52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) TECHNICAL

(2) PRICE

(3) PAST PERFORMANCE

Performance-Price Trade-off (PPT): Technical Proposal Evaluation

(b) Past performance is approximately equal to price.

(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)

Addendum to FAR 52.212-2 Evaluation – Commercial Items

BASIS FOR CONTRACT AWARD:

This is a competitive source selection in which competing offerors past performance history will be evaluated on a basis approximately equal to price. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions To Offerors, the offeror accedes to the terms of this model contract. All technically acceptable offers shall be treated equally except for their prices and performance records. The evaluation process shall proceed as follows:

A. Technical Acceptability. The Government technical evaluation team will evaluate the technical proposals on a pass/fail basis, assigning an Acceptable or Unacceptable rating (see Table 1 below). The proposals shall be evaluated against the following sub-factor:

Sub-factor - Staffing Plan: The Government will assess the offeror’s proposed methodology to meet the unique staffing and manning requirements conduct a comprehensive inventory and to maintain the Government’s COHS as described in the Performance Work Statement (PWS) including all warehouse and supply storage areas listed in paragraph 3.1.1., to include organization structure, and recruitment and coverage of key positions. The vendor identified key positions are based on requirements outlined in PWS paragraphs 4.11.

Table 1, Technical Ratings Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

B. Price Evaluation. The Government will rank all technically Acceptable offers, including those with correction potential, by price, including all option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in the Pricing Schedule by the proposed unit price for CLIN 0001 including all option periods, to confirm the extended amount for each. The proposal(s) must be submitted for a base year plus four (4) Option Years. The extended amount must equal the whole dollar unit price multiplied by the number of units. For CLIN 0002, including option periods, each Price Exhibit (Attachment 2) line item extended price will be determined by multiplying the unit price by the quantity. Each Price Exhibit line items’ extended prices will then be totaled to arrive at the total price for CLIN 0002 including option periods. The Government reserves the right to evaluate each Price Exhibit line item unit price, extended price, and total price of all line items. A determination of price fair and reasonable will be established for each Price Exhibit line item. The totals for CLIN 0001 including option periods will then be added to the total price of CLIN 0002 including option periods to arrive at the total evaluated price (including the six month option periods-see note 2 below). The price evaluation will document the reasonableness and completeness of the proposed total evaluated price. The Government reserves the right to perform price realism analysis.

NOTE 1: The Government will evaluate the “equal” items to determine if the product description provided by the offeror is acceptable. If considered unacceptable, the Government reserves the right to request additional product information for consideration.

NOTE 2: The price equivalent to the six (6) months extension of services authorized by FAR 52.217-8 will be evaluated and factored as part of the total evaluated price (TEP) for award. The Government will calculate proposed prices for a quantity equivalent to 6 months by prorating prices offered for CLIN 0001 and all corresponding option CLINs under FAR 52.217-9. For CLIN 0002 and all corresponding option CLINs under FAR 52.217-9, the Government will multiple the total extended amount by 0.5. Not to Exceed (NTE) CLIN 0003 and all corresponding option CLINs under FAR 52.217-9 will not be included as part of the TEP. Therefore, the offeror does not need to provide amounts for the NTE CLINs established by the Government.

NOTE 3: The Government will assess the country of origins filled in by the offeror to ensure compliance with DFARS 252.225-7021. Items not in compliance with DFARS 252.225-7021, the offer will no longer be considered for award.

C. Past Performance. The Government will seek recent and relevant performance information on all technically acceptable offerors based on (1) the references provided by the offeror, (2) past performance information obtained from questionnaires (Attachment 5), and (3) data independently obtained from other government or commercial sources.

Recent performance information includes relevant contracts performed for the Department of Defense, Government of Japan, US Government agencies, and commercial customers within the last three (3) years from the issuance date of the solicitation.

Relevant performance includes performance of efforts involving Operation, Inventory, and Management of a Government Contractor Operated Hardware Store that are similar in scope, magnitude, and complexity than the effort described in this solicitation. The Government will use the relevancy definitions and ratings in Table 2 below when assessing for relevancy:

Table 2. Past Performance Relevancy Ratings Rating Definition Rating Definition

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

In evaluating past performance, the Government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation.

The purpose of the past performance evaluation is to assess the degree of confidence the Government has in the offeror’s ability to provide efforts involving Operation, Inventory, and Management of a Government Contractor Operated Hardware Store that meet the solicitation requirements based on the offeror’s demonstrated record of performance. The assessment process will result in an overall performance confidence assessment rating of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or Unknown Confidence as defined in Table 3 below. Past performance regarding predecessor companies who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement will be rated as highly as past performance information for the principal offeror. Offerors with no relevant past or present performance history or the offeror’s performance record is so limited that no confidence assessment rating can be reasonably assigned shall receive the rating “Unknown Confidence,” meaning the rating is treated neither favorably nor unfavorably (neutral).

TABLE 3 – PERFORMANCE CONFIDENCE ASSESSMENTS

Rating Description

SUBSTANTIAL CONFIDENCE

Based on the offeror’s recent/relevant performance record, the Government has high expectation that the offeror will successfully perform the required effort.

SATISFACTORY CONFIDENCE

Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

LIMITED CONFIDENCE

Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort

NO CONFIDENCE

Based on the offeror’s recent/relevant performance record, the Government no expectation that the offeror will be able to successfully perform the required effort

UNKNOWN CONFIDENCE

No recent/relevant performance record is available or the offeror’s performance record is so sparse that no confidence assessment rating can be reasonably assigned

D. Integrated Assessment. In order to be considered for award, the offeror’s technical proposal must be rated as “Acceptable”. The Government reserves the right to award a contract to other than the lowest price offer if the lowest priced offeror is judged to have a performance rating of “Satisfactory Confidence” or lower. In that event, the Source Selection Authority shall make an integrated assessment best value award decision.

Offerors are cautioned to submit sufficient information and in the format specified in the FAR 52.212-1 and/or its addendum. Offerors may be asked to clarify certain aspects of their proposal (for example: the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.

The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
