FA524024Q3002 – 554 RHS ICF Debris Removal Attachment 5 - Evaluation Criteria
52.212-2 Evaluation—Commercial Products and Commercial Services (as addended).
Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers as acceptable or unacceptable (pass or fail):
(i) Capability of the item/service offered to meet the requirement(s) of the PWS;
a. Acceptable is defined as offer/proposal meets requirements of the solicitation.
b. Unacceptable is defined as offer/proposal does not meet requirements of the solicitation.
(ii) Past performance: the government will evaluate recent and relevant performance information on all offerors based on information provided by the offeror; any past performance information obtained from survey/questionnaires (Attachment 8); and any data independently obtained by the government. Offerors are responsible for submitting past performance information as part of its offer/proposal—failure to do so may result in an unacceptable rating.
a. Acceptable is defined as: based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
b. Unacceptable is defined as: based on the offeror’s recent/relevant performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
c. Recent past performance information is defined as contracts performed and/or being performed for any customer within the last three (3) years prior to the issuance date of the solicitation.
d. Relevant is defined as present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
(iii) Price: the government will rank the Acceptable offerors by price. The evaluation will document the fairness and reasonableness of the proposed price. In addition, each offeror’s separately priced line items or subline items shall be analyzed to determine if the prices are unbalanced. The government reserves the right to perform price realism analysis. In the event that the Government elects to perform price realism analysis, the Government reserves discretion over the methodology used. If the Government elects to perform a price realism analysis and finds a proposal unrealistic, the Government may withhold award to that offeror.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
