirements of FAR Part 6 and FAR Part 17, the price equivalent to the six (6) months extension of services authorized by FAR 52.217-8 will be evaluated separately, and will be factored as part of the total evaluated price for award. The Government will calculate the total contract cost (Base + one(1) Option year), then divide that amount by 4 (total number of 6-month periods over the 2 year contract) and evaluate such price for reasonableness.

C. Past Performance. Lastly, the Government will seek recent and relevant performance information on all technically acceptable offerors based on (1) the references provided by the offeror, (2) past performance information obtained from questionnaires (Attachment 6), and (3) data independently obtained from other Government or commercial sources.

Recent performance information includes relevant contracts performed for the Department of Defense, Government of Japan, US Government agencies, and commercial customers within the last three (3) years from the issuance date of the solicitation.

Relevant performance includes performance of efforts involving Drayage Services that are similar or greater in scope, magnitude, and complexity than the effort described in this solicitation. The Government will use the relevancy definitions and ratings in Table 2 below when assessing for relevancy:

Table 2. Past Performance Relevancy Ratings

Rating Definition Rating Definition

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

In evaluating past performance, the Government reserves the right to give greater considerations rating to information on those contracts deemed most relevant to the effort described in this solicitation.

The purpose of the past performance evaluation is to assess the degree of confidence the Government has in the offeror’s ability to provide Drayage Services that meet the solicitation requirements based on the offeror’s demonstrated record of performance. The assessment process will result in an overall performance confidence assessment rating of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or
